  1. I have to say (and don't kill me!) I have never had any problems with BCT. I wasn't forced into insurances etc and they have never contacted me for anything - I suppose it helps that I have never missed a payment with them though!

My troubles with Welcome are long documented and I am very glad to see them going down the toilet - and I can stand on my pedestal and gloat now my credit file has been rectified curtosey of our lovely Nottingham friends!!

Well I think in for a penny in for a pound - I'll make them the offer - if they say no then I've not lost anything they can have their car back via VT. If they say yes then goody for me.

This is what I have drafted for them

I am writing to you with regard to the above vehicle which I pay a HP agreement on to your company.

I have expressed the wish to voluntary terminate this vehicle (I am past the 50% payment) as I have arranged to purchase a new vehicle and this current vehicle is very much in negative equity. This has not been helped by the high APR on the agreement.

I have never missed a payment to your company and would like to make a one time offer to your company which I hope will be in the interest of both parties.

I am willing to make a lump sum payment of £500 to your company in exchange for the vehicle and my credit file being marked as the agreement being settled and your marker being released from the car on the HPI register.

Should you not wish to accept this offer than I ask that you continue with the Voluntary Termination as planned. I have been assured by your representative arranging this that this matter will not have any negative bearing on my credit file.

I believe 14 days to be an adequate timescale to respond to this matter – should you not respond in this timeframe the offer will be withdrawn and the voluntary termination will go ahead and I will make no further monthly payments to yourself.

    Yours Faithfully

  2. Thanks - I initially enquired about VT'ing a couple of weeks ago and they tried to pursude me to settle the account in full.

I told them that the p/ex value means that there is about £1.5k negative so there was no point. They then said they would accept a lower figure to settle it. They would accept £1.5 instead of the £2.5 outstanding.

The finance company in question (BCT) is currently not lending to new customers (a sign they are in trouble??) and therefore thought they might be interested a short settlement.

I was thinking perhaps send them a cheque for say £500 with clear instructions it is only to be banked if they are

    a) accepting it as full and final settlement of the HP agreement and they agree to reliquish their marker on the car on the HPI register

    b) my credit file is updated to paid in full and settled

Should they not accept this offer then they must return the cheque uncashed within 7 days and then arrange the VT as requested.

    Any thoughts?

  3. Hi all

I am lookig into VT'ing my car - not becasue I can't afford it - it's because I have purchased a new car and my current vehicle is in negative equity.

I am way over half way through payments in fact i have just 15 months left on my contract.

I have rang the finance company and they are sending me out my VT documents, at this point I asked if VT'ing affects your credit rating and he has told me No but it will be logged as settled - VT on my credit report.

However via other forums and website info some people have reported this does have a negative on their credit rating so now I am not sure what is the correct answer?

I am wondering if it may be an idea to try and F&F settle the account first and then VT if not.

The car is only worth about £1k p/ex now but has £2.5 outstanding.

I was wondering whether I should try sending them payment for say 50% of its worth in full and final settlement on the condition my credit file is marked as settled in full. I have never missed a payment to them or anything like that.

What do people think - should i try settling it or just VT?

    Many Thanks

    Andie

  4. I fear the "middle classes" are about to come out of this VERY worse off (not sure if that is grammatically correct)

They have already had my CTF off me - which to some is a small thing but as my son is disabled I got a yearly contribution - an excellent thing for him when he becomes 18! Whilst I paid in additionally to this my fear is eliminating that will not only decrease the interest you get as the market for them will decrease but as they are about to squeeze us hard those that have been topping them up may now not be able to afford too.

Child Tax Credits on the hit list - initally over £50k was the figure banded about however Theresa May has been quoted with a figure of £40k.

How helpful for familes where both parents work @ £20k each but pay out for childcare.

My childcare bill is in excess of £1k a month so using a fictional family earning 40K minus, tax, NI and pensions etc lets call it 30k. Minus £1k a month childcare = £18k

Hmmmm yes I see how that encourages people to go to work!

  5. Thanks all,

I sent the serious dispute letter last night saying they should return the account to Lowell to deal with the dispute first as they shouldn't have passed on a disputed account in the first place.

I have also sent the s10 above.

Not happy that Meritforce apparently do doorstep visits - I really don't want my relative to deal with them.

Thats the only reason I am thinking of offering a full and final just to make them go away and not hassle innocent relatives - though a loathe to do so as they have no paperwork.

  6. Hi Summer breeze,

I am about to VT my car - just because I have bought another one and the one I have no has such negative equity it's not worth part ex'ing it.

Have you been told anything about it affecting your credit rating?

I ask as I am getting conflicting info - my car dealer says nothing should happen to it

But then the finance company says it can have a negative effect?

As they are trying desperately to talk me out of VT'ing I wonder if its just a ploy?

  7. Thanks Pinky and Duffers

It's the only default I have so it's just a niggle in the backside!!

I assume I would have to contact O2 for removal of the default on grounds of no proof as they were the ones that put it on??

My only concern really is that Lowell were writing to an address I don't live at but is that of a member of my family.

Lowell accepted it was not my address but have obviously passed it on - Muck Hall and Meritforce obviously know it's not mine as their letters come c/o - surely they shouldn't be doing that!

