  1. Hello, Just talked to my solicitor and he told me that if the claim is over 750 you have to do it another way than small claims. Mine is 3,500.00. He told me that he would do the filing on it for me because that amount you cannot do it yourself. Does anyone have any other advice or idea? I really want to get this going now. Any advice for filing in Scotland to someone who has done it would be helpful. Or I will just go thru him and let him file for me. Also this is a small business account
  2. Hello, I sent the first letter with charges to the bank of scotland on the 14th of September, got the response, standard, on the 20th. Sent the Letter before action on the 28th of September. I just received this letter dated the 11th of October in response to the first letter I sent. I stated at the top the name of my business and account number so there should have been no mixup as stated. I refer to my colleague's letter dated 18th September 2006 , regarding your complaint against Bank of Scotland. I would first of all lilke to apologise that the acknowledgement of your complaint was sent by our Personal Banking Customer Relations Department. Unfortunately, as your letter was not on company headed paper, it was mistakenly treated as a personal account complaint. The relevant Business Leaflet is now enclosed, which explains how Business Banking, handle their complaints. My understanding of your complaint is that you feel the charges that have been applied to your account, are illegal, and you have asked the Bank to consider refunding you in full. You have supplied details of the amounts that have been debited from your account. You have based your request on the recent media coverage surrounding the decision by the OFT relating to credit card charges, and have mentioned the Consumer Credit Act. I am unaware why you have mentioned the Consumer Credit Act, as this relates to authorised borrowing, however the decision by the OFT relates to personal credit card customers, and in no way relates to business customers. As you will know , you entered into an agreement with the Bank, when you applies for your account. The Bank's charging policy is clearly outlined, at the outset, and it is then the customer's responsibility to ensure sufficient cleared funds are in their account, to honour any debits presented. The Bank cannot be held reponsible, if a customer operates their account, outwith the agreed terms and conditions. As there has been no bank error in applying these charges, I must decline your request for a refund. I am very sorry you have had cause to complain. You recently recieved a leaftlet explaining our procedures. Should any of your concerns remain unresolved please let me know what you'd like me to do to put matters right. We are keen to resolve your concerns, if we are unable to do so we#ll provide you with details of how you can contact the Finincial Ombudsman Service for help.   3. I have done the same thing. I just got my investigation letter and little booklet on how to complain today. I will give them 14 days from today and then send the next letter. I think your about 4 days ahead of me. Good Luck ! Firey
  4. hello there: Sent out letter to bos 10 days ago with a list of charges and a total. I received my first response from them thanking me for my letter and stating they are sorry that I am unhappy. They then state a customer relations manager will investigate the points I have raised and I will receive a reply no later than 4 weeks. signed a Peter Barry. Now in the letter I asked for a response within 2 weeks and I received that. How long should I give them before I send out the second letter? Firey
  5. Hi, am just sending off my first letter with the total that I want refunded to me from the past 6 years. The grand total with interest (12% to total) figured that would cover 6 years easy enough, comes to £3571.00. This is a business account with bank of scotland. I had all the statements so I didn't have to send the data letter requesting them. I typed in a list of all dates and charges and subtracted any refunds given to me (which were not many) and came up with this total. I am sending off the letter to two addresses, One boS customer relations in dumfermline and another copy to data protection manager. Halifax in west yorkshire. Are these the proper addresses? Wish me luck I really need the money!!. Firey:D
  6. :? Hello , I have several questions. My husband owed common charges on our flat and I made an agreement to pay monthly starting in August. I just had the bailiff at the door last week stating this had been taken to court in July and 150.00 was added. We never received any court summons or judgement although I see he had the paper on him. Is it legal to enter a judgement if you were never informed of the proceedings to begin with? Also I have a loan thru clydesdale financial services (like a charge card) for car services and If i am late they charge me 22.50 for late charge letter. That eats up all my payment and the balance is growing. I am self employed so its hard to determine dates to pay. Also I was wondering if its legal to charge for not paying by Direct debit. My car payment is made by standing order because I have more control on the date but they charge me 10.00 a month for not doing it DD. Also my phone company charges me 2.50 a month for not paying DD. Also I am sorta thick with this forum and have problems wording letters I could use some help in that respect. Thanks
  7. Hello, I have a card thru clydesdale for car services when I needed some work done and was low on funds. I have been paying for 3 years on this card and everytime I am over 10 days late with the payment they charge me 22.50 for arrers letter charge. Is this something that I can claim back? I have my balance going up instead of down because of it. If anyone can advise me I would be greatful. Firey
  8. Hi, I see that you are persistant in your appeal. I have a b of scotland business account and I think they have taken 5,000. or so off me in the past 6 years for silly amounts over my limit. Now they are trying to reduce my overdraft by 50.oo a month till I don't have one and I don't understand why. I just need to get tough I guess and send the data protection letter and start to get my money back. I am not a very in your face type of person and I have a hard time convencing myself that I can do this. I don't seem to find anything on the forum about business accounts either. I would feel quite foolish if they came under different rules. Thing is, my business has partially failed because of an accident and I could really use this money. Any words of encouragement for a slightly shy person? Firey
  9. Hello, I am about to start against bank of scotland to reclaim all my charges, only thing is, my account is a business one and I don't see anything relating to that. I havent added it up over the last 6years but I guess it will exceed 6,000. Could anyone advise me if there is any different proceedure if it is a business account. Firey
