  1. going back to this comment, a LOT (majority of) of my friends and colleagues were sceptical about this and thought i was mad for persuing it, until they hear ive got all my money back, now they are asking me for help!!!
  2. Hello and welcome!! Be sure to read through the FAQ's as they will show you the exact process to take. also pay special attention so you understand exactly where you stand legally in case this ends up in court (highly unlikely). I've now managed to collect full refunds on all 8 of my accounts (including closed ones) to a total of £3600!! Had to file a court claim on 2 though but they settled before going to court, but as you can see there is no argument on who is right or wrong! Anyway if they have only sent you 4/6 years does that mean the account has only been open for 4 years? If not remind them that the 40 day deadline is looming and you havent had your full DPA request fulfilled and you will report them to the data commissioner if they dont take action. Send the 1st letter including summary of charges with 14 day deadline. after that 2nd letter giving another 14 days then court action will be issued without further notification (if you didnt get a response,or a favorable response to the 1st letter then you can mention that your are not happy...) still not had a good response - start court action (add 8% apr onto the charges at this stage) Good luck!!
  3. Okay i'll go with your advice, thanks guys, im down to my last two now!!
  4. Im considering writing to them and giving them another 20 days out of goodwill from my part to relect on their position before applying for court action. In the same letter im going to ask them to provide manual intervention details and advse on the 40 day dpa rule... What do you think? Or shall I just go ahead anyway??
  5. Stupidly no, I used a different letter template from another website (before I came across this one) which does not ask for manual intervention details....so i dont have any of those details at the moment....what would you suggest?
  6. Hi I have got to the stage where the 28 days I gave both natwest and halifax are up, they have both offered me a meagre sum (15% of what im claiming). Anyway im about to file a court claim online to get my ful amount however i've realised that I have all information EXCEPT any details of manual intervention on both my accounts. Is it wise to write to the banks, offer them another 14 days to comply and at the same time send a DPA asking for manual intervention details (that would take up to 40 days to obtain) so i have this info before my case went to court??? Sorry if im stupidly asking a question that has already been posted somewhere Thanks :?
  7. Luckily i closed my HSBC account in Feb before starting action !! Im looking out for this for other accounts though. By the way im taking Halifax for £1300 in charges, however I have a credit card and a loan with them, do you think they might threaten to call in these two debts???
  8. Can anyone tell me if this charges thing also applies to clothing mail orders (eg. La Redoute, Grattan, etc..) They are just the same I would guess (giving you a credit account and charging late payment fees etc)??
  9. Posted my prelim on friday recorded delivery £1102.50 in charges... wish me luck!! Also collating info on visa cards and three other bank accounts so this could be a few big claims!! :o
  10. I've just been into the HSBC, Halifax and Abbey National to get copy statements printed, all three were asking questions as to why i wanted the information (to which I repied "none of your business, im asking for it because im entitled to it!!") The abbey national tried to charge me £4 for each statement printed (going back 6 years!!) to which i told him that they can only charge £10 in total (the manager went red and levied all chrges for the copy statements)!! Then he advised it will take 6-8 weeks to get the copies off of microfiche (to which i reminded him of the data protection 40 day rule) he went red again lol Im starting to enjoy making the banks squrim instead of the other way round!! Im also getting the distinct impression that staff have been briefed on this, which is why i got all the questions thrown at me by all three branches...
  11. Great thanks i'll keep everyone posted on progress!!
  12. Hi Everyone, im glad I found out about this site, i think its great what everyone has managed to acheive over the b###### banks!!! Im in the process of gathering all info relating to charges from accounts I have with the big four.. Anyway i read on the OFT website that they gave the banks until 31st may to respond, well i dont think i'm going to be in a position to have submitted my claim to the bank by then (as im waiting for the statements to arrive)...how do you think the banks willl respond and do you think will this affect me being able to get 100% of my unlawful charges back?? Thanks if you can advise... Ben
