Ooh just another quick one.....when I sent of my prelim letter I think I worked out the interest I was claimining back incorrectly - I used the spreadsheet on this website to do this, over the years I have had various agreed o/d limits but in the column 'interest free o/d' I just left this blank and not sure if I should have entered my agreed o/d limit at that time in that column - if this is the case this would be hard for me to do as I do not know at what level it should have been in relation to dates.

     

    I think i would rather just leave this claim for interest out now as it only come to £79.25 and I don't want to risk my claim by trying to claim for something I shouldn't!

     

    Therefore when I send my LBA letter shall I just omit this or will this go against me as I included it in my prelim letter?

  2. Ok so the deadline is up for my prelim letter and I am just about to print of the LBA.

     

    Just wondered about the last (optional) paragraph in this letter about submitting a Consumer Credit Act 1974 complaint to OFT - How do I go about doing this? Has anyone else decided not to do this and how has this effected their claim?

  3. Hi everyone

     

    Here goes......

     

    I sent off my SAR letter on 31st October and on 11th November had received a copy of my last six years statements back, however they gave me no evidence of when manual intervention was used they just made a statment saying that the administrative charges debited were done so in accordance with the terms and conditions of their current agreement.

     

    So after looking through my statements I worked out that they had taken £3309.50 off me over the years! Then off goes my prelim letter on 21st November, which they received by special delivery on 22nd November - therefore the deadline for their response should be 6th December. However today I still have no reply! My boyfriend who is also making a claim and who sent his letter on the same day as me got a BOGOF reply within a few days. Has anyone else had their prelim letter ignored? and how did this effect things?

     

     

    Anyway I am off to type up our LBA letters now and will keep you all updated as to how we both get on.

     

    What sort of timescale could we be looking at before we finally get any money back?

     

    Heres hoping I turn into one of the success stories:p

    soz for not replying earlier not been on line over weekend, not sure if you've already sent your letter? but I am personally going to wait until the deadline is up I read on another thread to stick to the deadlines that way if it does go to the courts they can see that you have given them a reasonable time to try and resolve the matter. I will try and find this thread for you.

    I too have receieved the standard reply to my preliminary letter - we disagree with you letter and 'we beleive our charges our fair, reasonable' blah, blah, blah.

     

    I received this response within the 14 day deadline so should I wait til this deadline is up before sending LBA or shall i send it now?

  6. I sent of my SAR letter to NatWest on 31st October, following which I received my statements for the last 6 years. But I did not receive any other information relating to any manual intervention - does this mean that I have not received full data protection act information that they are required to send?

     

    I have since sent my preliminary letter to which I have had a reply along the lines that they disagree with me and believe that their charges are fair, reasonable and transparent. It also states that they are under no obligation to explain how its charges are calcualted and they are not prepared to enter into any correspondence on this matter - does this mean that they are in fact breaching data protection and failing to disclose me with the relevant information that I initially requested in my SAR?

     

    I also received reply to my prelim letter within the 14 days, so should I wait til the 14 days are up or send my LBA straight away?

     

    Any help or advice would be much appreciated as I want to make sure I have everything in place should I need to go to court. I am also worried that as I have not had a full SAR reply then this may go against me when putting my case forward to the courts as they may question my reason for taking them to court if I do not have all the evidence.

  7. Hi all

     

    After reading a few sucess threads for reclaiming ERCs I am now beginning to get quite excited as over the past 6 years I have paid ERCs on 8 remortgages and secured loans.

     

    However I do not have details of the actual amounts paid so how would I go about getting this information? Would I just have to send a similar letter to the SAR template for reclaiming bank charges? Or could anyone supply me with an initial letter they have sent in reclaiming ERCs?

     

     

    Any help and advise would be much appreciated :)

  8. Could you help me with working these out, not sure how to enter these into the spreadsheets provided on this site.

     

    As the date the interest is taken out of my account my balance is not an overdrawn balance, although for the period the interest charges relate to it may have been on several ocassions - therefore do I have to look through the period and enter the balance as the highest o/d one for that period?

  9. I am confused as to how to work out the interest charges -

     

    Natwest charge interest at the end of the month i.e on 30 Nov 2000 I was charged 1.04 for the period 2 oct - 5 nov, but my account balance on the 30 nov was £700.15 credit and on 5th nov was £296.56 credit.

     

    but it was overdrawn on 2 ocassions during this period the highest being £435.67 o/d - so should I use this overdrawn figure to put in the spreadsheet column account balance at interest date or do I use the credit figure for the end of that period as stated in the spreadsheet notes? - however if i use the credit figure I am not entitled to claim any interest back on this ocassion?

     

    Please help I am v. confused and want to get things right.

    I have recently been looking into making a claim for getting my money back.

     

    I have sent of my Data Protection letter requesting 6 years statements and have received a letter back from them making reference to manual intervention which states that these charges have been processed in accordance with the terms and conditions of their current agreement with me as a result of the activity on my account.

     

    Is this a normal statement/standard letter they send out? Or are they trying to tell me that I can't claim them back as stated in the terms and conditions of my account?

     

    Any advice would be appreciated.

    I have today requested my previous 6 years bank statements from NatWest so that I can work out what I may be entitled to. Over the years I know I have incurred a substantial amount of charges. A couple of months ago I did query a charge which had escalated over a couple of months and they agreed to refund my account £90. Would this go against me if i try and get all my previous charges refunded?

     

    Any info much appreciated. Thanks
