Mbna Irish credit card being chased in uk
rooster32 replied to rooster32's topic in Overseas Debt/Overseas Account issues
Sorry to be a pain with all the questions! But, if a uk dca was to take on the debt where would that then leave me in terms legal action in the uk if I chose to ignore it? In worst case scenario could I request a copy of the agreement from them and hope this can't be produced? -

Thanks cerberusalert. Should have mentioned that the amount was €4500, I assume that it wouldn't be worth their while pursuing through the courts for this? -
Mbna Irish credit card being chased in uk

Thanks for your reply. Even though mbna is a global brand can they not put a Mark in my uk file through their uk company? If I ignore this letter is there a timescale where this could be written off ? Thanks again. -
Hi and apologies if the answer is already here. I've had a look and can't see anything. Basically I had a credit card in republic of Ireland and moved to uk 4 years ago. This week I've received a letter to my uk address from an Irish based debt collector advising the debt was being passed to another Irish based collector. I had been making payments to this card but stopped when the cost of living and additions to the family meant I couldn't afford the payments! I wasn't aware it had been passed to a collector until I received the letter. Where do I stand with this? Can I be pursued and my uk credit rating affected?

Could someone have a look at this and advise? The total amount shown is a combination of a mortgage for 89k and an unsecured loan for 28k. It also shows one payment per month. should it not show a breakdown and Should i not have a seperate KFI? Any help or advice appreciated.

I've spoken to a group called cartel client review about this and they reckon i have a case for the mortgage part - "a flaw in the contract" and can get 5k back? they also say they will challenge the unsecured loan due to it being "unenforceable" and will look to get this written off? Has anyone ever dealt with them and does the advice they have given me sound realistic? Also is there anyway i can do this myself for free to avoid a £495 and £195 fee for each agreement? *I don't have access to a scanner to upload the agreement*

Hi, first post here - seems the best place to ask my question! Its recently come to my attention that part of my northern rock mortgage may be unenforceable. I took a mortgage with them in march 2007 for 89k and an unsecured loan for 28k. the key facts agreement sent out has the total amount as 117k, with no record that this include 2 seperate loans. Should i not have a seperate key facts for both these loans or a seperate CCA? they take the 1 payment from my account monthly too, surely they should be taking 2 seperate payments? If i was to ask for copies of this what is the best way to start going about it? Thanks for any help on this!
