  1. Hi M It says on the letter that I can write back saying why I disagree with the outcome and provide anymore evidence that they haven't already seen. I can also ask the Ombudsman to review the case... At the end of the day I haven't lost anything by taking this path and I didn't give up at the first hurdle but I can't see how I can give any more proof than I have already given. Onwards and upwards I think. Good luck with yours M, I am still subscribed to the thread so let me know how you get on. I am still awaiting the outcome of one more complaint so fingers crossed for me R
  2. Hiya I quote the reasons from the letter.. 'I accept that the firm may not have adequately explained the ongoing cost of the policy and potential monthly benefit that would be paid in return for your premiums. However, even if the firm had done so, I am not persuaded this would have affected your decision to take out the policy. I say this because I think it is more likely than not that you would have still purchased the policy if you had understood exactly how much the policy would cost and the potential amount you would receiving in benefit in the even of a claim. I have not seen sufficiant information to suggest there are any other reasons to recommend that your complaint be upheld' I must confess to being a little confused by this response. The complaint was that the policy was'nt purchased at all but either added without our knowledge or the wording not clear that a box had to be unticked rather than ticked and my husband missed it. In any event, it's now 1-1 in RKM versus the baddies.

  4. Quick Update: Had call from adjudicator asking a) what was the employment status when the card was taken b) what were employer benefits i.e. sick pay etc c) why did we think the box was ticked hmmm just have to wait and see now
  5. Hi I got that letter but for First Plus. You have to sign it and send it back to the ombudsman before they (FP in my case) get in touch with numbrs. I kept hold of my letter for 2 weeks waiting for FP to get in touch then I rang the Ombudsman for direction when it got so close to the 2 week deadline.. Ring the FSO to check but I think I am right.

  7. Good afternoon all I have now received a photocopy of the CCA Credit Agreement from Egg. Nowhere does it make any mention of PPI. I will update with any news. R x
  8. Hi, thank you for your help. Does this sound ok? Further to my telephone conversation with one of your Staff today, I write to confirm the following. Following my complaint to the FSO, I am in receipt of your letter dated 21/12/09 which gives me a breakdown of the full refund of the PPI and interest on the above account and also confirms the cancellation of the PPI. The refunds were made by cheque and included with this letter. I am also in receipt of your letter dated 04/01/2010 advising me that the refunds have now been completed and of the new loan payment amount with effect from 1/2/10. However, on the 4/1/10 you took the monthly direct debit for my loan payment as normal but you took the PPI payment amount as well. I believe that you should not have taken this PPI payment as you had already cancelled the PPI policy on 21/12/09 and refunded me in full. I would like a full refund of this PPI payment taken on 4/1/10. If I do not receive a full refund within 14 days, I shall have no hesitation in filing another complaint with Ombudsman which I believe will result in another £500 fee to yourselves.   9. oooh I got a screenshot too! It just had a box with Accident, Sickness, Life cover written in it (I think it was that - off the top of my head). They said also that Egg staff couldnt amend the boxes... that being the case then, it MUST have been pre-ticked! R
  10. Oh eck - I'm back already with a question! Letter dated 21st December came yesterday. Says to confirm ppi now cancelled, full breakdown of refund and cheques. Today letter arrives saying date of amended payment for loan only starts 1.2.10. In the meantime on 4.1.10 my monthly payment was taken including the PPI part... I have called them this morning to get it back but they say it's right as new payment doesn't take effect until 1.02.10. Am I right or are they? Thanks
  11. Hi I came on this site just a year ago in a dreadul state of stress having uncovered the truth about our PPI. I just wanted to let you all know that following my referral of the case to the Ombudsman FP agreed to settle and put me back in the position had I not taken the PPI. They have today sent me a cheque for the PPI payments made and a cheque for the 8% interest on said payments. They have also credited the loan with the PPI amount taken and also the interest paid on this. Over the last year I have also claimed back two lots of credit card charges against MBNA, have a claim in against Egg card for PPI and another PPI for FP but through Freedom Finance. My eyes have truly been opened to the sneakiness of these companies and also my gullability. All these claims and successes have stemmed from the encouragement and reassurances given in those early days not only on this site but also MSE and FP Complaints. I truly was at my wits end and have suffered a deep depression over the last 12 months due to the stress. I just wanted to say thank you to those who responded to me for their time and the encouragement and reassurance given, it really did mean a lot.
  12. Hi. Thanks for your post. This one was done online too, in 2001. I did the SAR but didnt get the Agreement... She did say on the phone that they hadn't sent it to me hence the need to get it from somewhere else. Hmmmmm
  13. Hi. I have filed my complaint with the Ombudsman regarding the PPI on my husbands Egg card. The claim is for mis-selling in that he didn't know he had it (don't ask how he didn't know - I was dumbstruck when I realised!) and he certainly didn't need it as it gets 6/12 full pay 6/12 half pay from work and we have plenty of private life insurance. I had a letter last week from the Ombudsman asking me for a copy of the Egg CCA Credit agreement. Having followed the process of SAR etc initially ( I have just won a case against First Plus so kind of had an idea of what to do) I found I had not got a copy of this document. I got my husband to ring Egg and eventually managed to get them to talk to me to be told the CCA would 'have to be requested from another building as it was not usually requested'. Now, this is where I lack knowledge. Why would the Ombudsman want a copy of the CCA when I have claimed for mis-selling of PPI? Having read the threads on here for the last 4 hours I can't seem to find a reason. I have also spoken to the person dealing with my case at the FSO and he said he had requested a copy from Egg too. Thanks in advance for any ideas which could enlighten me.

