  1. Hi, thanks for your help Im not sure I totally understand, does that mean I can let them know Im going to stop the payments until they produce the agreement and they wont trash my credit file?? I was also thinking that my only account is with Halifax so would I have to change banks to do this or could I walk in to the branch and tell them to cancel the DD?? thanks again for you help.
  2. Hi, So this has been going on for a while now, I have now sent them 3 letters: Thank you for your recent letter sent to me, the contents of which are noted. I appreciate your quick response to my original letter. However, the reply received by me does not fulfil your requirements under the Consumer Credit Act 1974. The Act demands that I be supplied with a true copy of any properly executed credit agreement that exists in relation to the above account. I may ask for this on demand providing that a fee of £1.00 is paid. This fee was sent with my original letter. My request remains outstanding. The items you sent in your reply, does not constitute a true copy of any credit agreement that may or may not have been signed by me on the opening of this account. It neither confirms that I am liable for any alleged debt to you, nor gives me any chance to evaluate whether any original agreement was ‘properly executed’. I still require you to send me a true copy of the original credit agreement that you allege exists. As you will know, under the Consumer Credit Act 1974, a judge is not permitted to make any enforcement order unless the creditor can provide a true signed copy of the original credit agreement. This means that unless you can produce such an agreement, this alleged debt is not enforceable in law. They have continued to send me unsigned copies of an agreement. I am currently still paying the loan repayments, but im considering stopping as im under no obligation to continue. So do I stop and if so what are the consequences? I worried it will effect my credit rating. thanks for the advice.
  3. Ok, so this morning I got a letter in the post "Thanks for your request for information regarding the above loan agreement. Please find enclosed a signed copy of the executed agreement. What i actually received is a loan agreement with no signatures at all. There is a box at the bottom that says "signature of customer" that says sign only if you want to be legally bound to its terms. - It isnt signed Then another box below it says signed for Halifax by - no signature there either. Thanks for all your help by the way!
  4. No they are not pursuing me for payment as I have not stopped payments being made on the loan from my bank. Should I do this?
  5. Hi again, Not quite sure what to do now as it is past the 14 days and I have not had any reply from Halifax. Is there anything more I can do to get a response? thanks for the advice
  6. I have a number of issues regarding sky and the mis-selling of their services. 1. I decided to get Sky HD+ as well as there bb service around december time. I was informed when setting up the bb my line could take between 6-8mbps, the 3mbps was free but I decided to pay the extra £5 per month to get the faster speed. When it was eventually installed I could only connect at 1mbps after a number phone calls to sky I got through to a guy in technical support how tested my line, he told me who ever had sold me the bb at the faster rate was lying as my line couldnt recieve anything over 1.5mbps. 2. Secondly I had my land line with bt, I set this up in december because I needed this to get skybb. Sky then called me to say if i changed to them for line rental it would be £2 cheaper per month, I said it wasnt worth the bother but the girl said they could sort it all out without me having to do anything, I was assured a number times that there would be no fees attached to this process so I agreed. Sky then ended my contract with bt and bt then charged me £127 for cancellation which sky hadnt mentioned at all. please note that sky cancelled bt on my behalf, I did not speak to anyone at bt. I have since contacted sky to complain that I was mis-sold this line rental but they have replied to say that they wont do anything, pretty much just telling me tough luck. I am very annoyed at the way sky have treated me, if you can give me any advice on where I can go from here I would be very greatful. thanks

Im not really sure if im posting in the correct place for this but anyway, I heard from a friend that there was something about loans taken out before April 07 so i was told i should request a copy of the original credit agreement from Halifax, by the way the loan was only for £6000 so I still owe about £4000. Anyway, I recieved a letter from Halifax this morning stating that "I refer to your request for copies of your application and agreement forms. After checking our records, I can confirm that unfortunately we dont hold any copies of your personal loan application forms on our files." Can anyone tell me what this means? and where I should go from here. Im a little confused as they confirm that I asked for the agreement forms but only say they dont hold any copies of the application form on file??
