I am claiming my bank charges for the last 9 years not 6, I have been trying to find the forum with regard to doing this (as it says there is a separate one in the FAQ's) but I cannot find it anywhere? Is anyone able to point me in the right direction, RBOS responded immediately to say they would be defending the full amount so I want to be prepared.... Any help much appreciated! Michelle :grin:
  2. Hi Lynzilou, Thanks for all your help, I couldn't get the postcode to work so to be safe used my branch address instead! So the court have issued the papers and they've now got until 18th to respond, bit nervous, because its quite a large amount, reckon they'll put up a fight! Keeping everything crossed for next couple of weeks!! Michelle

I am about to complete the Moneyclaim against RBS, I have entered the address as their Edinburgh office as this is where I have received correspondence offering settlement figures from but should I be using my Branch address, which is in England?? It says 'The address details you have provided outside England and Wales.' Any help would be much appreciated Thanks Michelle

    Thanks, this website is brilliant, nice to be able to contact people going through the same! The claim is for about £800 including interest, however since then there have been a couple more charges, can I add them on do you know?? Michelle

    Got a Court Date now of 19 December - talk about drag it out!! Been reading the other threads, I'll await their phone call before we get to court! (fingers crossed anyway!!):grin:

    I'm so pleased I read this thread, I have just received my Court Date with Cahoot for 19th December!! Can't believe its so long away! The letter received from DLA Piper saying no breakdown of charges and interest had been received was practically a carbon copy of what they sent to me, I also replied to say that it had been sent twice already! Am really nervous about the court date? Do you know of anyone that has met them in court?? Good luck with your court date! Keep me posted how you get on!!

  11. Hi Paul, Use the templates provided on this site, you firstly need to get all your statements and work out the charges you are able to reclaim. Then send the first letter requesting they refund your charges, if no response or a counter offer, I would proceed to the letter before action (LBA) and then when their 2 weeks is up go on to the small claims court and start proceedings. Everthing you need to know is in the FAQ's. Good Luck Michelle

    I have received my Allocation Questionnaire from the court along with the defence. This is pretty scary, is it normal for it to go this far?? On another note, I have looked everywhere and am probably being stupid but how do I put the stages of each of my claims like everyone else has at the bottom of each of my messages????:?   13. Royal Bank of Scotland have sent a letter saying they will not be refunding any of my charges. I now need to send the LBA, there are some extra charges that I had not listed in my first letter, as long as I detail them in the LBA on the breakdown of charges, will it matter that I have changed the amount I am claiming for? Thanks Michelle
  14. Hi, I can't believe RBS, I have just had a call from them to say that they will only refund: Card Misuse (if under £10) Charges incurred because of charges Unpaid Items Duplicate Charges (??) However they will not refund any Referral Charges - My claim is almost £3000 with interest, all but £60 are Referral Charges, so they have told me I can claim back £60!!!!! Apparantlely I will receive a letter tomorrow stating this. I said that I did not believe this to be the case and advised I would get back to them. Their response is to the first letter being sent, in light of the letter I receive tomorrow should I proceed straight to the Court?? or still send the letter before action? They also said that the OFT's statement refers to charges applied to Credit Cards and the Current A/C charges have not been looked into. Thanks Michelle
  15. I have just sent my Letter before action, they have until next Tuesday to respond, I received no response to my initial letter. I am trying to claim back nearly £800, I was shocked when I found out how much it was, amazing how they all add up. Good luck with you claim, keep us posted! Michelle
  16. Not sure I sent the first letter requesting list of charges to the correct address so yesterday I sent the letter to my actual branch. Just had a call from them asking me what I meant by manual intervention!! Felt a bit stupid as I don't recall the exact wording in the letter, had to make excuses until I was able to find the letter on my PC and read it again!! At least I know they have received it now - just waiting now!!

    Hi, I sent my letter requesting my charges back on Friday and so far not heard anything, I'll give them til next Friday and then I guess take the next step - feeling nervous!! I'm worried this action may affect my credit rating??

I actually got a phone call from the Bank today to let me know I have a direct debit going out which will take me over my overdraft, I told them I transferred funds from another account on Tuesday and would hope they will be in the account tomorrow so no charges will be going on to my account. While I was on the phone I asked them if they can provide my statements and immediately she answered it is ot worth me going to the ombudsman as they have justified all their charges - is this the case?? I expect its a standard speech they've been given....??
  19. Thank you, I will look through the threads, but as yet can only see that people have sent the letters to their branches, think I'm worrying unduly!!! Just want to get the ball rolling!!:grin:

I sent my request for statements for the last 6 years, last week, to the RBOS address on the DPA link, everyone else seems to have sent their letter with their cheque to their Branch - has anyone else sent theirs not to the branch?? How long did it take before the information was sent, I know it says up to 40 days, just wondering if it will take that long?? Thanks.
  21. I think I'm confusing myself now, I sent the letter requesting all charges with the £10 to the address from the DPA link above the template letter - should this letter also go to my branch??

  23. Hi all, I sent the letter with my £10 to request all my statements yesterday. I know they have up to 40 days to send this information to me but is this how long it is likely to take - I imagine they will delay it for as long as possible?? Can anyone help me as to what I can claim , is it anything that appears on my statements as a Charge, i.e. I used to be charged £10 per month for my Royalties Account, then charges about £7 a month for the overdraft, plus all the usual referral charges etc... I think if I can claim everything it amounts to about £2000. Good luck to everyone pursuing this - Martin Lewis is a genius!! Michelle
