  1. Beach thats awful. How can they keep a car for 3 months till auctioning it when they go on about the car losing value everyday you keep it. This needs to go to Ofcom and Ill defo be contacting Watchdog about this. I hope Mark and others can help you resolve this.
  2. Thank you everyone. Beach do you have all your annual statements from them? If not, ask them to send it to you, showing every payment that was made. This is your back up! Also keep every letter, note every phone call and keep those statements from your phone company. Many phone companies will send you these and back dating a year or more. Ill be sending a letter to Ofcom and watchdog about Mercedes. They use bully tactics and its unacceptable especially in these hard economic times. The worse thing with Mercedes is that they want all or nothing and made no effort to help us. They told my other half....dont bother paying us as its going to a debt collector anyway! How crazy is that? After 2 payments missed!!! And they put this on their website Q. What should I do if I find myself in financial difficulties? A. The most important thing is to let us know right away. We’ll explore options with you and see how we can help. Yeahh right!! If they had, we would have never been in this situation and with a cost of £400 in legal fees. Which I feel was unjust! Also Beach when you call Mercedes only speak to a guy called Ricky Napoli, he was the only half decent person there. But as you know Recorded letters are the way to go. So what happens now? Are they coming for the shortfall?
  3. I just wanted everyone on here, who is going through repo that all is not lost. We were taken to court this week over 2 and a half missed payments which we tried paying but Mercedes would have none of it. They wanted it to go to court as the agreement was PCP and they wanted us to keep the car and pay the £4000ish lost on its value and not them! Or sell it at auction and come to us for the shortfall, again making us pay for the lost value of the car. Thats my impression anyway. To cut a long story short we defaulted in December. The agreement was terminated in Jan. We were given the option of voluntary surrender but we refused as we agreed with Mercedes that if the arrears were paid, the contract would be reinstated. We also got this in writing from them as Ive seen on this forum that Merc have gone back on their word and contined with legal action. Anyway they wouldnt take payment for the arrears and basically, eventhough Blake Lapthorn were aware of this letter and agreement, Mercedes would not accept, as it was too late. We were never given a time frame other than it needed to be done before the court. We had no time to get a time order and we were very confused and scared. Had it not been for MarkieMark1 on this forum we would have been lost. He gave us all the advice we needed, told us not to worry and thankfully we listened to him and went to the hearing. On the day, Blake Lapthorns people did not turn up, neither did Mercedes. A woman was there apparently to represent them but I still have no idea who she was. Ill dig out the paperwork and let you all know at a later date. She tried talking to us before the hearing and scaring us. Telling us that Mercedes would not accept anything less than £1000 a month!!!!! Luckly Mark gave us his number so we called him and he assurred us that everything will be ok and that we should not talk to this woman at all and concerntrate on what we had prepared. Soooooooo my other half went in to the hearing. The judge instantly said he would not grant a court order for 2 or 3 months late payment but wanted to test it out and hear our side of the story. We explained that we tried to make payments, showed the letter sent to us by Mercedes, the calls made and when BUT the most important, the incorrect figures that Mercedes had provided too!!!! We also showed that we had the arrears and even accounted for the last 3 momths that they hadnt taken payment for! The judge was super impressed and also asked if this was a payment being made my credit or debit card! We were paying by debit and he was very pleased by this. The judge couldnt believe she was trying to ask for £1000 a month and said it was unacceptable. She then somehow got down to £500 and still the judge said no. She went on to say that he had bad payment history!! My other half explained that 2 and a half payments in 37 months was not an example as everyone has a bad patch but Mercedes wanted all or nothing and we only had 10 months left on PCP. They were extremely unhelpful and just wouldnt take payment. The judge said next time if they say that, to make the payment via the automated system and that Mercedes should never had refuse payment. He SUSPENDED the court order wahooooooo!! Asked my other half to pay the arrears in 2 days and to pay £350 a month which is £15 more than what we used to pay (no big deal) for the remaining 10 months and hand the car back as intended with PCP !!!!!!!! What a great feeling to come out with such a result and not end up forking out £11000 for a car worth £7000 at the most. Most important is to atttend court and not be scared. Be open and tell the truth and the judge is not as scary as you think. If anything the judge was fair, understanding and normal. I want to thank everyone on this forum who helped and especially MarkieMark1. Mark your a legend and I thank you hugely for your help and patience. Any questions, feel free to ask.
  4. I think Ill be to late to write a letter as the hearing is on Tuesday? Unless I hand the letter in today personally, what do you think? As for the mileage, that is still way under the agreed amount so thats not going to be an issue.
  5. Hi, thank you for getting back to me. I've been worried sick. The ballon payment at the end is for £5900. Should I write to them today asking to hand the car back as long as the contract is terminated and arrears paid? The only problem is the car needs about 1k worth of work done to it also. Do I need to do anything before we go to court? I've heard of a time order, what is it? I'm so lost sorry
  6. Hi all, hopefully someone can help me asap. My partner has a car through Mercedes Direct back in 2007 on PCP. He feel behind on a 3 payments last year and paid off one of the months arrears when in November of 2010 he was told that Mercedes will no longer take the arrears from him but the payments will be taken from a debt collector and he will be contacted soon. Mercedes said that the agreement will carry on and the monthly payments continued to be taken until Feb of this year. He was served a default in December and then a termination of agreement. However the so called debt collectors never contacted him. Anyway to cut a long story short he has paid more than half and they needed a court orde which thet have given and the court hearing is next week......well we spoke to the lawyers representing them and to Mercedes themselves and were told if we pay the arrears they will stop the court hearing and reinstate the contract, I have this in writing from Mercedes dated in Feb will no time frame in which is needs to be paid. SO we tried to make the payment today and Mercedes have refused to take the payment eventhough they can see the letter they have sent us. Even the lawyers working on Mercedes behalf contacted them and were told the same. My partner was told he will have to attend court and put his case across. And told that either Merc will agree to take the arrears or they may offer us to keep the car on a agreed payment scheme. We have the arrears ready to pay as we do not want the car but they want 9K or nothing. What do we do as the hearing i next week Tuesday? Please help?
  7. Hi, Im new to this forum so please bear with me and please help if possible. My partner has a PCP agreement with Mercedes. He bought the car from a MercDirect back in December 2007. I dont have the full details with me as yet but wil update if needed by tomorrow. So he bought the car and paid £500 deposit. I think the car was bought for £16000 and he made regular payments of £336 per month. Unfort we have had a few finanical problems recently and he feel behind in his payments. Hes in arrears of £840, he was called by Mercedes and told that he would be contacted by a debt collectors Anglia and he could pay the arrears with them and Merc will continue to take the normal direct debits as usual. So he was contacted at the end of December with a letter posted by hand that his mum forgot to give him till today !! Hes able to pay the remainder balance over 2 months. So heres the dilema, because he didnt contact the debt collector he has now been asked to fill out a voluntary surrender form. We have about 10 months left on PCP and have paid well over the 50% value. Also they state we owe 11k! Now we wanted out after the last PCP payment, we didnt want to keep the car. Plus its only valued for £7000. I have no idea what to do. We need to have a few repairs done...amounts to about a 1K. And we dont want the car to be taken and charged Mercedes body work charges! Please help, as I have no idea what to do.
