Hi I have received a Gross Misconduct letter about 3 separate incidents which were supposedly alleged in September 2009. Three staff members in total were given these letters all on separate issues. No investigation has happened, and I have not been given the chance to explain and I have also tried to give HR evidence. HR have informed me last month (May 2010) that due to organisation difficulties no investigation will happen. However, HR have stated they will be perusing a personal development policy. This assumes I am guilty of the allegation, and will involve extra training and will be marked on my personal record. I have suggested that this is not in my best interest. The other two staff members have taken up this ‘offer’. HR have stated that they will peruse the gross misconduct investigation with myself. 1) Can HR re open gross misconduct investigation ? 2) if others have been treated differently I.e. taken the route of personnel development does this mean discrimination? 3) 7 months since letter arrived 9 months since allegation.

Patient not given medication. I am under investigation of gross misconduct (NHS) for the above. following is the issue: (Names been deleted or changed) Harry nurse in charge of evening shift at about 16:00 on the ** decided to take out two people (female) and (female) out on a trip using his own car as the unit vehicle was suspected to be broken. He was also accompanied by a Health Care Assistant ****** According to harry nursing entry timed/dated *** on the **** as seen on both peoples respected notes, harry returned back late. He mad an apology to ** for the late return. According to person **medication chart she was due a dose of ** mg prescribed for the Evening. It is normal practice on the Unit () to give prescribed Evening medication at 17:00. I norhtwalesman on the date** was not allocated and has not been documented that I was to give prescribed medication on the late shift. I can not recall if anybody was in fact allocated the duty of giving prescribed medication for the that evening shift. As harry had taken out person ** during the allocated prescribed medication time i.e. 17:00 it would have only been possible for person ** to have her ** on her return to the Unit. Person ** and ** had also missed out on there meals . As serious disorder harry should have made adequate arrangements’ prior or at least on their return to the Unit to arrange for ** to have her prescribed medication and to have food and water. As ** prescribed medication ** was allocated as an Evening dose. harryl therefore could have given it on their return. There is no mention either on ** medication sheet or Nursing notes of an attempt to give the Evening dose of or ask fellow Nurses on duty or contact the on call Nurse or the on call Psychiatrist for advice. Furthermore my first notification of person ** not receiving her **was in 3 month later. instead harry filled out a complaint form, now im being investigated awaiting date of hearing. Any suggestions.
