  1. My account is filed with the courts, awaiting the OFT, HSBC solicitors hav acknowledged this. So, whilst checking my statement I noticed that they have applied debit interest of £14.95 on to the account. Can they do this as the account is with the courts and no interest can be applied until a judgment has been made? Cheers in advance
  2. Hi, My GF has spoken to Harrington Brooks who told her the letter from AL 'is gold dust' their solicitors are going to do all the work for no extra charge. One bonus of being involved with Harrington Brooks!
  3. Hi, My GF took at a loan in 2002 for £7000, PPI Due to the PPI she asked AL for a copy of the CCA, they have written back and said they don't keep copies of loans that ended over 6 years ago. This loan she ended up defaulting on, missed 3 payments, but has since being paying the loan back via Harrington Brooks. So, The loan was taken out over 5 years, would have ended in 2007/8 so the loan couldn't have ended over 6 years ago. AL have been sending her statements regarding this loan which clearly shows dates and payments, last statement May 2009. Are AL just avoiding/bluffing? as clearly their dates are wrong and my GF has a legal right to see her CCA, or does the Harrington Brooks involvement change the her rights/CCA? As they don't have her CCA does this mean the loan is not legal and therefore not enforceable?
  4. Pete, I couldn't agree more! I had a call today and once we got past the 'are you aware of the case....' He then tried to for data protection issues and go through all my details, i.e. wage, job, any other credit cards, debit cards, loans etc Having a great understanding of the data protection act this info had nothing to do with it, this was established at the start of the call, obviously I just referred him to the info they have is correct, this is the first time they have tried to do this. Im thinking of changing my phone numbers via my online account to stop the calls?! Jason
  5. Pete, It seems that way, since the letter im expecting contact from Metro after the 26th Sept. I shall use your template letter if they do. It's just annoying that you take them to court and they still try and 'bully you'
  6. Pete, My claim is for £1800, once the O/D is removed I will owe HSBC £950, £450 is charges. I have already moved banks so that's why they have probably haven't renewed the O/D. I'm not that bothered but I assume they will then move the account to collections and the added pressure that comes with that??
  7. Received a letter today from HSBC informing me that following a review of my account my O/D limit of £500 will be withdrawn on the 26th Sept unless i pay off what i owe. Can they do this as the account is in dispute and is now with the courts? iiyama

Hi, HSBC are still making phone calls re my overdraft and payment even though HSBC have acknowledged that its now a court issue and they have written back confirming that i only want to hear from them via letters. I assume they are trying it on and hide behind 'its automated' system rubbish. What can i do to stop this bullying?
  10. HSBC have responded, i have to fill in a questionnaire, further court cost ot £35 which has to handed back to the courts by the 7th Septemeber. Is this the way it goes?
  11. Hi, I have found all my documents for a loan of £7000 i had with HSBC, also included is the PPI paperwork, i paid £1480. Can i reclaim this PPI amount back? I have a computer print out of the loan agreement but a photocopy of the PPI agreement. Im certain that i was told i could only have the loan if i had PPI at the same time? I dont need to aske for docs as i have them what is the next steop. Thanks in advance
  12. Hi, HSBC have sent me a 'Defendant filed an Acknowledgment of service' letter regarding my Court claim . I assume its a standard response, defendant has 28 days from date of service of the claim.... the Solicitors are, Dg Solicitors 12 Calthore Rd Edgbaston Birmingham B15 1QZ BANK CHARGES KG Is this the standard response?
  13. Hi, I have had HS since 2006. I sent off a non-renewal letter to them following an annual hike to £120! Ive just noticed that they have taken out the money last month, when i phoned they stated that they never received the letter and the 28 day cancellation period has now lapsed. They have passed it on to their complaints dept who will decide whether i can cancel the policy and my money back. I realise that i should have sent the letter recorded delivery, but what are my rights?!!! Thanks in advance

  15. Just to update all those that have taken time out to help and advise me. I now have a 'notice of issue' to the claimant through my door from the Norwich combined courts regarding my bank charges. HSBC received their copy on the 3rd August and have until the 17th August to reply. I very much enjoyed informing HSBC when they last phoned me and requesting that they update their records with the Claim number, i was informed that they wouldn't be contacting again regarding this matter. Just to cover myself I used DG stop telephoning me template letter which HSBC have replied to. I haven't received a call from HSBC since the 1at August 2009!!! Fingers crossed with the outcome!! Cheers once again for all your help and advice
  16. Ok, SatNav has been returned and I have been to Comet. They printed off a receipt for me which stated the purchase date and price, 26 months ago, £250. I was informed that Comet staff have just been 'trained by the local Trading Standards' and that due to the age/nature of fault I would require an independent (possibly two) reports that clearly state that the USB port fell out due to poor manufacture. It was also pointed out 'that it could have fallen out due to excessive application/use' Hence the need for the reports, which is fair enough. However, Having contacted various suppliers of TomTom nobody repairs them in my area, due to Comet and PC World who can sell them so much cheaper then they can. I have been advised by Trading Standards to print off a template letter from their site and send it to the Comet store and see if they will change their stance, highly unlikely! So I hate to admit defeat but SOGA is a waste of time IMHO. You might as well buy SH items, far cheaper and if they go wrong you have nothing to lose as they didnt cost you that much. Thanks for all the advise!

  18. Hi, When the item first went wrong Comet printed off the receipt for me, its the only thing i have ever purchased from them, they used my surname to find it on their records to. With regard to the fault, its hardly been used and the USB connection on the sat nav just fell into the unit after i updated the software, apart from that the unit was fully working. Clearly this item was not 'fit for purpose' Whats the point of SOGA if you have to take them to court? Or is it a case of Comet et al testing your resolve? If i did take them to court is it likely that the court will go with the SOGA? Thanks for all your advise!! Jason
  19. I dont have the receipt but i paid by credit card which they keep records of,which i know they do as they have printed them of for me before. I will go in with a summary of the SOGA, I wont let this one go.
  20. Thanks legalpickle, Ive requested the sat nav back from TomTom and plan to take it back to Comet. I expect a 'fight' but i think a sat nav should last at least 5 years. I will print off some info on the SOGA to take in with me.
  21. I need to make a claim against my broken camera. All was going well until i was told my excess was £200. Ive never had excess of £200 i always go for £100. Ive been told i selected an extra voluntary excess when choosing online, hence the £200 excess. When i selected the policy (1st Quote) they phoned me and we discussed the policy, i own a v expensive hi-fi and always check they will cover it. As far as im concerned i was never told my excess was £200. I have since gone back online and yes the amount i selected was £100, which i assumed was the excess i wanted, not an extra amount. This isn't made very clear. The insurance company are going to check the recorded conversation and get back to me. But the 'vibe im getting is they wont budge. What are my rights as i feel i have been mis sold a product? I must add I didnt check the policy when it arrived as fully as I should but i just saw £ 100 excess and the amount covered and DD amount!
  22. DX, Doesn't the UK SOGA require you to prove that the item was faulty due to construction or an inherent problem? Were as the EU directive 1999/44/EC states that as long as it is within 24 months since purchase 'and fit for purpose' you are entitled to repair or replacement??
