  1. Point taken on SAR. The reason for wanting to make smaller payments is that we are being helped by family to make this full payment each month. All other creditors are on a payment plan for low monthly payments. We have told them that we can not make up the 2 missed payments, but have offered to continue paying the full monthly payments... the letters and phone calls continue! Becuase of this I see little point in trying our best to get them payed off, we may as well have the phone calls for non payment!
  2. Maybe they didn't ask for this because we only missed 2 payments then continued with full monthly payments?
  3. No default notice, the letters stated reduced monthly payments, but they were the full monthly payments, just 2 months missed last year.'s It's actually less than 2 missed payments as we paid a bit extra each month.
  4. Thanks for the reply. To be honest I am not sure what I hope to achieve! We made an arrangement just over 6 months ago, that we would continue to make the full monthly payments and that it would be reviewed in 6 months time. Throughout the 6 months they wrote letters asking for the money, sending new loan agreements with double the interest rate ( we didn't sign). Maybe we should just lump them in with the other creditors and offer a much lower payment, as making them a priority has not helped.
  5. Please would someone clarify if I can SAR for a £25000 unsecured loan? I have read about under £25k and over £25k, this loan is exactly £25K. The loan was taken out around 4 years ago, ( online) all through our very difficult times the payments have been made in full, apart from 2 months payments. The loan is with Lloydstsb. The balance is now only around £5k, we are still making the full monthly payments, but they are constantly phoning and writing for the 2 missed payments. They have tried to get us to sign a new loan agreement ( not that stupid!) Just really annoyed with them now, as out of all our creditors they have had full payment. We were thinking of offering them a much lower monthly payment, but really not sure what is best to do. We can't make up the 2 missed payments. Any help appreciated.
  6. Try the online tax credits calculator, you can play around with it and see what works best. You have to work 16 hours + per week ( S/Employed is fine) If you work 30 hours you get the 30 hour element as well. They will accept an estimate of earnings. There is no problem with lots of hours and little income from self employment. The online system is very easy to use.
  7. Thanks for the help. The account was opened in January 2006. My reason for asking, was the wording in the letter they sent with the agreement:_ Copy of your executed agreement the reference in 1) above, as in section 78 itself, is to the requirement to provide a copy of the executed agreement. The actual executed agreement is the document which has been signed by or on behalf of both parties - in other words, the original signed agreement ( see section 189(1)) Does it not need to be signed to be executed currectly? I know I am grasping at straws!!!!!!!!!!!
  8. More advice would be appretiated! I have a reply to my CCA from Lloyds TSB, they have sent a copy of my credit card agreement, all looks to be enforceable, apart from the signature area, the bank have not signed or dated it. Should this be signed to be enforceable? Many Thanks

  10. The story so far in brief! Lloyds credit card taken out around 2005 / 2006 14 months ago times got hard and a lower payment was agreed for 6 months ( with all credit cards) When a review was due, I provided all information again, then had a call saying I could extend the agreement for 6 months, but I had to promise that I would revert back to full payments after 6 months! I stated that I could not make that promise as I could not predict my situation in 6 months time. No agreement was reached. I now have a letter from MHA Collections:- Total amount due £11566 Instructed to recover arrears of £11566 This is where I am confussed! My Lloyds TSB statement for January 2010 states a balance of £13546. Anyone know why the amount differ? I usually read through other posts to find my answers, but can't find anything to help with this one, so any help much appreciated.
  11. I have read lot's of posts, but am still unsure! Should I request a CCA or SAR. Egg have sold my debt to Apex Credit Management. The orginal agreement would be pre 2007. Apex have made lot's of phone calls but I refuse security every time. I have now received a letter from Apex requesting that I phone them and arrange payment. Having read lots of posts on here, agreeing to pay them is not something I plan to do!! Hopefully someone can point me in the right direction. Many thanks.
