  1. Well verbally shoosmiths say they are chasing the ca but will continue to take payments as a court order takes president. We are going down the route of sending a sar to natwest as the local branch cannot find any details on it and we want to sort the ppi out first. Could anybody point me in the right direction of a sar template letter, and should i be sending this to natwest head office or the local branch where it was taken out ? Thanks in advance.
  2. The afore mentioned ca, and yes it was made fairly clear to my partner she would not have got the finance without buying their ppi.
  3. Any help on where to go from here ? Its been 20 days since i sent them the ca request and nothing in writing back from them at all. My Partner phoned them last week and they confirmed they had received it and were looking into it. All the paperwork she can find regarding the loan is a thin duplicate ca with all the ammounts on, but no policy number for the ppi and no signatures on it at all. Should i start by asking natwest for a sar?

  6. Have sent apex the second after 12+2 days of not receiving my ca letter and received a reply that they are pushing egg for the relevant documents. I was wonder whats best to do from here when its reaches 30 days and i still have nothing ? Do i inform the relavant authorities ? What can i expect from them next ? Same goes for my cabot thread, at the same stage.
  7. Hi all This is my partners debt but i am handling it for her. My partner defaulted on a £25k debt to natwest on 18/11/06 She came to a agreement with them to pay it off, wich she was without ever missing a payment. When on 01/02/08 they passed the debt onto shoosmiths, she carried on paying without ever being late,missing payments etc. On the 21/07/08 shoosmiths sucessfully got a charging order on our house. It has been 16 days now since we sent shoosmiths a ca request and we have heard nothing back(my partner called them and they said they had received our request and were looking into it). Are we chasing a dead duck here ? If the ca proves to be unenforceable can we have the charging order removed eventually or is it too late ? Also there is the small matter of the £4k ppi she was sold with the loan ? I dont want to push it too much with shoosmiths as im not sure where we stand at the moment. Any advice gratefully received.

  10. Hi Much the same as my apex thread i thought i better get one thread per company going. Just posted my 12+2 days letter to cabot for failing to provide me with my credit agreement and i guess this is when they are going to start getting desperate and nasty. They have also totally played ball so far. They wrote to me saying they were suspending all activity, taking payment etc, but admitted it was highly unlikley they would be able to find my credit agreement in the required time limit. I have got to admit i am begining to really enjoy this now,it makes a change to get desperate apoloject letters from dca,s rather than threats !! This is over a citibank credit card which i think was mbna when i got it 13 years ago or so.
  11. Thought it was about time i started a thread on this as im going to need help soon i guess. Just sent my 12+2 days letter to apex today for failing to supply me with my credit agreement. To be fair to them they have played ball so far(apart from one young snot who called me and knew nothing about apex writing to me, agreeing to suspend activity, and not contact me etc). It was a 12 year old plus egg account, so the best of luck to them!! I wait with baited breath for their reply.
  12. Hi After requesting a copy of my credit agrements from apex and cabot, i received a prompt reply from both parties. Apex agreed to halt action on the account while it was in dispute but cabot while accepting the account was in dispute have still taken a payment from me. Any advice would be welcome before i contact them tommorrow. It will not be 12+2 days that i wrote to then until the 5th of feb.
  13. Was handed a booklet with the general aim of the nursery outlined when i asked for a copy of the t&c's. Nothing mentioned about unforseen closures at all. But i was welcome to take my kids elsewhere if i was unhappy. I think i might just call the local paper about this.
  14. Last wednesday we recieved a call around 6am to say the nursery would be closed due to the weather. This nursery is open all year round bar xmas and boxing day which we have to pay for whether our kids are there or not. Today we were informed we would be charged for last wednesday regardless of the fact they decided not to open. How do we stand on this ? :idea:
