  1. Buzby!! I know what youare saying, but the thing is I do not drink ,or fall on my face, or have any kids,cause I have reached 68 yrs and have left all that behind me. As I said before!! I should be able to open the spectacles without the arm falling off . In a nutshell you are saying that I have no rights at all. I was under the impression that there is a twelve month warranty on what a person purchases. Ok Ray!! Many thanks for info ....Bownesslass.
  2. I bought my spectacles prescription from Asda (Carlisle), some eight months ago. On Saturday 29/05/2010,I opened the case to remove my glasses,and on doing so the arm detached itself from the rim. Took the spectacles back to Asda and was met with a minion who had a real attitude problem, and didn,t attempt to hide it. Upshot of which was "tough",nothing we can do. Where do I stand with this,as she tried to blame me for the failure in the manufacture of these spectacles.Surely I should be able to open my spectacles without the arm falling off. Would it do any good to insist on seeing the manager of the store? In any case I am furious at the way I was treated. Advice please,and what are my rights. many thanks.............Bownesslass.:mad:

  4. Hello!!.To avoid confusion,I am Bernard,husband of bownesslass,hence my use of this site,but this thread is personal to me. For over 20 years I was a customer of Bank of Scotland,at a branch in the south of Scotland,although I do live in England..........This thread concerns charges by BoS,and Direct line car insurance. When my Veh insurance became due,I informed direct line that I may not use them on this occasion,and instructed them NOT to access my account at BoS,as there was insufficient funds to cover the premium that they had quoted. I think you know where this is going!! within a few weeks I received a letter from BoS stating that I was overdrawn and charged me £28 00 pound for the privilage plus "administration costs" the total of which amounted to £68 00. Now this may be seen as a trivual amount,but there is a principal involved. Despite being told to the contrary by me Direct line had accessed my acount,and BoS had paid out,regardless of there being no funds to cover the amount. It goes without saying that this did not endear me to either Direct line or Bank of Scotland On return from holiday I immediately bent the ear of Direct line,asking for an explanation,and did consequently,receive many humble apolagies,and a full refund for the amounts the had taken,so fair play to them. However Bank of Scotland were a different matter,in short they could,nt care less. This occured in 2006, and the question is........Could I still try to recover these charges,and what are the chances of success. BoS also done me on PPI for a loan I once took out,and,once again came up with all the usual excuses when I made a claim. Needless to say good people,I no longer deal with any of the two companies above mentioned. ..........Kind Regards.....Bernard de 73s.
  5. Hello Mintcake!! I,m Bernard,husband of bownwsslass and I have her permission to post on her behalf. The same same thing has happened to us,we were just left high and dry by Eversheds, although our case isn,t quite the same as yours. First thing is !! don,t take any nonsense from Link over the phone,as we were harassed up until last week.Make them put it in writing,and any thing you send to them do it recorded delivery so that you have proof of posting. If it is of any help this is what I did. When we were ditched by E/sheds I wrote to Link Financial to ask how they wished to be paid and asked for paying in slips so that I could continue with my side of the agreement.That was a month ago and I still haven,t got that information,so don,t hold your breath.I still sent the payment due on the date but I sent a cheque from my husbands bank account. Anyway!! just hang fire on here and in no time at all there will be tons of people on these forums who will give you some cracking advice.

