Finally... After following the forums advise to a 'T' I can today report another defeat against the power of Natwest! I requested my statements over the phone after no response to my data letter. I claimed through MCOL for £1156 plus interest and MCOL fee, I recieved a CPR 18 request of which I responded as Martin suggested. The next day I got a letter disputing that the CPR 18 request was intimidatory. I filed my A/Q and then recieved a letter offering £800. To this I declined via email to Cobbetts. They then filed the A/Q a week ago of which was pointless because today I recieved a cheque for £1524 settlement in full!!! Sorted! I was a bit nervous at declining £800 but stuck to my guns!! I wrote asking for statements, I got a offer for 260 quid. they said they had charged me 520quid in the past years. Do I accept it? The reason I ask is that they only charges £20 a time anyway and they are offering half back. OFT sugggest 12 is fair so if i MCOL it I may only get about 200 back.. Any suggestions? Explain that the account is in dispute and request that they send it back to their client. It worked for me!! Matt

I am a little concerned about going to court, I have done so in the past but that was not a claim for this reason. Does Natwest settle before a court date or just 'not turn up'? I have filed a claim, recieved the standard defence and CPR 18 Request. I responded as per Martins template and entered my A/Q to the local court. Having read the forum I guess I will next recieve an offer for half the amount of which I have to turn down. What happens after that? Having spoken to MCOL with the same concern, they said I have to wait for the defence to be filed, if it is, then they request the documentary evidence with the questionaire.. here's hoping they forget! Matt 4/9/06 - £1156.00 + £148.18 INT + £120.00 FEE. Awaiting defence!

I asked for my statements a month back.. I didnt get a reply to my request for bank statements from 135 Bishopsgate. I didnt send a payment luckily i just requested them to deduct it from my balance. Instead I just rang 135 Bishopsgate direct and they backordered them for free. I got them a week later.. Asked for the charges back a few weeks ago, got standard letters from both 135 bishopsgate and my local branch (Leicester). Just issued the claim online.. fingers crossed.. Matt 4/9/06 - £1156.00 + £148.18 INT + £120.00 FEE. Awaiting defence!
