    As its Capital One and they dont have 'branches' as such, amend the spreadsheet as you need to.

    There are 3 types of interest!

     

    1. Overdraft interest: You can reclaim a portion of the overdraft interest you have paid on your account, but you need to fill in the spreadsheet to calculate how much of your O/D interest was caused by charges and is therefore reclaimable. It is not often a lot of money. (on my 2.5k claim, it was £37!)

     

    2. S.69 County Courts Interest (8%): This is the interest that the courts permit you to add to your claim at the point you file your claim at court. Again, you need to fill in the spreadsheet because it will calculate it for you, compounding the interest from the date of the original charge, so older charges will have more interest added. You do not ask for S.69 interest at letter writing stage, you only add it when you file the claim at court.

     

    3. Contractual Interest: This is a totally different type of interest which basically charges the bank the rate they have charged you for having your money. This could be as high as 30%! It can make claims of a few hundred pounds become worth thousands. However, it is not fully tested at present and is subject to much debate on the site.;) If (after much research) you decide to claim contractual interest, you claim it from the first prelim letter. You cannot then claim the S.69 interest on top of the contractual interest.

  3. When I got in touch with my branch I was told to put it in writing, which I did, when they received my letter I got a phone call of them saying that I had to fill in a transfer form, I told them I already had put it in writing, but they said the form had to be filled in and signed.

     

    Thats bizarre, when I got rid of my Adv Gold, I just asked the staff at my branch and they did it on the spot, didnt have to sign anything.

    I'd go into the branch and make a 'noisy' fuss about it, I'm sure they will oblige!

    Your DPA letter should have requested all data from your entire banking history with Natwest, so if you had the account for well before 2001, its worth trying to get those statements too.

    Try telephoning this number and push hard to be sent all your statements.

    if you want to save yourself some time, send your prelim letter off with the charges you already know, when you get the statements you can amend spreadsheet and LBA. If they are really late sending them you can amend amounts easily right up till you file a claim at court.

  6. Cobbetts are notorious for filing their defence at the last moment. It is quite common to receive it on the last day or even a few days late.

     

    Do plenty of reading about what happens if they dont file on time, dont automatically press for judgement until you are absolutely certain they are not going to file, ie. ring court, ring cobbetts to hassle. Its likely that they are very very busy right now;)

     

    Believe it or not things can get more complex and time consuming with default judgements as the banks often succeed in getting them 'set aside', which can cost you more time.

     

    Dont worry though, you'll still get your money, Natwest usually pay up on amounts this size sometime after submission of Allocation Questionnaire......well they did with me at least!:)

    1. He has a copy of the CCA and it is in perfect order. signed dated etc

     

    2. No PPI, he thought he had paid it, but has checked and was not.

     

    3. He only had the car for a year, so was under the 1/3 way through term.

     

    4. He was told in a letter from Yes Car Credit received 6 weeks after repossession that it had sold for 2k. no explanation.

     

    He is trying to settle with Go Debt now. A few weeks ago they offered him £1500 lump sum to settle.

     

    He counter offered £1000 spread over 6 months.

     

    They declined and are now pursuing aggressively the 6.5k.

     

    They have sent him a statuatory demand and are threatening to have his home sold! They claim to have checked Land Registry.

    We know that he has to respond within 18 days to the SD, but wondered if any one can clarify the grounds under which we can apply to have the statuatory demand set aside.

    Welcome Tabit, you make some good points about treatment of bank staff. We do not encourage our members to be confrontational towards branch staff, as I understand it, branch staff do not have the authority to refund more than £50 approx and we encourage people to be polite in their dealings with bank staff.

    However,

    'when in a short time free banking ends in this country, don't complain about it. you sowed the seed for it and fed it well.'

     

    is a statement likely to offend our users, because these charges are unlawful and should never have been taken in the first place, let alone prop up free banking for the UK population at the expense of the more vulnerable in society.

     

    I assume Tabit that you are here to reclaim bank charges? If so you too will be part of the Consumer Revolution to end unlawful charges and you are very welcome, if for any reason you are not here to reclaim charges and wish to pass comment on the end of free banking, then it is likely this will create alot of hostility and antagonism, so I would ask you politely, not to do so.

     

    Can you please now start a thread in the forum of the bank you are claiming against?

     

    Please no further arguments on this thread from any users please.:)

    The first thing you need to do is get your statements, if you dont have them you can send off to your bank using a Data Protection Action letter.

    OK, so you have already sent one letter asking for your charges back. Did you attach a spreadsheet of the charges to your letter?

     

    If so then the next letter is the Letter Before Action, which gives them notice of a further 2 weeks to repay or you will file a claim at court.

    Any unauthorised overdraft fees, rejected DD/Cheque fees/Card/Cheque misuse fees etc are reclaimable.

     

    I dont know if the £93 is all unauthorised overdraft fees, but it sounds like it is. The £30 cheque fee can also be recovered.

     

    Have you had charges before, you can easily reclaim all charges going back 6yrs.

     

    Which bank are you with? Read up others stories in the forum of your bank and then start a thread of your own to tell us how you get on.

     

    By starting a thread in your banks forum, you will get lots of help and

    advice from people who are also fighting them to get these penalty charges refunded.

    sorry didnt mean to confuse you there.

     

    a full dpa request includes all date held about you, which can include letters, notes made by staff during phone convos, interest rate notification, overdraft limits, application forms etc etc

    sometimes this info can be helpful, but in a standard claim, all you need is statements.

    the other reason i mentioned it is because if you agree to a £5 statement 'release' and then dont get statements, you can be left on the back foot, because the 40 day deadline isnt ticking.
