  1. Hey everyone I was so busy yesterday I didnt get on. Thanks again for all your wishes and congrats its so lovely to get it. I did go to court and had a chat with the judge who was very nice but a bit confussing at times. I got my money today Had a little celebration with 3 bottles of Cava (Lush) hang over today tho but I WON!!!!!! tried to donate on the site today but my paypal account wont let me as I have to be verified or something. Perhaps if the site had other funding options rather than just paypal I could have done it today. Thank you all one more time I shall be doing it all over with the joint account, bye for now.
  2. Responce from Abbey... I have faxed confirmation of settlement to the court and have a transmission verification report as evidence of my correspondence. I have settled your claim in full and final satisfaction and will seek to rely upon this correspondence as evidence of settlement. I hope this clarifies our position,
  3. Thanks amethy its all worth it in the end. I have just e mailed Abbey again as the court have told me that they have not received any information from them. This is what I said.... The court has not been informed of this settlement as I have just asked them myself less than 2 minutes ago. I look forward to the part payment and will advise you of additional costs once I have spoken to the judge.

Payment in the sum of £3811.80 will be made into your account by 10.00am tomorrow morning. The Court has been informed of the settlement in full.
  5. Your not a million miles away are you LULA? Just e mailed them and said this. Dear Louise thank you for accepting liability. Unfortunately I have just contacted the court in order to have a stay of 2 weeks to allow you time to process my funds, and have been advised I need to do this today. This will not be the case as I am at work today. I shall contact you tomorrow with a revised figure as this delay which has been caused by you will add more costs onto my case. I will take this e mail to court tomorrow and discuss this with the judge and advise you ASAP.

Thanks Lula I did get all that I asked for including admin costs etc. I have just spoken to the court who tell me I need to be in court today to get a stay of 2 weeks at a cost of £35 I explained my situation to them about the e mail and my concern with them not paying out in some cases and was advised to turn up with the email from them, and have a chat with the judge and just be declared the winner I dont mind as it may get Shabbey into trouble Drink anyone?
  7. OK I want to jump up and down now and say thanks to all the people who make this site work for all the people fighting the banks etc. We cant do any of it without all of you. I shall deposit my 5% as soon as I receive the money. Just need to know what I have to do next?

Dear Mr Bralant, I too have now checked your file and see that no court bundle has been produced nor has counsel been instructed. Thus it seems an administrative oversight has occurred and we are (as you quite correctly pointed out) in default. I can therefore confirm that Abbey National plc will settle your claim for the full amount of £3811.80 (this includes a reduction for the £250.00 already refunded to your account on 15/9/06) I will request payment today and this should be deposited into your account within the next 3-5 days. Please accept this email as evidence of our agreement to settle this matter in full and formally withdraw your claim with the Court. Please also forward a copy of your letter to the Court onto us as soon as possible.

  15. have e mailed this to them Dear Louise, thank you for response. I have contacted the court and they have confirmed you have not submitted any evidence (Court bundle). I therefore feel you are being unreasonable as you are fully aware of the court deadlines and need for evidence etc and I will win by default. I will settle for 100% and nothing less and will increase costs I incur, if I need to waste a day off work, and will inform the court of your delaying tactics which surmount to wasting public court time. I look forward to hearing from you later today with a full settlement offer.

In response to your email, I am writing to you in order to negotiate a settlement with regards to your legal claim against Abbey. After having verified your claim, I believe the total claim currently stands at £3811.80 (including all interest to date, all court fees and less the goodwill gesture received of £250.00 on 15 September 2006) . In both the interests of commerciality and the over-riding objective of the court process, Abbey would like to make you an out-of-court settlement offer of £3100.00. This reduced amount reflects the fact that some charge should have been levied on each of the defaults made against your account and also that an out-of-court settlement will undoubtedly avoid any further time and/or costs expended in the pursuit of this legal claim. Given the imminent court hearing, this offer will stand until the end of today, please let me know whether you wish to accept this offer and I will process payment. I look forward to receiving your response, .................................................................................................. I have also called the court and they told me the bank has not submitted any evidence. I asked if this means I win by default and the person at the court told me "No" I still ahve to turn up for the hearing as normal. What do you think gang?

I have gone through all the normal prcedures etc. I posted for help a while ago and no one responded I just dont know if I have everything ready as I have done this all on my own. I submitted the 3 bundles etc and will be in Luton court on Thurday morning. Who do I call at Abbey?

  23. Hello all just need to know if I should have heard from Abbey by now as its been some time since I submitted all the case to the court. The hearing date is May 10th but not a sausage from Abbey?
  24. I have now served the papers to Shabbey and to the court. Do I now wait till my court date of May 10TH
