  1. Provider: Capital One Amount Reclaimed: £432.00 Amount they paid: £373.00 The story: In mid November 2009 I wrote to Capital One requesting statements. They wrote back to me saying that I had not made out the cheque (for the £10 fee) correctly so I would need to amend it and return it. I wrote out an amended cheque and returned it to them only to have them write to me again saying that I had forgotten to sign the letter that I had sent, so I signed the letter and sent it back to them again. My statements finally arrived at the beginning of January 2010 and I added up the charges and the appropriate interest and wrote to Capital One asking for a total of £432.00 to be returned to me. On the 25th of January I received a letter back from Capital One saying they have looked at my case and they made me an offer of £9.15 (which represented the difference between a £20.00 charge and what they deemed to be a "fair" £12.00 charge), they also spouted some of the OFT rulings claiming all the charges were fair etc. So I wrote back to them refusing their (ridiculous) offer, stating that I did not agree with what they were saying and that I now planned to pursue my claim via the Financial Ombudsman and/or court proceedings. They swiftly wrote back to me stating they had re-assessed my case and were now prepared to offer me £373.00, which although it was not the full amount I asked for, I accepted as I believe this was a reasonable amount. I advise anyone pursuing a claim with Capital One to persevere and not be put off by their run around methods or paltry offers. I'm happy with the result even though it took over 4 months.

  3. Thanks alot. So are you suggesting the first thing i should do is ask Cabot (or Vanquis?) for my original credit agreement? Am i right to assume they would be unable to provide it? Or would they provide it and i would need to go over it with a fine tooth comb to find loopholes? Do you have any comments regarding the refund of the "unfair" charges they have levied on my account? Thanks again, you are being very helpful!
  4. Oh yes, they have sent me various "deals" stating they will half the debt if i pay such and such amount right now or if i sign up to monthly repayments they will double my payment amount and such. Ive been ignoring thier calls and letters for months now. What does CCA them mean?
  5. Sorry, yes the company is called Cabot. What is Notice of Assignment? The only paperwork ive received from Cabot has been short letters giving me "special offers" for making repayments....
  6. I took out a Vanquis Credit Card in 2006. It started out with a 500.00 limit which was rapidly increased to 1500 once i started using it. I found the monthly repayments unmanagble as the interest was massive, i was paying around 60.00 per month and of that only about 20.00 was actually coming off my balance, the rest being interest payments. I then lost my job and neglected the repayments, Vanquis started adding 35.00 overlimit and late payment fees totalling at least 70.00 every month. The debt now stands at about 2500 and has been sold to a company called Cahoot who pester me constantly to make repayments to them that i cannot afford. I have a few questions im hoping you guys can help me with regarding this situation: Firstly, I wish to dispute this entire debt because the majority of it is made up of "unfair" charges. Would i need to contact Vanquis or Cahoot to air this grievance. should i make a claim for my unfair charges to be refunded to me? If i was successful in my claim would the money from Vanquis be paid directly to me or would it go striaght to Cahoot and id be liable for the rest? Also, if the debt is being disputed by me would this mean it becomes unenforcable by Cahoot? Any info or advice would be grateful received.
