  3. Hi All, I received a notification from the fixed speed camera people that I had exceeded the speed limit by over 30 mph in a 30mph zone. The car reg was noted and I received a form asking who was the driver was. At the time of the offence I was 150 miles away working and have proof of that, I replied explaining I was not the driver and could not have been. I asked for photographic proof but was told they cannot issue that because of data protection. I have now had a reply asking me to photograph the back of my car and registration plate and sent it to them:shock:. Does anyone have any experience of this kind of thing and advice. I can only imagine someone might have cloned my registration plate for illegal activities? Here is a reply I have prepared to the constabulary I have not sent it yet. "Since I am clearly stating I was not the driver of said vehicle with registration mark "XXXXX" that you indicated was photographed on 6th August 2009 and regardless of the data protection act it is a rule of law that any party wishing to prosecute and including the police must disclose the content of that evidence to their opponent if a plead of not guilty is made, which will be the case in my circumstances if you continue with this process. I do not believe I have a legal obligation in photographing the rear of my vehicle and send you details. Bear in mind that criminals who clone vehicles for illegal purposes will already have details of cars they wish to replicate and so I do not understand why a photograph is necessary or indeed that it proves the vehicle was or was not mine. If you quote me the requirement by law to supply you such information please, I will happily oblige your request. If this continues to court and if I am charged then the criminal procedures and investigations act of 1996 entitles me to material evidence. I point you to 3)1 The prosecutor must a) disclose to the accused and prosecution material which has not previously been disclosed to the accused……. I await your reply and hopefully photographic evidence either now or when charged." Anyone got any advice? Thanks Adrian
