Hi, After I sent a default letter to a creditor for failing to send me a true copy of the credit agreement I recieved a copy of an agreement that is undated by the creditor; the date section is blank. There is unreadable date stamp under the creditor's signature. Bearing in mind they sent it to me in response to a letter I sent them a default notice informing them the limit had expired that the debt was unenforeable and there is no date etc where do I stand with this? Any advice / info / suggestions is appreciated. Thanks, p1

I have an issue with Barclays in that I never changed my address on the account when moved home because they always wanted me to go in an sign papers etc. I didn't ever do this because of working (I was freelance at the time and not working meant nor getting paid which I couldn't afford) and either having to make an appointment or sit in a branch for two hours at a time. I left the address as the original one on the account and as it still is. However, because I wrote to them from my new address they wrote back and said they couldn't action my request for a true copy of the credit agreement. I have since received demands and letters from a third party debt collector at my current address. When I received the first one I called and asked why they were writing to me at an address not on the account. They said they had written to me at my current address before etc (which they had NOT) as they found it thorugh a trace service. I asked them to send copies of any letters sent to my new address which they did not. |(I know it is not wise to call etc but I have a name and the time/date I called). They advised me a number of times they could not change the address unless I went into a branch to change the address etc yet they chase me for money at my new address. They have breached the data protection act and gone against their own advise. Please can someone help me with this. Thanks, P1

  6. Hi, Has anyone had any contact with Carter & Carter Financial recently? I have been using their debt management services and they seem to have fallen from the face of the Earth.... I am currently trying to get information from creditors about payments Carter & Carter Financial did / didn't make. Thanks, P1
  7. I'm still chasing some information... Once I have all the info I will contact one the charities you've mentioned. In the meantime I am reading the info on this site in an attempt to get my head around the whole thing of debt, rights, law etc and see what is mentioned about the companies I am dealing with. Thanks for your help. P1

Hi, The debt management company I used went into administration i.e. stopped trading, didn't tell anyone, stopped taking calls then phone numbers dead, the website became a broken link etc - simply disappeared. I have contacted all my creditors explaining the situation and requested the status of each of the accounts along with the credit agreements. I have one account, with a creditor, on which the credit agreement is unenforceable through a court. Am I right in thinking that the money I paid to the debt management company for agreed payments of 'x' amount to each of the creditors should be written off even where the creditor states payment was not received from the debt management company? I have proof of the total monthly payment to the debt management company and the statements telling me which amount was paid to each creditor and letters from the creditors/creditor representatives (debt companies) with references to the payment amounts being made through the debt management company. I need to figure out how much is outstanding on each creditor account and then work from there with regard to monthly payments moving forward. Any information anyone has is greatly appreciated. Is there a standard letter I can send? The creditors have disregarded what I told them about the debt management company going into administration and the figures they are giving me do not reflect the true amounts now owed. I am not sure what to do next! Many thanks for your help. P1
