I am nearing the end of the 5th month of a 6th month probation period and my job is going well and as far as I am aware Management is pleased with my performance. However, due to a change in my personal circumstances I have decided to hand in my notice at the end of next week and hopefully travel to Australia, to study, at the end of September this year. I am confused as to what my notice period is during my probation period as the contract is misleading in my opinion as; tates the following:- "This employment can be terminated by either party giving each other 3 months notice", but then in the next paragraph it states "...this offer is subject to a 6th month probationary period". No-where in the offer letter does it states what the notice period is whilst under probation, but I believe this still to be 3 months? I personally would like to serve the 3 month notice period, seeing as I have budgeted around receiving a salary until the end of September, but do I stand the risk that when handing in my notice, whilst still under probation, my employer can turn around to me and ask to leave earlier than the 3 months I am willing to give them or are they bound contractually to the 3 months? I rung ACAS a few times today and got 3-4 different answers!!!...oh dear! Are there anyone out there that knows employment law? Thanks, G