  8. Hello wise people. I am Bernard,the husband of bownesslass. As usual I have her full permission to post on her behalf. These encumbants at Link financial are really getting on our wick. I have on two occasions,written to this outfit concerning the continuation of the agreed monthly payments of her account. Having stated that we would only deal with this matter in writing,youv,e guessed it she is being hounded by telephone. As you may be aware this subject has been posted in other places. We have no desire to be confrontational but it seems that Link don,t understand plain English,and are trying to provoke a response from her (ie upping payments)not a chance I might add. This kind of behaviour is not going to continue,and the stress of the harassment and bullying,is unacceptable. Ok good people, I,m sure there is any number of letters out there that I can mail to these dim wits,so any template letters plaese point me to where they are. When I have dealt with any responses and advice from you good folk,I fully intend to take issue with them as to the validity of this debt and their ability to enforce it further after such a long time. As I have mentioned in other posts,this debt reached such proportions through charges for this that and the other. The original amount was less than £400,but now stands at £780. My missus was quite willing to continue with her side of the agreement,but the same can,t be said of Link Financial. If anyone out there knows the address of the London head office of The Arcadia Group,to which D,Perkins belongs I will seriously bend the ear of the Chief Executive Officer, Sir Philip Green,and see how he likes it. ..............Advice on how to proceed please,Bernard on behalf of Bownesslass many many thanks:mad:
  9. Hello mate!!......Ok I have just had a battle with Advantis Credit,on exactly the same subject. I sent these encumbents the Statute barred letter and Guess what?? they ignored it. My next letter to them was informing them that since they had seen fit to ignore my first letter I DEMANDED that they instigate their complaints procedure,as to why they were prepared to continue the harassment whilst ignoring the laws that cover these matters. That was on the 12th of Jan, and I also informed them that I was now lodging a formal complaint against them to the OFT,Trading Standards,and the Financial Ombudsman. On the 20th Of Jan I recieved a letter from them but this time there were no threats,only sincere apologies for this ,and that,and the other. Better still on the 24th Jan , another letter that they had "Investigated" and INDEED my alleged "debt"was in fact Statute Barred ,and that they were no longer making any more contact with me as the debt had been cancelled,and would not be handing it to anyone else. Don,t bend your knee to them there is tons of assistance on these forums as I found out.:grin::grin: PS, The person who signed my letters was Josie Foster ......Process Improvement Manager .........................Advantis Credit Ltd
  10. On the 7th of January we were informed by Eversheds of Leeds that they were no longer handling the account we had and told us(by phone)to contact the people at Link Finamcial. WE duly wrote to link and asked them the way forward to continue with the payments and asking for a number of bank giro slips to post said payments.The agreements reached for these sums were hammered out some years ago and adhered to by way of regular agreed payments. True to form they ignored my request ! and Phoned ,despite stating in my letter to them that I would respond only to written material on this subject,they also said that they will be sending out a "budget" form to fill in, and that they did not deal in writing ,only by phone. Well they can send out as many forms as they like,we will not be completing any of them. Can they take this account into default in spite of my letter them? PS,I won,t be answering any more telephone enquiries from them....................Regards...de73s

  12. I fear that there might be too much of a time lapse,to do a great deal more than has been suggested. My wife can not remember having a binding CCA or for that matter a policy.She lost her job in1996 so it would be around that time when she made her "claim". when she did this she put it in the hands of the CAB who was acting on her behalf. Thing is!! Would the CAB have retained records of all transactions in this matter with Dorothy Perkins. After so long she can not bring to mind ever having a policy or not. Where the devil would we find such info,after such a time lapse.In any case we will not give up just yet. Regards........de 73s

