  1. Hi Sorry for any delay-this is really complex.I have just gone through it myself. It is true that they do not need to contact unsecured creditors. You have had the final hearing-do you have any equity in the home? or is it all used up.If you have none or you are a joint owner the position is different? This is a real complex area and full of problems and with little support from the courts or anywhere else.Let me know as much as you can and I will help Simon

  4. Hi Now I may be in the wrong place but are we talking about Charging orders or Restrictions-has anybody any experience of the following scenario? Hi I am struggling at the moment and wonder of anyone has any ideas. We (wife and I)are selling a property with two joint mortgages and 4 Restrictions placed upon the address in my sole name and the Restrictions are the standard type with wording which tells me that I cannot sell without notifying the four restriction holders. My conveyancer says that I must settle all charges and that there is not enough money to pay the last one off. Thus the sale is stuck. I say all he need do is notify and he says he must pay it all off to get good title? Can anyone help or point me to definitive research or precedent on the matter Thanks Hobon

  6. Hi Which solicitors did you use as I am in the same position but my conveyancer wont sell and says I have to pay all the Restrictions first even though the restriction does not say that? The Restriction simply staes that I have to notify them-which he has done?
