  1. To DG, thanks, any idea where i can get a copy of the correct dispute letter? to BB39, excuse my ignorance, re the charges reclaim, was there not a ruling of somekind just before xmas saying that charges could not be reclaimed ? or am i being a plank? thanks BAB

Hello, 1) I sent a CCA s.77 to s.79 letter to my card accounts with Mbna and Barclaycard. i have heard nothing. can anyone advise me what to do next? 2) I sent the same letter to Barclays bank re my large overdraft with them. Again,i have heard nothing. can anyone offer advce? Many thanks. peter

  5. wow, thanks for quick response. the cca i sent is copied below, This letter is a formal request pursuant to s.77(1) of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide. I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77(6) will apply. Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee We look forward to hearing from you. was it the right or wrong letter for cards and bank overdraft ? Hello I sent a cca to Tesco credit card and received a letter back, with my £1 postal order, saying 'request received under S77-the above account is not a loan account and therefore we are under no obligation or requirement to provide you with the requested details' Does this mean that this card and the other credit card accounts i have are not covered under the cca rules. after the economic turndown my business folded and i have been left with card debts with Abbey (santander) Barclays and MBNA. Also, do bank overdraft facillities come under CCA. Any help will be very gratefully received.
  7. Sorry if this is not the right place to post a thread, having trouble finding my way around. Am I right in thinking there are two factors to relating to unfair credit agreements, 1) Unfair bank charges: which one would try to reclaim via whatever channels apply, and 2) Unenforceable credit agreements: which one could try to establish to help in a self actioned debt management programme? I am really interested in the latter as I want to clear my bad credit score and offer reduced settlements with the aid of a family loan. I have the following types of debt, 1) Bank overdraft-Barclays 2) Credit cards with- Barclays, MBNA, Tesco, Santander 3) Supplier credit-builders merchants, Jewson Ltd & Travis Perkins, one of which is a CCJ 4) Others- Hitachi credit for laser eye surgery, Vodaphone bill So far I’ve kept this lot at bay with letters pleading poverty and an IVA process which I want to cancel as I want to offer final settlements, privately. I've read IS MY AGREEMENT ENFORCEABLE( Via section 127(3) CCA1974) but I’m not sure if this just relates to credit card agreements or all types of credit agreement. Can anyone point me in the right direction?
