  1. Once again: the toc will probably get next to nothing out of the £100 odd fare as RPSS will take most for administrating it.

    The original ticket was declared null & void for the reasons already given therefore it had/has no value.

    .

    FGW process their own unpaid fare notices via their prosecution department and will keep any administration paid themselves

    Just hoping to get out of a bad situation without opening unnecessary cans of worms, you understand. Not much to do now but pay up as quickly and painfully as I can - I've kind of gone off dishonesty myself!

    By your own admission you did not have a valid ticket for the journey made, this was by design and the Toc have reported you for fare evasion. The prosecution department will contact you in approximately 6 weeks, it is only when you have the reference number that you can respond with a pleading letter offering to settle out of court, which will cost you approximately £150.

     

    It is the prosecutor who decides if in this case he is willing to accept an out of court settlement.

     

    Once you have received the paperwork you will know which regulation to defend, this forum has lots of information which you will find useful once you have the paperwork and charge

    it is a requirement to tell the DVLA immediately. You must have continued to use the licence as a form of Id. As the address was not changed you have admitted leaving the property 3 years ago I have to ask is it a family residence?

     

    Honeybee is correct the Toc will not respond positively to a letter containing accusations, the prosecution team will look at facts to present and probability me a successful conviction.

     

    If this is your first offence the prosecutor will consider a pleading letter with mitigating circumstances. This is dependant on the Toc as not all are willing to settle out of court.

    I understand that you have a valid oyster card that you use on the underground and were using it to travel on First Capital Connect for your journey.

     

    As there were on gates you failed to see the validator and didn't pay for your journey before boarding.

     

    Fcc inspector was correct to issue a penalty fare for £20, which you refused to pay, they had your intent to avoid from that point and have followed the process to court.

     

    What is the offence quoted on the court summons? It is your decision how you plead but it sounds like guilty would be your honest answer - to date you have not paid for the journey made.

     

    The fact that you were unaware how to use an Oyster at a station without Barriers are mitigating circumstances, which the magistrate may consider when making their judgements.

     

    If the charge is bylaws 18 this is easier for the prosecutor to prove and will not impact on your future career.

     

    It is worth attempting to make an out me court settlement with Fcc prosecutor to finalize the matter even so close to court date.

  6. You need to appeal to http://www.ircas.co.uk with the ET reference number - they will need a copy of your valid season ticket and photocard.

     

    You are permitted to forget your season ticket twice within a 12 month period, on the 3rd occasion the penalty fare will have to be paid in full.

     

    If you need to make a complaint about the revenue staff this will be a seperate matter to the penalty fare notice, contact East Midlands customer services.

  7. Virgin Trains do not issue Penalty Fare notices, sounds like they will prosecute as you have shown intention to avoid fare. They had the option to issue an unpaid fare notice during the journey for the full single fare, having already given you the benefit of doubt and you did not purchase a ticket at the interchange station, I suspect that the prosecutor will shortly send a verification letter asking for your version of events.

    Try not to worry, but answer the questions truthfully and provide any mitigating circumstances that may be relevant.

  8. I have seen this style of letter before "1. Upon proof of claim that I am a person and not a human being." and suspect it may have orginated from another site that charges for its services.

     

    It seems a bit late in the process to open an appeal once the reminders have been sent the time to appeal has ceased, Old Codja and other posters have already attempted to advise using their professional opinion free of charge.

     

    If the ticket wasn't valid on the day and you have admitted that you didnt have a railcard when purchasing a ticket I can only recommend making full payment before the summons is issued

  9. I thought I recognised your name... I did advise on 6th January 2010 that the penalty fare you received last year would be statute barred after 6 months.

     

    Good luck with avoiding this fare too... and yes I also remember how you responded to my advice that you had got away with it. Thanks for that.

     

    I would advise that you always pay your fare when travelling on the railway or using the car park facilities provided by Southeastern.

  10. I remember watching a programme last year - probably Watchdog. Anyway this poor woman had her driving licence removed (not sure why) she had contacted them on numerous occasions and they refused to listen. The presenter drove this woman to Swansea and the driver concerned had it sorted out very quickly. I cannot attach the link as I am 10 posts short :-( google watchdog dvla to find the appropriate link.

  11. Perhaps they gave you the benefit of doubt on the first occasion, and cancelled the PCN as a gesture of goodwill. What was the time difference between all 3 offences? Having received a PCN for "not displaying valid ticket or permit" to then get another two for the same reason would seem careless, the onus is on you to ensure the permit you hold is displayed.

    Sorry if this is not the answer you were looking for but it could explain why the remaining 2 PCN's have not been cancelled.

  12. I cannot see any prosecution taking place as after 6 months as it will be statue barred. The posts indicate that you have admitted this is the 3rd time that you have failed to carry a season ticket within 12 months - don't forget your season ticket again or you will definitely face a prosecution with no opportunity to pay a penalty fare.

    I would count myself lucky that you 'got away' this time as obviously the TOC involved decided not to prosecute on this occasion. I'm sure they will deal with you more effectively as you have proved to consider yourself above the rules of all other passengers adhere to.

  13. If you were issued a penalty fare the payment date would have been 21 days after issue, sounds like that has expired (it is now mid-February)

    £46 must include the dreaded admin fees added due to your late payment, the £5 you quote must be for the ticket you would of purchased prior to boarding the train - any penalty fare is a minimum of £20

    Have you appealed yet??? Find the penalty fare and read what it advises you to do

  14. Appeal against the fine to the correct address...

    but also write to the customer services (should be able to find address on the train company's website) ... if the railcard was valid when you purchased your tickets but expired before you completed your journey you may be able to claim you were mis-sold??? It's worth a try as having read various posts it looks like if you didnt have a valid railcard you will have to pay all 4 fines OOCH!
