  1. Hi

    Can someone help me. Because I gave out the wrong account number to a supplier a payment pf £850 was transferred into the wrong account. The people who were paying me tried to get the payment reversed by Santander who have responded that they have tried to get in touch with the recipient but can't. They now say there is nothing more they can do. Does anyone have any experience or understanding of what I can do next?

  2. I have several old, pre 2005, unresolved cc debts. All have been the subject of cca requests and numerous responses. However, I moved house recently and am about to move again. Pretty soon my trail will go cold and they won't be able to find me for a while. But can they issue court proceedings in the meantime and I know nothing about it? Some thoughts from seasoned experts would be helpful.

    I have an old account with Morgan Stanley which I have asked for advice on this forum before. I have sent for a CCA and had letters from Cabot saying they have ben unable to find them.

    However, today, I received a huge package with an old agreement and all my statements in photocopy dating back to 2002. I have seen the agreement before but not the statements. I have been advised that it does not have the correct clauses etc on it.

    Can somebody advise me if the position has changed at all recently despite the award in the High Court recently going against the borrower

  4. We're dealing with the original creditor, who according to their letter, have not sold the debt on. But presumably, they will and the whole cycle will start again. However, what's interesting is that they used two DCA's to chase it down including the viciously unpleasant AIC based in Glasgow.

    Have you any experience with responses to this kind of letter post cca? I would be interested to know how banks and credit companies are reacting to this style of legality.

    I have two DCA's - AIC and HFO - who are chasing my other half. I have taken advice from the forum and have my own DCA's under control but both these two have had CCA requests and continue to call.

    We do not mention that we have sent CCA but just refuse to speak to them point blank. AIC are particularly unpleasant though we know that both of them have received the CCA as they were sent recorded and received.

    What is the line to take with them? Is is best to just keep playing this no comment game or send another letter reminding them of their obligations. Does anyone have any experience?

    I am no expert but it still looks like there is some evidence on your form that could lead back to you. Watch out for things like account number in top right hand corner and the allied number at the top.

    Apparently these people check these forums and they could get a heads up on your strategy.

    I am concerned with on-going sagas concerning two DCA'a that I may have unwittingly put myself at risk of forgery by sending letters with my signature on them.

    I have asked both of them for the CCA, sent recorded etc, without a signature but previous letters have had my signature.

    I have read on these superb pages that DCA's will pull any trick. Is this really a reality?

    I have just discovered on another photocopy from Cabot, which was much smaller, that there is a bar code on the side and beside that the words: application form.

     

    Here is the text of their letter to me:

    Dear x

     

    Your query

     

    We have acquired the original application form from X relating to the account and have enclosed a copy for your attention.

    If you now recall this account as belonging to yourself, it is important that you contact us as a matter of urgency in order to discuss your payment arrangements.

     

    Alternatively, if you still dispute ownership of the acount please contact us on the above number to discuss the matter further.

     

    etc

     

    Given that what they sent me is an application form and they mention that the account is in dispute do you have any alternative advice?
