  1. with regards to the original application form, do you mean the application for for the ADGD account? He hasn't used any of the services as I'm aware. He's already been in and queried the fact he didn't want and ADGD account but Natwest didn't care. (he's too nice to be forceful). Also, as the debt relates to bank charges, and with the current delay with the OFT case, how does this stand in querying the debt amount? thank you for your quick reply. Also, will this have any adverse affect on his credit? Thank you people!
  2. Hello, my friend's boyfriend was in a pickle with Natwest and I'm doing some research to see what his best options are. The problem is as follows: 1. He had an Advantage Gold account (didn't understand the terms) 2. not realising, he racked up a debt with them of £1500 3. he is now in full time employment and went to see them about sorting out a repayment plan seeing if he ould freeze the fees he was getting each month - they said no. 4. it is now with a debt collector's agency (not sure which one) The bank account is mostly from bank charges - I know this is suspended and for his piece of mind he wants to know this is under control and he is willing to repay it just to relax. Can interest be frozen on the debt so he just pays back the £1500? Any other advice on a way to pay this off? Would anyone advise a balance transfer on a credit card? Thank you in advance for your help and ideas!
  3. Does that mean that they can basically charge me what they want as long as they say it is for an administration charge? Surely that can't be right, otherwise they could turn around tomorrow and tell me I have to pay £500 in administration charges and make up a reason for it. It seems an unfair balance of power. Next time I will be looking to go to a landlord direct I think. Thanks for all the posts though!

  8. Me again! Our letting agency want to charge £100 + VAT admin charge when we leave the flat. We had a 6 month AST, then a rolling tenancy. When we signed for the rolling tenancy no new contract was issued, but I think we were bound by the original terms which never mentioned a check out fee. 1. Should I request what the admin charge covers? 2. Is it excessive in the unfair terms in tenancy / Unfair terms in consumer contracts? 3. If I complain about the charge can it have repercussions on my guarantors or even me? 4. on checking out, can I receive a receipt that shows the tenancy has ended, my guarantors aren't related to that property and my name is not black listed? Thank you .
  9. hit the nail on the head Mr.Shed! There are neighbours below who have harrassed us from day one. A family with debt problems, we have had to call the police on them before. they regularly have screaming matches, threatening to kill each other and even us. when we mentioned our intimidation to the letting agency, they said they couldn't do anything as the landlord was frightened about them damaging the property if he asked them to leave. Recently they have just put in a complaint about us about noise, we are not noisy and the letting agency admit this family are aggressive, have been problematic and abusive in the past and have advised us never to answer the door to them. I get the feeling that it is a case of keeping the most aggressive party happy, hoping they don't do anything stupid to the property. I want to move on anyway but feel sorry for my flatmate who wants to stay in the property. Thank you for your help though, I will let her know not to just accept what they say and hopefully it gets sorted out! Have a scale click from me!!
  10. I haven't seen the letter stating the admin charge, but there is no mention of it in our starting tenancy, which was a 6 month AST, and then we moved on a month to month basis. With regards to the month to month, we never received a renewed contract, but a one page form we had to sign and there was no mention of the admin charge there either. The flat is in hove, east sussex. Is there any grounds to prove to them that my flat mate doesn't need to physically move out? Thanks a lot for your help though Mr.Shed!
  11. MY friend and I have rented a flat for 1 year. We are on a month to month tenancy through a letting agency. I am leaving the property at the end of the month and gave the letting agency 30 days notice about this - explaining that my flatmate would remain and discuss options for tenants to take my place. My flat mate has found a couple to take my room, and told the letting agency who said this was fine and they would just need to do a new shorthold tenancy for the 3 of them. However, when I phoned them I have been told the following: 1. if one of us ends the tenancy we both have to move out. When I asked why, I was told a jumbled message of the following: 1. it was something to do with new legislation about deposits which now have to go to the government 2. It was something to do with being unable to change the guarantors. 3. it was something to do with needing to do a new inventory on renewing the tenancy which couldn't be done if my flat mate's things were still in the flat. (It's an unfurnished flat) Does any of this sound plausible? We have now received a letter saying we must both move out and pay £100 admin charge. What is the deal with admin charges? Can they charge whatever they want or can they be contested? If anyone can offer some advice it would be fantastic. We are 2 young girls, and I just get the feeling that the letting agency are taking advantage of us.
  12. Am helping my boss with his claim, he had already received 6 years worth of statements. 1. We sent the first payment request letter with detailed charges - heard nothing 2. We sent the LBA with the same list of charges - heard nothing He's about to file on MCOL, but I noticed that his account number changes in the statements 3 times. But, the statements follow on from one another with the balance carried forward. Does it make a difference? Do we need to quote all 3 account numbers under the one claim? any help would be great!
  13. Sounds a little conspiratorial doesn't it? I don't think that your regular bank employee gives two hoots about how much money is being refunded. I can't imagine a team of office employees living from wage check to wage check logging in and placing posts to gain our trusts to try and then change the tide... Ultimately, we are campaigning for what is rightfully ours, we're not being underhand which is why we can be transparent about our actions and discussions. There's nothing on these posts that the banks could read to help their defence, so let them read, and let them worry.
