  1. Have just asked bailiff about his certificate as there are 3 listing for his surname on bailiff register, he is not one of them. He said thats because he works for them as a self employed agent and that he is certificated at ********** court. He also refused to give his first name so that I confirm that non of the 3 listed bailiffs with his surname was him! I also asked what the procedure was for dealing with vulnerable people and stated that according to the insolvency helpline I was classed as vulnerable as I was a lone parent and a student. He said to call the company and asked them. I asked to see a copy of his certificate and he said I didnt need to as I could contact ********* court for confirmation.
  2. Hi, I stupidly didnt pay a parking penalty and now have a bailiff knocking on my door. I did not recieve a notice to owner and so after he came yesterday I downloaded an out of time stat declaration and sent it to TEC after having it witnessed at local court house. However, the bailiff put a letter through my door - a 'notice of seizure of goods and inventory' for my car. However..... I sold my car on the 01/03/2010 but have only very recently sent off the log book to change the registered keeper. If the bailiff checked then the car would have still been registered to me at the time although the sell date was before. I have made offers to pay in installments several times in the past 2 days which he has refused. I told him that I have filed the out of time stat dec but he said as it was done after he seized the car, it doesnt count. I am a student nurse who uses my car to get to my placements and uni and am also a single mum of 2 children. The notice of seizure also was not dated - it was left blank. I would like to know.... 1) Is the notice actually valid because it is not dated? 2) Can he seize the car as I have sent log book off saying that I sold it on 01/03/2010 but the DVLA wouldnt have received that on the day he seized the car. 3) Can he actually take the car as I use it for hospital placements which is a vocation?* I live 25 miles away and cannot get there without the car. 4) Can he still seize the car because he posted the notice before I sent the out of time stat decl? Of course I will definately NOT be letting him into my home - all windows closed and garden valuables locked in shed. The PCN is from the council. *I have mentioned that i thought the bailiffs couldnt take the car because i am a student nurse and I use it for uni as I found this infor on a website... " Are there any goods that the bailiff cannot seize? Bailiffs (except bailiffs acting on behalf of the magistrate's court - see below) cannot seize the following goods: tools, goods, vehicles and other items of equipment necessary for use by you in your employment, business or vocation; clothing, bedding, furniture, household equipment and provisions as are necessary for satisfying the basic domestic needs of you and your family" Does uni count as a vocation? Any help appreciated!
  3. hi, my PCN for parking on double yellows states: 'served on XX/XX/XXXX at 17:22 by civil enforcement officer XXXX who had reason to believe that the following contravention had occurred and that a penalty charge is now payable Parking in a restricted street during prescribed hours.....' Is this valid? I was parked only just on double yellows, was mainly in a parking bay and had brought a ticket which expired 1 minute before the ticket was issued!!!! Any advice appreciated - I have 2 parking tickets - the other of which was my own fault which is causing me the majority of problems and I will start a post about this one seperately! Thanks CMB
