1. OK SMJ, Thanks for that. So let's open it up to the wider population. Has anybody been taken to court when involved with a parking dispute at a station? and was it a CPN (Civil Penalty Notice) ie 'an invoice' or a PCN (the fiendish 'Parking Charge Notice')? Paul Adams aka 'seething' see my story here in the local paper Express and Echo, Exeter.
2. It is not a fine it's an invoice! If they want to recover this sum from you they would have to take you to court. They most probably wont especially as they would probably lose the case. They do not have the same powers as the police, local authority or traffic wardens. Furthermore their tickets should not look like parking fines (it's a CPN not a PCN right?). If so THEY are breaking the law. You have your permit so I would suggest you ignore them. If they harrass you for it, then go to the police. If they give the impression that you are breaking a criminal law then THAT is illegal in itself. Paul Adams see my story here in the local paper Express and Echo, Exeter.
3. Hi hewston, The only thing you need to do is not pay them!! If they give the impression that you are breaking a criminal law then THAT is illegal in itself. You may have broken a contractual agreement. So what? Paul Adams see this from my local paper about my dealings with them "Parking ticket wrong colour escape"
4. Hey hey hey, Just found an old disputed ticket that IS Illegal!! (I'm already very angry about I ticket I got when the machine was full and wouldn't take my 20p) I had paid for a season ticket £120 six months!! (cash only no credit cards!!) My mistake was that I parked in 'Heaths Nursery' which isn't allowed and not 'Heath Way' or 'The Nursery' which are both OK. (see the difference??) My appeal to them was refused. I paid up as they threatened court action, which they accepted in 'full and final settlement of the matter'. LOOK!!!!!! This is what is written on it. (No 'date of Issue') +++++++++++++++++++++++++++++++++++++++++++++ Parking place standard charge notice. Road traffic act 1984 (as amended) To the driver of the vehicle shown below. Payment slip. Parking place standard charge £40 You are informed that this vehicle was parked in contravention of the above order as shown below; Ticket number: 303892 Inspector: 06 Parking place: Heaths Nursery Area: Registration number: YLU999X First Noticed at: 18/11/02 and 14:37 Time on Ticket: 00:00 Make: Volkswagen Colour: Brown/Faun Fee Paid: 0:00 Unpaid charge: £0:40 Licencing authority: KINGSBRIDGE Time of issue: 14:38 Signature of inspector (followed by illegible scribble, probably can't read/write ; ) SEASON TICKET NOT VALID IN SHORT STAY CAR PARK HSBC loan - DPA letter sent 6/06/06 (OK it was really 9/06/06 but it's more appropriate isn't it?) HSBC credit card - DPA letter sent 6/06/06 HSBC 3 accounts - DPA letter sent 6/06/06 RBS (Mint) Credit card - DPA letter sent 6/06/06 Lets hope that light at the end of the tunnel isn't in fact a train coming the other way.
5. Hi, No, the interest with Liv Vic was FROZEN when I first got into difficulties. Not so with the HSBC and RBS, they pressured and hassled me to push up my repayments, so now I have defaulted on them too. I am already being advised by the CAB. I am shortly aiming for an fixed arrangement with reduced liability rather than Bankruptsy, that way I will have managable repayments and get to keep my company!! That way there is light at the end of the tunnel (Let's hope it's not a train coming the other way : )
6. ...and no, I don't feel entirely responsible. I'm not extravagent nor do I have any expensive habits. The first time was during a recession when every business around me was going down. Even my agent went out of business and I was the last one working for her. People I had done work for couldn't pay me. I never really recovered from that. and the bank forced me into it!!!!!!!! The usual, they would charge me for not having the money to pay them and then charge me for being overdrawn and then have the audacity to charge me £10 for a letter to tell me what I already knew. (I told them that "if I could charge people £10 for sending a standard letter, then I wouldn't be in the mess that I was in"). Oh I wish I could claim back from 20 years ago. More recently, I tried to start a business underfunded, so again have accumulated debts of £30,000. I had it all under control until very recently, when my sporadic work with high expenses finally caught up with me and I was caught out whilst working miles from home, unable to get any money to eat or get me back safely. I had to sleep the night in my car. Why? because I had paid an unjust parking fine which had pushed me overdrawn incurring charges. Total £45. Nothing left, I'm finished. UNLESS I CAN GET ALL THOSE UNFAIR CHARGES BACK, THEN I MAY BE ABLE TO SAVE MY BUSINESS AND CARRY ON MAKING AN HONEST LIVING!!!!! - Seething btw. I have a 'debt consolidation loan' and credit card, both unfortunately in default, from 'Liverpool Victoria' I am currently paying £1 per month for each. They have not made a single unfair charge for anything, only regular interest. and they haven't hassled me either! 7. Hi Rich, Thanks for your reply. Here's the scan. I have however paid the ticket as I believed that I was liable and didn't want to risk paying £60. The PCN just states "Issued on: 09/06/2006" Is that the same as "Date of Issue" or is this also illegal?? Also the time says "issued at 08.00" ie not am/pm.
8. I received a £30 charge for parking overnight in a 'FREE" zone in Milton Keynes. clearly marked with a green line. On returning to my car I was amazed to find a PCN (and a cracked windscreen!!!) My main issue is that the large sign at the entrance read quite clearly that the green zones were free, no mention of the "permit holders only restriction from 7.00 to 8.30am" (I got the ticket at 8.06am although it says only "at: 08.06" on the ticket!, not am or pm.) Yes, that was on a very small sign at the end of the line of bays, which I didn't see. I wrote back about the issue including photographs of the signs but they said I should have seen the notice on the machine! Why would I even be looking at the machine in a "free" zone? This surely is a case for not seeing the "small print". Has anyone else been in a similar situation? Regards seething.