Just had a letter from the ombudsman saying First Plus are going to offer me a settlement based on 'the general approach that the FOS takes when we decide that a consumer has been mis-sold a PPI Policy' PLEAAASE Tell me I've won the case somebody ...
  15. Hi thanks for your help again. I have already covered 99% of these points in my original letter to First Plus which they say they have seen at Freedom. I have rehashed the letter and will send it tomorrow. I suspect it will come back with either a general no or a re-direction back to First Plus. I also have an Egg card PPI which I am in the middle of. They have said that my husband must have ticked the box on the online application in 2001 and that cannot be altered by egg staff but he didn't know he had it. I deal with all the payments and banking etc and assumed he knew about the PPI when the online statements came in (I checked them not him). The thing is he had a pre-existing medical condition which would surely have disallowed a claim? The have sent me the ombudsman booklet but I have not told them about the medical thing yet. Do I go back to them with it or go straight to the ombudsman? Im so grateful for any advice, getting a bit over my head now and stress is creeping in.
  16. Hi thanks for your help. I have the CCA for both loans and both are entitled First Plus. I have had a letter from Freedom this morning asking me seven questions. They state they will officially acknowledge my complaint when I answer them. 1. on what basis do you believe that the PPI was misold 2. Why do you think the advice was incorrect 3. What did the advisor say to give you the impression that the PPI was not optional 4. What did the advisor say that implied that taking the policy would assist your credit application (I never mentioned this in my letter) 5. What did you tell our advisor regarding your existing levels of cover and why do you believe that this cover would have been sufficient to protect your loan 6. On what grounds do you base your allegation that out advisor had no financial background 7. Why were you not aware that the PPI was added to your loan and would incur interest? This was clearly stated on the statement of price sent to you and the credit agreement that you signed. Now I answered most of these questions in the letter I originally sent to First Plus. Where do I go now? My claim with the FSO has only just gone in for the other PPI. It's all very confusing. Thank you for helping
  17. Hi. I already have one claim just going to the ombudsman with First Plus. I have discovered however that; My husband took PPI on a loan in 05 with First Plus which we consolidated in 06 (the 06 one is the one underway with the Ombudsman). He paid 7k in PPI on this 05 loan. When consolidated less than a year later he got nothing back. Just a new PPI on the new loan. I have done my SAR and my first letter to First Plus but they have come back with this and I don't know what to do.... I note from our records that the loan and Payment Protection Insurance we sold by Freedom Finance Ltd. Unfortunately this means that Firstplus does not have access to the telephone calls made at the time of the application. I am therefore unable to investigate the sale of the insurance. I have however passed details of your concerns to the complaints team at Freedom Finance. As they are responsible for the sale, they will investigate and respond in line with the current complaint procedures. It then goes on to say if I want to talk about this further, am disattisfied with the response or wish to escalate internally, then I am to call them. I have 8 weeks to respond. Now, yes I did go through FF on this first loan and PPI but my gripe is that First Plus didnt refund any of the 7k PPI after less than one year of use when the loan was consolidated. Do I go to Freedom, do I go back to First Plus or do I wait for Freedom to come to me. Please help!

  19. Hi, I am back again. I wrote back to FP asking them to reconsider my complaint. Whilst they claim no liability, I have today had an offer of settlement if I cancel the cover, I don't find this offer acceptable. Do I now write back to First Plus refusing their offer or do I just go straight to the Ombudsman. Thanks in advance
  20. Hi. Im back with a reply from First Plus. They have disputed every one of my reasons for being mis sold my payment protection. I'm not sure whether I am supposed to write back to them or do I go to the Financial Services Ombudsman next? Advice would be very welcome

