  2. I have pursued further charges from the same bank having already received a refund of previous charges. They are saying that when paying back the previous charges I was advised further charges would stand and therefore cannot pursue a recovery of the latest ones. Is this correct or can I continue to pursue these rgardless.

I cancelled the direct debit mandate paying a Gym membership, I had completed the minimum 12 month subscription but didn't realise there was a 3 month notice period (didn't read the small print). I have been ignoring their requests for payments for the 3 months and they have now passed the issue to a Credit Management company, giving me 10 days to pay or they will pass to solicitors to commence county court proceedings. I am tempted just to create a letter dated 3 months prior to the date I stopped paying and submit this a copy stating it was the gyms fault they did not action my cancellation notice. Should I do this or is there an alternative way out of this.
  4. I tried to pursue late payment charges from Halifax for a credit card I had with them up until a year or so ago. They have refused my request, the following is a paragrapg from their letter; 'HBOS disagrees with the legal analysis of default fees outlined in the OFT's Statement, published in April. However, the group confirmed 2nd June 2006 that it will be reducing default fees across its credit card product range to £12 with effect from 1st August 2006 and until that date, all existing terms and conditions will apply. At the moment the statement refers specifically to credit cards, but is likely to be expanded to other products in the near future, this change will not be applied retrospectively, so unfortunately, no refund of charges is due to you. Is this correct or are they just trying to put me off? Likewise I received a similar response from Goldfish, but they are prepared to refund the difference between what they originally charged me and their now reduced £12 charge. Can I still pursue both for the full refund?
  5. I have sent both my preliminary letter and letter before action to my bank and I am now only a matter of days aways before I send them the my formal claim. However, in the interim I have received another charge applied to my account at the month end. If I do not get my charges back before it comes action can I add this latest charge to the action? Hence the action will be for a greater amount then I have been writing for, or will I have to start a new action.
