    i am prepared to pay the outstanding amount (missed payments) and the original d/d of £52 a month.

    but i don't have a income and my father is going to loan me the money(no pressure to repay),

    so probably because i don't have income it would be difficult to enforce.

     

    this way they'll get their money but i don't want a ccj registerd against me.

    do you think they'll accept that?

    i will send a cca or a dpa?

    cos i'm sure that charges have been put on...…

    ...i really would rather not go to court.

     

    do you think they'll negotiate about this and default.

    sorry to seem so needy,

    i'm not really but am a wreck about this.

  2. no it's okay Alan, I realise that you're not a lawyer and that the advice is given by lay people. my point is simply that your knowledge has helped me and i'm sure others. the debt was passed to intrum justitia who i had been paying regularly, when i was ill and missed payments it's been a company called debt investigations (UK) ltd that's been writing, they say if i don't arrange payments with them it will be passed back to intum justitia. so would i send CCA to both companies? original debt was with HSBC. thanks

  3. thanks for that. god it is so empowering to take charge of your finances again and to know that you're not the lowest of the low for having money problems. All I can say is God help them! cos I am all guns blazing now. I have been in the depths of misery for several months now because I couldn't see a way out that didn't include going bankrupt or something involving debt management. but now i will sort out what i actually owe and what these theivin gits have added on. Thank you for replying.

  4. alan, you're not a lawyer by any chance??? if you're not you should be! all your postings are increadibly helpful to me. I've struggled with debt for about 15 years, single mum, working etc. until i found this website I have always felt totally ashamed and humiliated by my debt problems. since reading all of this i realise that a huge amount of what i struggle with is charges etc put onto my accounts. not any more, god help them! I am about to send CCA to a dca and DSAR to original creditor. The origial creditor passed it to dca 1 who then passed it to dca2. who do i send the cca to. I notice your copy was to HF regarding Robinson Way (ex HFC). sorry for being thick but who was your original creditor? HFC? so who then was Robinson way and Horwich Farrelly?

    I have a loan with HFC which i have paid on time every month for the last 3 years.

    i had some trouble earlier in the year and in march didn't make payment and hid head in sand.

     

    the loan defaulted in april and i have been served with a summary cause summons with a return date of 26th july.

    what can i do as i am terrified, but can't afford to pay it all ~ £800.

    any help would be great.

    i have read thru threads but can't find anything about summons.

    I've just just received a summary summons from HFC for a credit agreement I took out in march 2003,

    i have never missed or been late with apayment since then.

    so far i have paid back £1900 out of £2496.

    but in february I lost my job and have been struggling and burying my head in sand.

    the return date is 26th july.

     

    so here's what i've done if anyone has any ideas i'd be really grateful.

    I don't want a ccj registerd against me.

    I am writing to HFC with a cheque to cover the missed payments and requesting a new direct debit form.

    i have informed them that i have no income or assets and that my parents are prepared to assist me in paying it off IF I can negotiate at this stage, i haven't openly said that if they don't accept then i won't be able to pay, but since i have no income or assets then don't know what the court would order...

     

    . I've also asked that they remove any defaults registerd against me.

    I also plan to send a data protection act etc to them since i know that charges have been added, which i think might help?

     

    could anyone give me any advice before I send this letter...

    i would be really grateful since i'm worried sick

  6. Hi, I've been following this forum with interest and have decided to launch my own claim against BoS. I have 2 accounts, a current account and an easycash. The easycash one has only accrued a few charges, but the current account has gone way over overdraft and i reckon it has about £2000 in charges applied. This is what makes up most of the balance. they have passed it to a debt collection agency now. really angry because i always had a really healthy bank balance and because i've been off ill and had some problems financially, these charges have pushed it off the scale. have opened a parachute account and will transfer my easycash balance to new account. anyway how can i stop the debt on current account increasing while i do this claim and should i write to debt collection agency informing them of my claima nd that the balance they are seeking is mostly made up of unlawful charges? thanks.