  22. The red are my husbands replies. FP.The questions I need to ask you relate to Insurance policies that you may or may not have. Separate to what cover you may have with us already and separate to what cover you may have on your mortgage so I just need you to forget about that for a moment. 1) If you were out of work due to an accident do you pay into any separate Insurance on a monthly basis that would repay the loan to First Plus. No 2) anything for Sickness . No 3) anything for unemployment . No 4) Do you have any separate life cover that would repay the loan in full to First Plus... I don't know the answer to that.. FP Don't know, no thats ok, thats fine 5) Do you get death inservice from your current Employer - yes 6) and if you were off ill would they pay you - Yes - FP How long would they pay you for - 6mth Full & 6 mths half pay - FP Brilliant, great 7) and lastly do you have any other financial arrangements like savings plans or policies in place that again if anything was to happen you would be able to repay the loan in full to First Plus - No Ok I can recommend based on the information that you have provided that First Plus payment protection could assis you with repaying your borrowing ok. In making this recommendation ive not taken into consideration to details of any other existing insurance policies or arrangements you have so this insurance may duplicate your cover in certain areas. ok now a copy of the answers to these questions will be sent to you. Ok as I said what we would need to do is clear the credit cards and I can give you the five thousand that would be doing a loan of ****for you cards and put the loan over a term of 15 years purely so it will fit within our criteria and that repayment wil be ***, is that alright for you Husband yes it would reduce outgoings What I need to do now is just explain the costs involved for the loan of **** and the optional payment protection premium ok? So as I said the total monthly repayment will be ****, I will break that down for you Payment for the loan is £*** Payment protection is £***giving you that total monthly repayment of **** payable for 180 months. It includes insurance premium tax at the current rate. Are you happy with my recommendation that you take out the Payment Protection Premium Husband yep - FP Brilliant ok - what I will do then is pop these documents out in the post for you. (This next bit is said really fast) Ok before I send the documents I just need to run you through the insurance very quickly, ok so that you are fully aware of what Im doing ok. So you have applied for First Plus payment protection that could protect your payment in accident sickness involuntary unemployment, hospitalisation or death. It does not cover any medical condition that you know about at the start of your policy or saw a doctor about in the 12 months immed before the start of the cover, involuntary unemployment that you knew about before or occurs in the 60 days before the start of the cover. The cover lasts for the first five years of your loan and after this if you keep within the loan T& C and not made a successful insurance claim you can claim a cash back refund of the whole premium from FP. However if you settle your loan or cancel your insurance before the end of the 5 yr term you will not get a full cash back refund, the amount will not be proportional, it will be significantly reduced and will not include a refund of the interest paid on the premium, examples of the amounts that you would get back if you settled early would be advised in the documentation. The cost of the policy is added to the loan amount however our loans are not dependant on you taking any insurance offered. Now I didnt know about this premium until I pulled the paperwork out a couple of weeks ago. Husband was horrified and obviously hadnt taken in what she was saying. This is what Ive managed to think of for a claim: I do not believe that our policy was sold in our best interests At no point was is it clearly stated that the lump sum for the protection was added to the loan up front At no point were we clearly informed that this lump sum added to our initial loan would accrue interest over the whole period of the loan I was told I can claim back 'a cash back refund of the whole premium from FP' - there is no mention of the interest charged or it being included in this 'refund' This policy only covers for 5 years of the 15 year term even though we are paying premiums for the full 15 years This policy only pays a claim for 1 year - this would leave us not covered for the remainder of the policy even though we are still paying monthly premiums for the full 15 years *** receives 6/12 full pay and 6/12 half pay if he is off work ill *** has sufficient cover from work to pay this loan if he dies in service *** and *** have independant life insurance policies and had life insurance policies at the time this loan was taken This policy covers both ***and ***. At no point were any questions asked as to the employment status of ***who was and is still self employed - this means that ***is not covered under some of the terms of the policy which was not pointed out when the policy was taken We were not told that alternatives were available from other Companies to cover us for this loan We were made to feel in the call as if the loan was dependant upon us taking this policy - as if it we all part and parcel of the loan procedures Do you think I have a chance?
  23. Hi. I sent of for all the info First Plus had on our loan and now got it back. We took a loan and 13 months later requested another 5k. This was refused but in the call the FP person said we could consolidate what we had and if we paid off the two credit cards we had with this new loan then she gcould give us a cheque for the 5k that we wanted. My gripe is with the PPI which I didnt know we had but evidently from the transcripts my Husband agreed to. I have typed out the transcript of the relavant part of the call and would be grateful for some guidance on whether you think we have a case for mis-selling.. can I put the transcript here for someone to have a look at? Hi After pulling out my First Plus paperwork yesterday to find out how details of our loan, (we are thinking og moving) I was horrified to find that the insurance we were sold was lumped on at the beginning and has to be paid off including interest over the whole 15 year period of the loan, even thought we are only covered for five years with benefits for 1 year. Please could someone have a look at my reasons for claim mis-sold below and tell me if you think I have a case? I had no idea even though I signed the forms, which I obviously did in haste, that I was in effect being conned. My husband says I rang him and said you get 5 years cover and at the end of it you get the money back, to which he agreed. I had NO IDEA that they were going to add 16k+ to the loan for this! I haven't slept because I am so angry at my own stupidity. · We do not believe that our policy was sold in our best interests · We were not aware that a lump sum was paid in advance for this policy and then added to our original loan · We were not aware that this policy only covered us for 5 years of a 15 year loan · We were not aware that the payments and interest on this first lump sum advance would still be being paid throughout the whole of the 15 year period even though we were only covered for 5 years under the policy · The person who sold me this insurance stated.. you pay the premium and if after five years you havent claimed you get your money back... at no point was it mentioned that we would be paying a monthly premium plus interest for the term of the loan! Should I also add to this list that I am self-employed and was at the time of the loan? I don't even think I am covered. Thanks for your time
