  1. Hi Supasnooper. I'm learning!! Thanks for your advice again. Is there a template letter for unreadable agreements? Am I right in thinking that small box of unreadable smallprint couldn't possibly contain all the necessary terms to make it enforceable? Thanks again
  2. Hi CitizenB Thanks for the great advice, it will all be simple to me soon!! This card is my Dads, he can't remember how long he has had it but is sure it's before 2007 and it was not an online application. The leaflet with terms and conditions that you tell me are current doesn't surprise me because it is an original leaflet they have sent, not a copy and it is very crisp and new looking! I will have a read up on the threads you have suggested and send the letter on Monday. Thanks again

The account has been going for many years and this is all new paperwork. The "agreement" is not a copy of anything original. It looks like it was printed at my request. I will send a copy of the letter you suggested on Monday and await their next move! Thanks for the advice

It is the same as my monument posted on here yesterday so I am not going to post it, I will treat it the same as my one. Everyone's advice and support is very helpful and important to me. Without you guys I would be in a very dark place right now. As things stand I'm still living and breathing (therefore fighting!) and I feel like there is hope so thank you x

AJC Amex pictures by cupcake62 - Photobucket I'm new to this but I would say it is not enforceable because because the smallprint is unreadable, they haven't signed the agreement, it looks like an application form and they do not state the necessary terms. Am I correct on all counts or have I missed something? Could someone suggest a reply please. Thanks:)

  14. I have recieved this today in response to my CCA request. EC mon pictures by cupcake62 - Photobucket Am I right in saying this looks like an application form and doesn't have the correct terms therefore they cannot enforce it or am I missing something? What should my next move be? Thanks
  15. Just an update! I sent the letter suggested by 42man along with a telephone harrassment letter by recorded delivery yesterday. Today I received the 2nd part of their terms and conditions as their first letter suggested. They look to me like a current set of T and C's. I am posting them just in case.   16. Hi Midge61 I would love to challenge this agreement. Not because I don't want to pay it but because I feel we were not advised properly about their conditions. Unfortunately I have a lot on my plate at the moment (see other threads) and do not want to rock the boat with Blemain. I have read some very nasty things about their behaviour. I hate to sound like I have been scared off but for now I have! I am keeping a keen eye on any information I can about others with these sharks though. Good luck!
  17. Hi Dizzykate I am watching this thread with interest. We too have a loan with blemain, didn't realise just how ownerous their terms were and didn't think we would have to have the loan more than 6 months (that was nearly 18 months ago!) I recently started a thread about it too wondering what I can do about their terms. http://www.consumeractiongroup.co.uk/forum/mortgages-secured-loans/182358-blemain-agreement-has-gaps.html Our loan is not regulated because (I believe) it is for more than £25k. We did ask a solicitors to look at it for us but they said because it was unregulated there wasn't very much they could do. I hope this helps and I keep my fingers crossed that it might be different for you.!

  20. Can someone please advise me on this agreement. I am trying to understand these agreements and Supasnooper has advised this one has all the right terms etc on it, so I am not looking for faults, just trying to understand so when I get the next one I might know what to look out for. Under the address box it says "In condition 1 we have set out some special meanings we have given to words in this agreement." Am I blind? I cannot see condition 1. Should there be another piece of paper? I know this isn't enough to be unenforceable I am just trying to understand what is written. Thanks
  21. Thanks MG I will have a look but I don't think I have any bank charges in the last 6 years. I've never missed a payment on anything, that's why I'm in this mess. When I couldn't afford to pay it I just kept borrowing, thinking life would be over when the day came that I couldn't pay! Absolutely sick of the phone calls now! Do they really think if I haven't answered the phone so far I am honestly going to answer it in two minutes time?! OBVIOUSLY BECAUSE THAT IS HOW OFTEN THEY CALL!!!!!!!!!!!! I am going to have a look for a template letter to send Barclaycard re there attempt at fobbing me off with t and c's from 1997. I don't really know what to do about Sky. It would appear that it is enforceable so I don't know what to do. Being that, that is the only one we have had back so far I am tempted to pay it this month but not sure if I'm just making things worse if I pay them and not one of the others. (I think I have read somewhere that sky is part of barclaycard and they are the worst for telephone harrassment! If they find out I have the money to pay sky will that make them call me more?!) Anyway thanks for your continued support I'm off to find a template letter. x
  22. Thanks Underdog! I am learning fast with all this! It makes me more mad the more I learn but also makes me tougher. I WILL fight them all the way (with everyones help please!!). We work so hard every day, my other half is so exhausted after working all weekend (and a physical weekday job) he fell asleep by the time I put our kids to bed tonight (8 o'clock). Why should we give in to these crooks? I just need to keep on top of it all and learn a little each day. One day we will be in a better place and I will be in a position to help others in similar situations.

Hi I have received my nationwide statement today and they have taken my £1 postal order and put it on as payment to my account although my letter made it clear that it wasn't to be used for anything else! What do I do now? Should I wait to see what happens about my CCA or should I contact them now about it? Thanks
  24. Hi Underdog Thanks for your post. So I cannot write to them and ask them not to apply charges? I am going to write anyway because the phonecalls are getting ridiculous now. I wasn't aware of the insurance for loss of rent in time to take it out on that tenant but I since have done with all my other tenants.
