  1. Hi Katie, i filled in the forms myself, but the CCS did tell me if i wanted help, to give there bankruptcy line a call. There is alot of forms but u can do it online slowly, so when u have all the information you need, you can fill it in online and you dont have to do it all at once as it takes ages! Go to The Insolvency Service Website and fill it in on there. With regards to bank accounts, yes the day i went to the court i took everything out... i was gonna leave some in but my husband said to me that it might be months before i get it and i didn't want the hassle if they didn't give me it back. So just take it all! My bank haven't contacted me since i emptied it and went bankrupt (i had no debts with this bank either) so i assume they were contacted by the official receiver and closed down? I had a lot of issues with people saying have you consider this and have u thought about an IVA.. its annoying as i had a lot of debts with Northern Rock who do not accept IVA at all! The CCCS told me not to consider an IVA as Northern rock never accept them.. its strange really as with an IVA they would of got something back but now i had to go bankrupt they get nothing! And they wonder why Northern rock went down the pan! When you get to the courts you are advised to see someone and talk about the bankruptcy 1st, like to discuss if its the right option and to make sure you are aware of all the consequences of it. i did not do this as i have talked it through with the CCCS many times and was aware it was my only option, and i think i knew everything they was to know from all the leaflets the CCCS sent me and things on the internet (one being this website!) Hi Katie, U dont need to notify the mortgage company, just send the keys recorded delivery with a note advising them of who you are, a mortgage account or reference number and that you can no longer afford the payments on the house. Do not sign the letter either. After we did this, they called us saying we needed to sign some forms saying we were giving the house back. Alot of people say do not sign anything but it is fine to do so BEFORE the bankruptcy. As anything signed after, could mess it all up and u could end up owing money to people! With regards to council tax, the local council had to wait till we signed the letters and posted them back to the mortgage company and then they mortgage company would notify the council that you are no longer there, until this happens, you will be liable for council tax. When u go to the court for the bankruptcy petition, they dont ask anything really. They just check over the forms, making sure its all filled in correctly, make u swear an oath on a bible and then take your money! They stamp your forms and get u a copy and advise how long it will be till someone calls you, all depending i suppose how back logged the judge is at the moment! Set 1 up and gave me a visa debit card! Not a solo card that my bank before i went bankrupt gave me!
  3. oh and u dont have to tell your rental company, as ur official receiver will do that. Check your contracts of ur letting agreement as mine did'nt mention bankruptcy but they do tell the agents and the owner of the property. When my letting agents found out they spoke with my husband to make sure we can still make payments. that was all.... i was worried they were gonna try and kick up out but they cant as there is nothing in the contact.
  4. Hi katie, The order you said to do things was right, i did it the same. Find nice house, move in, save up for bankruptcy, go to court and end of debt. When i used to get calls from lenders, i ignored them as all they do is call people through an automatic system and demand money, you tell them your situation and then u will get a call the next day. It only stops when u either pay them or go bankrupt. When i went bankrupt i gave them all my info about it and i havent had 1 call yet, most of the letters have stopped apart from 1 company who wont give up! You can tell them you are saving up for bankruptcy but it wont stop the calls as without payment your details stay in an automatic calling system and can be called up to 3 times a day till 9pm! yes and its legally! crazy! so i would tell them once but then dont answer there calls as u will be so sick of telling them the same story everyday.   5. Hi, Well i finally went bankrupt yesterday, no appointment necessary...! It was quickest £510 i have ever spent! It was quick and easy, took half an hour and the lady was very pleasant and knew her stuff! I have to wait for a call now to see if i need to bring any more information but it was such a great feeling when i had done it! A huge weight lifted (on to my husband!) i can know feel a bit better that no one is going to come knocking on the door or send me threatening letters now. I have a nice rented house, nice job and feel alot of stress going away. Just have to do it all again for my husband now! Think i need a holiday!
  6. Well i moved out of my house in May, to a different area and a much nicer house. We tried to leave our old house in a decent state as was told when trying to sell, how we leave the house can determine how much we get for it.. therefor trying to reduce the shortfall. (Which doesn't make a difference if your going bankrupt i suppose!) I spoke to the local council who said once our mortgage provider receives the keys, they will get notified by them and we will only have to pay up to that date. I did receive a large council tax bill, but when i told them the situation, they advised to wait till they hear about the repossession and then they will send us a new revised invoice. Which after a few days was that they owed us money! A whole £50! We have seen our house up for sale with the same company we had it up for but with £25k less! So our shortfall is now £35k! I know they can get more for it, but they seem to now even want to try and claim some money back for themselves! when i posted the keys back, i did it recorded del with a note saying my name, the address of the property, my account number and that i couldn't afford the mortgage anymore. I didn't enclose my address, but later gave them it as they sent me some forms, which i signed as advised by the CCCS, (any forms signed before the bankruptcy is fine BUT do not sign anything after as it may make u liable for any payments.) These forms were just confirmation i didn't want the house ect.. Since then i have have got a new job 5 minutes walk from my house, a lovely house in a great little town. As i don't need my car, i sold it to pay for my bankruptcy. I now have the money and the forms completed and hope to go to the courts today. Well as long as i can get an appointment, as i thought u could just turn up! If it all happens today, i will post the experience on here as i dont know what to expect and i am suspecting all these horrible civil servants, staring at me, judging and making me feel worse than i already do! Anyone know what there like and how quick the process is? I heard it can take all day! And trust me to choice the day when its going to be 29' today and ill be roasting in the courts!

Thats great about the house insurance... and that you got a 6 months exempt from your council tax, i wonder if that depends on what district you live in..? or do they all do that, as to honest i never thought about council tax! we finally got somewhere, we got offered a few places to our surprise but typically my husband choice the house with the big letting company who were adamant we needed credit checks ect! we somehow passed with flying colour's and we move in 26th May! So we are very happy as its big enough to have a family in! When u file for bankruptcy, they ask u where you have lived for most of the time, as to where ur debts are registered.. as we are moving to a different county, would we still have to do it here or at our new area? Do we have to tell any of our debtors are new address? Its great to see light at the end of the tunnel, and when the bankruptcy goes through i can finally relax! With the regards to the comment above about the company who fills in the forms, i wouldnt use them as the forms are not that bad (okay i know it did take me a while to do them) but if u have probs the CCCs are great and why spend more money than you have too, save the extra money you would spend and have a wee holiday! I know i will when this is over!
  9. I have found some rental companys do not do credit check but work references. We have found a small house that said as long as we are employed full time thats all they need! I also got a copy of our credit report and mine was quite good..??? So if your looking at private renting, i would call or email the rental companys (go to right move and you can email all the rental companys on there and advice of your situation). I had a few replys advising they would work around my bad debt problems, and some companies are very good. Fingers cross we get the house we want!
  10. Any joint debt you have will go into your name, if your husbnd goes bankrupt. I am having to go bankrupt as most debt is in my name, and once i do, it will force my husband to go bankrupt aswell after. The thing that annoys me, is that you cant do a joint bankruptcy and have to do it seperatly! I think you should be able to go it jointly especially as most of our debt is joint. Wouldnt it save the courts time and money doing it this way? With regards to the council rehoming you, you dont know where they are going to put you...? You could end up in a really bad area! Im currently looking at private renting, but im concerned as my husband is going to have to put his name down for it, as i wouldnt pass the credit check! Wouldnt anyone recommend telling the letting agent about your bad credit or just keep it to yourselfs? Even tho, this is a horrible situation to be in, i feel much more relaxed after reading everyone posts and that your not the only one going through this!
  11. I would like to thank everyone on here for there advice! I am going through a very similar situation, where i cant pay for anything due to wages being cut. I have been trying to sel my house for 6 months with not 1 viewing and its already at negative equity! I have to sell it as i have spent way to much on things breaking and think if i dont move soon, the house will just fall apart! After having read everyones threads, i was given the same advice about handing keys back by the CCCS and thought it was a very drastic thing to do but it seems alot of companys recommend this. Doent Payplan charge for these services? i was always told never to use them by the CCCS and having experienced them from working as a (dont hate me) a debt collector for a major bank.:-| Can i just clarify something as you guys give great advice! If you need to go into renting and declare yourselfs bankrupt, the order to do so is: 1.Stop paying things to save up deposits and moving fees ect.. 2. Find somewhere to rent and get a contract signed. 3. Hand keys back 3. Bankruptcy. The reason i ask as i dont want the OR to turn around and say i did it wrong and have a restriction order against me.
