Is a faulty handset part of the contract?

I would just like to say,this is exactly what has happened to me,and i am in the process of writing my secound letter and sending via recorded delivery. Mine is with phones 4u and o2,so you must let me know how you go on. -
I bought palm pre on the 22nd November, the phone totally crashed on the 23rd,everytime tried to make a call,the next day after i charged it up.Took it back to phones 4 u,they replaced handset sraight away. On the 1st December it done the same again,(i only really use txts,so i had only used phone a couple of times for calls). I went into phones4 u,they done the bizz of calling services etc,but did not get anywhere.The told me i would have more clout myself. I called them from home,told them i wanted rid of phone,they told me i could not do that,and they would replace the phone with another of the same . They then said if the the phone does the same again,within 28 days,i can have a non like for like exchange. I really do not want this phone anymore, I bought it on contract with O2, through the phones 4 u,store. Any advice would be greatfully appreciated.