Contacted the financial Ombudsman,who E,mailed me back suggesting that I should give advantis a chance to investigate my complaint in house,in the first instance,through their complaints procedure.   15. Hi, Pinknico. Very good question!! What the devil had she been paying for all those years? She asked for a claim form which they refused,out of hand,and just said she was not covered.If unemployment is not covered,then what the hell is.
  16. Hello!! I hope I am on the right forum this time. If I give a rough scenario could anyone advise please.My wife had a Dorothy Perkins store card for years and paid PPI at £5 per month for at least 15 years. When she became unemployed,she asked for a claim form,which they Refused to send,and told her she was not covered for this. They were quite prepared to send demanding letters,and charge her for the priviledge,when she dug her heels in and stopped payment. The debt went from £400 to £1060 for which she is still paying to the present day. Is there any way she could institute any proceedures to recover this extortion? We have only recently discovered these forums Any advice will be greatly appreciated. Regards........
  17. Hello! Further update of progress(or lack of)from Advantis credit. Having posted off Statute Barred letter on 19/12/08,I this morning 9/1/09,recieved their reply. "Thank you for blah blah blah"we have been unable to contact you by telephone and ask you to contact us on Advantis Priority Line to arrange a Payment plan(Yeah Right).Also provide us with an current contact number so we can contact you when necessary. If we do not hear from you within 14 days of the date of this letter we may commence legal action against you. Yours blah blah blah Advantis Credit Ltd. ------------------------------------------------------------- It seems that they have completely ignored the contents of the Statute Barred letter,and the last paragraph of their reply surely is a continuation of their threats. I will now report this to the relevent authorities. To do this who do I contact? Needless to say I will not be contacting them on any of their reply. Does anyone think I should send the second template letter asking for for a CCA,at this stage,and if so would it be an acknowledgement of the alleged debt. Regards.....

  19. Hello! Once again I,m posting on behalf of my Missus bownesslass. Anumber of years ago before I knew her, she took out a Dorothy perkins store card along with PPI for same. When she lost her job guess what, yeah you guessed it,they refused to stump up. This Insurance had been paid for roughly 15 years @ £5 per month,and she had actualy paid more in PPI than she owed them,(Barstewards) Question?? Would a claim be statute barred?or would it be worth having a go. She is still paying the damned card off......What do you suggest. Regards....

Ok ,this is excellent advice, the original sum was a paltry few hundred pounds but astonishingly it just seemed to balloon to the level,and yes the original creditor did add charges. After paying more than the "debt" was worth in PPI wife dug her heels in and on the advice of the CAB offered a small monthly sum which was aggreed to. The amount went from £400 to £1060 with charges,at present day it stands at £770.47. We have lots of food for thought now though. Many,Many thanks.
  21. By the way!! the debt in question was for a few hundred pounds,but each time she recieved a letter the amount escalated to £788 (present).
  22. Hello it,s me again! This is a difficult one but I do not intend to take any action until I have a cross section of advice.By the way I am Bernard,bownesslass,s husband and I have her full permission and confidence to post on her behalf. A good number of years ago she took out a store card card to finance birthdays and Christmas presents,etc etc. Circumstances changed and she found herself struggling to cope. The upshot of which was a confrontatioal series of letters and threats of court action by the creditor.Had she been my wife at the time it may not have been so bad. The CAB was involved and resulted in an aggreement being reached whereby an aggreed sum would be paid each month ,which shw has stuck to till the present day. When she took out the store card she also took out payment protection(£5 per month) that she duely paid for approx 15 years.The moment she lost her job they said it did not cover (as ever) her for unemployment. The aggreement reached was handled by a firm of solicitors Eversheds of Merrion St,Leeds, who have on the 5/1/09 (Monday) just informed her that they are no longer going to administer the account,and informed her (by phone) that she should contact their client,(Link Financial services Ltd) to discuss the account. Here is the question!! Is it safe to do that ? or should she let the Link people contact her? will she be open to pressure to increase the aggreed amount?.will they try to annul the aggrement. As we are both pensioners,this is quite stressfull,so any of you wise and helpfull folks out there who can advise us would be greatly appreciated. Sorry to be so long winded,Kind regards.

  25. Hello andHelp!! Please bear with me this is my first post on these forums. Within the last two weeks I have recieved a letter from a company named Advantis Credit demanding payment of the sum of £487.50.They say they are acting for Phoenix Recoveries Ltd, Sarl who in turn are in tandem with SDFS(Littlewoods).I have no idea where this has come from,but am informed that this dates from 1996/8. We are both Pensioners and have now had our Christmas ruined.Just today,we had a phone call from Advantis on this matter.I have asked for details of this so called"debt"but have come up against a wall. Please!! some guidance or advice, can you help?What rights (if any) do we have:evil:
