Sorry my reason for not following up was because: 1) Co-op Bank folded - so there was no "defense"!! 2) I stupidly started 2 different threads on this problem and I only followed in the other one!! Obviously they get a solicitors firm to send out a response to "buy time" for them to see if they can defend against a claim. That will give them an extra month of time in which to respond. It would be helpful if the Consumer Forums website pointed this out... It's a bit alarming for a newbie like me to get a solicitors letter back from a bank. Most people are saying banks won't contest a claim - they may not - but they may employ delaying tactics!! It might help newbies if there was a short FAQ - so they might expect an initial solicitors letter, etc. Bob
  2. Hi Thanks for the interest mate. Actually I am about to send off my Notice of Issue form, to my local County Court, to accept their payment of the full amount (inc. court costs)!! I guess the solicitors letter is an automatic thing to give them more time to pick apart (they hope) the POC. Unfortunately (for them) I had my claim very carefully set out. Thanks again to the Consumer Action Group POC's documents. They did the trick for me!! Anyway that's my 4/ 4 claims settled with a very satisfactory outcome for me. Bob
  3. Hi I recently followed the standard procedures for claiming back Credit Card Charges from 3 banks. 2 folded and paid up... However the Co-op Bank is contesting the claim (which is for They will legal firm in Manchester fighter for them... While I have no legal help and a very limited knowledge of consumer law!! Naturally I have read "Small Claims Procedure: A Practical Guide" and the OFT ruling on charges document before I started the action... I could really do with some advice now as feel I am likely to lose this claim!! HELP!! Bob
  4. Ok guys, I've attempted to reclaim credit card charges off RBS, MBNA (2x), and the Co-operative Bank. RBS and MBNA (2x) folded during the delays between my First Letter and my LBA. The Co-operative Bank sent back snooty letters for the first letter and LBA. So I thought OK lets kick some butt!! I used the up-to-date POC from the Consumer Forums. I recently filed the claim at my local County Court. I heard today that a Co-operative Bank appointed solicitor that they plan to contest the claim. I was really hoping it would get under the radar (as it's for less than 100.00 GBP). Anyway able to offer any words of advice me as a first time claiment newbie?? I have read through the 2006 OFT ruling (where I gather the 12.00GBP figure is effectively a temporary maximum charge level cap i.e. not "cast in stone"). I should also add I have a copy of the "Small Claims Procedure: A Practical Guide" which I have read through. I will post back soon with details of the Co-operative Bank defense (when I receive this)... Bob
