  2. Hey guys latest update. I sent what you told me to write from G&M in responding to the NTO and have had a reply back. Looks like I will have to represent myself in front of the parking adjudicators. Here's the reply. Thank you for the representation made on reciept of the NTO regarding the PCN what was issued by a CEO for an alleged parking contravention. I have considered all the information you have provided but I am unable to cancel the PCN. This letter is therefore a formal Notice of Rejection to your representations. The PCN was issued as the CEO believed the vehicle to be parked in a dual use bay at a time when only loading is permitted. I have rejected your representation because it is based on the issue of signage and road marking, which I can confirm are compliant in the dual use bay on Circus Road. Because this is a dual use bay there is no requirement for the legend "LOADING ONLY" to be painted on the road. All instructions for the different uses of the bay are clearly stated on the sign on the pavement. For the same reason a yellow line is not required in this bay. I can confirm that the hours of operation for all Pay by Phone bays are indicated by the CPZ hours for that particular area. Just as parking on a single yellow line is permitted outside controlled hours, parking in a pay by phone bay free of charge is permitted. In the instance of this dual use bay the CPZ hours are 8.30am to 6.30pm Monday to Saturday. Outside of these hours the loading only sign comes into effect. Terms and conditions of the pay by phone system are made available to users at the time of registration and it is not therefore necessary to have the hours of operation on the signage. Users are expected to familiarise themselves with these conditions of use as they will be held liable for any PCN's incurred due to unfamiliarity. The dual use of the bay is clearly indicated by two different time plates placed next to each other. While it may be common practice to place restrictions on one time plate it is by no means a requirement. Parking information signs displayed in the City of Westminster comply with the guidelines set down by the Department for Transport. I can see that we have failed to provide you with a copy of the DFT approval for use of the pay by phone signage without hours of operation, in a bay that is not "at any time." I must inform you should you wish to recieve this from us you would have to make a freedom of information request to us either by e-mail or letter. A quicker way of recieving the information might be to contact the DFT directly. Please accept my apologies for not explaining this in our last letter. Your representation states that a Notice of Rejection was not sent to you following your original challenge (Informal Representation) against the PCN. Please note that at this first stage of challenging a PCN we will only reply with a letter informing you of the outcome. If you are not satisfied then the next stage is to make a Formal Representation. This is what we consider your latest correspondence, as it was recieved after the statutory 28 days from when the PCN was issued. This letter is your Notice of Rejection, as stated above. You must now either pay the PCN or appeal the Council's decision to the Parking and Traffic Appeals Service before the end period of 28 days beginning with the date of service of this notice. G&M what you think of their response?
  3. Hi there Green & Mean. Just been waiting for the Notice to Owner to come in and arrived this morning. So shall I just copy what you have written above and also is there anything else you can think I could add? Also found something interesting too, they have recently changed the sign plate and now everything is written on one plate and also they have changed the loading hours as well! So now the loading hours are now from 6.30pm till 8.30am monday to sunday. So it must have been wrong in the first place as they didn't erect the correct signage. Also you know you mentioned about the legend loading only in the bays, that still isn't present in the bays!
  4. So I don't need to write to them to say I want to make a formal representation so shall I just sit on it and wait till the notice to owner comes?
  5. Haven't gotten to that stage all I have done so far is right to them and sent a letter via email and wrote exactly what green&mean said I should write. Just got the response from them today telling me what i've written in my post.

Hi there guys have an update to this situation, I just recieved a response from the Parking services here is there response to this: "Thank you for your correspondence regarding the above Penalty Charge Notice issued by the Civil Enforcement Officer believed the vehicle to be parked in a bay designated for loading only. Your challenge against this PCN has been rejected because the road markings and signage are correct and compliant to the regulations. As the bay is not a dedicated loading bay in force 24 hours and has a seperate use during the Controlled Parking Zone hours, the legend "Loading" is not required on the road. During the CPZ hours of control the parking bay is a Pay by Phone bay. The signs that advise of the CPZ are located at the entrance at the entrancve to each parking zone unless the restrictions remain the same as the zone you are leaving. It is the drivers responsibility to ensure they check all local road markings and signage to ensure they are fully aware of the restrictions in force. After reviewing all the evidence submitted by the CEO and yourself, I can confirm that the PCN was issued correctly." They enclosed two pics printed on the letter one of the car with the ticket and one of the signage which I have already taken a picture of and shown on here. Two options pay at discounted rate from date of letter or make a formal representation. So the question is what now? "green&mean?"

  10. Not different bays, the bays are normal parking bays, the only information about loading only is the sign above which I have shown. Here is pictures of the road, I was parked where the silver golf is parked:

  12. When you say the large sign are you reffering to the Loading only sign? And how would I find out this information whether the signage is unlawful?

Hi there guys I got pictures of the sign, when I parked up on the monday I was basically looking at the sign with the number and the location number on the pavement side as shown: The sign displaying loading only is facing to the road. This is the sign: I wasn't looking on that side as I was on the pavement phoning the number and putting through the payment thinking everything would be ok. It also seems that its enforced only on that side of the road, rest of the road doesn't have this. It does say on there charging hours 8.30am-6.30pm all other times no charge so I don't know if I could use that as a valid arguement as well as only one loading only sign. If I challenge it do I have a chance or if I'm just clutching at straws here? BTW it is a PCN from the Westminster.
  14. Hey guys want some advice. Basically I was parked up on a road where you have to phone a number and pay over the phone to specify how long you wanna stay. The controlled zone runs until 6.30pm and there after its free. I even confirmed this with the woman I spoke to when I was putting through the payment. I went back to my car later in the evening and found a ticket on my car, and it was for my car being parked during loading only hours. Which apparently runs from 7pm-7am. Where I was parked its enforced only on that small section of the parking bays. Now I was pointed out by someone there is one sign which states the 7pm-7am rule but its facing towards the road. There isn't a sign facing towards the pavement side with that information. There is a sign for the telephone number and location zone on both sides of the pole and telling you the time restrictions. Now when I parked up and looked at the sign, for obvious reasons I was on the pavement rather than going on the street to look up at the sign for the telephone number so I could pay for my parking till 6.30pm. So my question is can I challenge this ticket as I wasn't aware of this restriction at the time, I was told by the parking operator it is free after 6.30pm. And there wasn't a sign or for that matter information about loading restriction enforced from 7pm facing towards the pavement side? Thanks.
