  1. Unfortunately yes, however my solicitor says I can always claim against the finance company for the extra two days they held it up in impound.
  2. I've resolved this. for anyone who finds themself in the same situation just threaten your finance company that you'll seek an injunction under Tort of Intereference of Goods Act 1977 in order to return the goods. Seems to make them respond within five minutes.
  3. Crikey, what a complete and utter con. When I phoned this afternoon I was told it was £190 to release it. got there and after arguing over the £20 / £12 a day debacle said I'd complain to the police for reimbursement and to just release it. "No problem, that's £250". Explode? I almost went supernova. I queried this new price and told them that the woman behind him had already told me £190, at which point he turned to his computer, clicked away and then said "sorry, it's £210". Now, if I had been a mug I might have handed over £250 without questioning it. It was at this point I said this was a complete [problem] and clearly they just pull whatever figure they like out of their arse. i ended up paying £210 but I'm still going to persue the price that was printed on the ticket the police are issuing.
  4. Okay, resolved the issue in my other thread, now got a whole new can of worms regarding the impound company. Basically, on the police ticket it states that the Impound companies charges are; £105 removal and £12 a day storage. I phoned them to find out what I'm due and they are now claiming it's actually £20 a day storage. I told them that's incorrect as the police and their ticket both state £12 a day. Impound company say that £20 a day is the new fee, when asked when this came into action they told me October 2008!!! That's 6 months ago, surely this is more than enough time for the police to be issued with up to date tickets with the correct prices on? i've sought advice from my solicitor and he says they have to honour the price that is shown on the ticket and if they don't I'm to complain to the police that this company, whom the police have a contract with, are trying to fraudulantly obtain monies by deception. I phoned the police to inform them and they insist it's a civil matter, despite telling them I'd already sought legal advice and him saying otherwise. As I'm going to be collectig my car shortly I'd appreciate any further advice anyone could give. thanks

  6. Not sure if this is the right forum so please forgive me. The other night I had an unmarked police car race up behind me and tailgate me to my house. He then accused me of speeding (I wasn't and he had no proof) and then said my car showed as having no insurance (again, not true). He called for a real traffic cop and when he arrived I gave him my insurers details (A-Plan). The traffic cop turns to the guy who stopped me and says "What if we can't find his details?" to which the first cop says "We go to Plan B". I asked what 'Plan B' was and he tells me they'll seize my car. The traffic cop goes to check and comes back a minute or two later to say that my insurer (A-Plan) doesn't exist (it certainly does), they can't find it on the internet (it's the first result on google) and that no one has even heard of it. At this point they call for a flatbed and my car is impounded. The next day I go to the police station, produce all my details to their satisfaction and they notify the impound company to authorise the release of my car. However, my troubles don't end there. I get to the impound yard and they now tell me that the police have autorised release but now the finance company (Black Horse) won't. Now, towards the end of last year I became unemployed, which I explained to both Black Horse and the credit collection company they eventually passed it over to. Because of this I fell into arrears on the finance (after two years of not missing a payment). I have recently (start of March) started working again (which requires the use of my car) and after the trouble with the impound company have contacted Black Horse to inform them of the situation and that I am now working again and should soon be able to continue making payments as per normal. I have also paid over a third of what I owe and the agreement specifically states "we may not take back the goods against your wishes unless we get a court order. If we do take them back without your consent or a court order you have the right to get back all the money you have paid under the agreement" All the people I have spoken to at Black Horse have said they are confused by this situation and never heard of them refusing to allow an impound company to release the car. They were also understanding of my situation of being unemployed and working again, how I need the car and how I'm also accumulating storage fee's whilst they wait for powers higher up' to come to a decision to release the car. For two days they've been waiting for this 'decision from higher up' and I can't help but think I'm being messed around. So, a few questions. 1) Are Black Horse within their rights to tell the impound company not to release the car despite the fact I've paid over a third? Or are they merely trying to buy time whilst they desperately seek ways to seize it back? 2) As I produced my documents to the police and proved I have insurance, am I still liable for the release fee and storage costs at the impound company?