Do Meritforce actually do doorstep visits or is it just a front? Them writing to me c/o I could care less but them actually turning up on a family members doorstep I do have an issue with.

Going to email them tonight saying they must be aware I do not live at that address hence the c/o and the homeowner will report them to OFT for continuing to use their address when it has been accepted that it is not mine. Will also throw in the serious dispute letter as a reminder that so far Lowell, Red, Hampton Legal and now Muck Hall have failed to provide proof.

  8. Thanks Pinky and Duffers

  9. Long story short....

Lowell pursuing an O2 debt - no paperwork to back up their demand for £500 - except of course for their excel spreadsheet sent from red with no customer details.

I have disputed this is proof - gone back and forward with them since July 2009 then basically just started to ignore them as they contest that their excel spreadsheet is proof.

In march I had a "once off offer" of a 30% lump sum reduction or the whole thing in installments of £25 a month.

Again ignored it - that signals to me that they have no proof of anything - come down a bit further and maybe we'll talk....

Then a month later a letter from Mackenzie Hall the usual "call us to make payments and stop this going to court blah blah blah"

fired off the in dispute email and left it at that.

Today a letter from Meritforce doorstep collection (funny though their email address is the same as Muck Halls!) and funnily enough guess what the £500 has now reached £780....

So I have fired off another indispute email and the reminder that I do not live at the address they are corresponding with that they are more than aware of considering the letters come addressed c/o!!!!

So now my thinking - I have a default on my account (o2 logged that not Lowell) - can I make an offer to Lowell just to go away or should I just ride it out knowing they actually have no paperwork?

I'm thinking I offer them say £100 in a Without prejudice letter in full and final settlement.

Does anyone have any experience of settling with lowell?

Also could I ask them to rectify the default as part of the settlement or would that be down to O2? (as a side point I did get a NOA)

    Any advice would be great.

  10. Claudia winkle man took over from Jonathan Ross on Film 2010

Jonathon Ross is married to Jane Goldman

Jane gold man wrote the screenplay for Stardust which also starred Rupert Everet.

Rupert Everet starred in My best friends wedding with Julia Roberts

Julie Roberts was in Flatliners with Kevin Bacon.

    Kevin Bacon to......... Amanda Holden

  11. Me thinks they are going to go to their agm and say they are doingnexactly what yes car credit did i.e. Run offntheir current loan bookmand wind it up......hence getting the man in that did it for yes car.

why would they do that otherwise? And it's funny because in reading back through their announcement of Jamie taking over there is no mention at all of him only being there in the interim to get their 2008 accounts out....

  12. Well eventually Global have crawled out of the woodwork with their real names this time.

Their letter starts with "you have returned correspondance marked adressee unkown which is incorrect"

Funny as I didn't return anything - in fact this is the first correspondance I ever had with them and the Tower front letter went in the shredder....

Anyway they are now pursuing an account passed to them by Paladin who had written it off as a non starter as no CCA...infact no paperwork at all!

Hence the once in a lifetime 75% off offer - errrrr how about 100% off as you have nothing!

So they have bought an indispute account...surprise surprise...

And they have said "we ask that you contact us immediately whilst you still in a position to have control of entries on to your credit file"

So lets start from the beginning again speaking S....L...O.....W....L.....Y and LOUDLY so they understand........

  13. Hi sexyfufu

I have just spent ages reading your thread!

Eerily similar I am also going to Disney for my honeymoon - though thankfully a different hotel!!

I'm not going until next July but booked in April this year.

It seems I have the same person dealing with my complaint as you had - her name is mentioned once in your thread....and I must say (rather sarcastically) she is a great help!!!!

For me as a gesture of goodwill they will allow me to cancel without losing my deposit.......

What an absolute joke...I told them they put their financial gain in front of their customers health and this is shameless profiteering - something they have failed to contradict me on.

Well on the bright side I have managed to get the exact same holiday with Thomas Cook for a lot cheaper than Virgin so I will be speaking with the helpful lady in the managing directors office on Tuesday to request an immediate refund.

I just don't know how they can get away with such things!

  14. Andie,

I am taking them to court, My hearing is on the 8th June 2010.

And i agree there customer service is terrible.

Wow - I hope you wipe the smug, we are better than you, smiles right off their faces.

They have treated me like rubbish - it was a completely different story when they were taking my £6k off me when I booked my honeymoon!

I rang them as in between booking and now my son has been diagnosed with a medical condition which means i will have to take pretty hefty medical equipment on the flight and I will need space to give him medical attention during the flight.

You wouldn't think this would be a problem for an holiday company that says in their brochure they help all disabled passengers.

Well they didn't feel the need to help my son and actually told me that I would be liable for excess baggage on his medical equipment and if I wanted more space I would have to pay for an upgraded seat there and back for us at the bargain price of £2199!!

    How very helpful!

  15. Hi

I tried writing to her as well.I didn't even get an acknowledgement from any of the directors .a large company that don't seem to care at the top .

I posted a comment on Facebook they removed it !

Cmon Mr Branson you can do better than this !

I emailed her and the next day had a phone call from someone at her office.....but basically still got nowhere!

There customer service leaves a lot to be desired!
