  1. Hi All, I've been reading through all of the posts. I know we are all ****ed off with the past and GMAC's thoroughly abismal and unfair treatment to all of us that are, and have been in arrears, but we have to be positive here and look further than what has been decided with the charges fee fine situation. (please read the fine information on the FSA website for the fee they have fined GMAC with). It is only one of the many unfair and excessive fees GMAC has implemented over the last few years. We have to be patient and go through the motions firstly with the SAR, and then the following letters to force GMAC to take note and pay our unfair fees. As i have intimated in previous posts GMAC have been forced to stop charging the £50.00 monthly fee as of 31/10/2009, and i am sure all other fees that run in line with the Unfair Bank Charges scenario will follow suit. I have asked for my Subject Access Request and will take it from there. Next i think will be the ERC - Early Repayment Charge, again with GMAC picking on the vulnerable in the 'Sub Prime' market that GMAC alledgedly specialised in. ( they have been caught remember!!!) The mortgage market is now being scrutinised, so here we go, but we have to be patient. I will keep you posted. Cheers Mcintosh44
  2. Hi jayjaypants. As for the fine to GMAC, i think you might not have any option accepting the offer on the basis of the first findings with the FSA. (Go to the FSA site and search for 'GMAC fine', that will give you an idea of what the findings are from the FSA including the breakdown of the charges they are paying out) My £70.00+ has been added to my account as from last week. As for the other fees, ie arrears £50 fee, DD unpaid fee, and all other various fees that will be a different story. As in the last message you will have to adapt the template for claiming bank charges to the mortgage fees etc. I have actually added the ERC with Kensington Mortgages because i already have my statements so lets see what they come out with. You should send a Subject Access Request to GMAC to see what fees they have already added to your account. £10.00 cost in which you will get back. Search for Templates and you will get the information of how to write the letters. Finally, According to GMAC and as of 31st October all arrears fees (£50.00) have stopped with them working with the FSA findings.... Good Luck. Mcintosh44
  3. Hi all, well i have just had a very interesting telephone call with GMAC. It appears that the FSA are the body that have forced GMAC into halting the £50.00 Arrears fee. I have now asked them to post me all of my charges going back over 4 or 5 years. I know this will run into £0000's with arrears fees and all else they have placed on my account. Now to test them with an SAR and see just how much they owe me. If the FSA can fine them and force the arrears charge to halt then it looks like that fee has to be unlawful, etc etc...........   4. Hi all, I have dug out my old Kensington statements and low and behold i have been charged £3306.98 including various fees and the mighty early redemption fee of nearly £1900.00. If i put the interest on at 8% it is nearly £5000.00 from 2001. Me thinks it's time to fight and be solvent again........... Mcintosh44
  5. Hi All, Does anyone have any letters to start off claiming back any charges added on from the mortgage companies, i.e. GMAC, Kensington & Mortgages PLC. (all fees including arrears, DD failures, court fees, solicitors fees) I am adamant i will get money back from these 3 mortgage companies with the FSA having fined GMAC for abusing people in arrears. This will run into £0000's and with an 8% interest rate should be an interesting amount!!! Please help thanks, mcintosh44
  6. Hi all. I have a Mortgage with GMAC and have acrued quite a considerable amount of 'arrears fees' over the last four years or so. Unfortunately circumstances have restricted me from arranging a High street lender. I am now aware that GMAC have stopped adding on the £50.00 'arrearsfee'. This ceased on the 31st of October so in my reckoning they are basically admitting these were an unlawful and unjust charges they have got away with for years. I have also had a letter amounting to a pityfull £70+ for the charges/fees in which they have been fined. I now am asking if anybody is going to continue and progress to asking for the charges to be repaid, and or court proceedings? Thanks mcintosh44
