cherers for that, worth considering. I have heard (dont know if true?) of cases where an agreement has been challenged, the balanced wiped off and the consumer kept the car???????? is this possible? Thanks in advance

porsche financial services I dont think they are underwritten by anybody else and if they are it is not on the agreement can you advise?

Will do - have they confirmed to you they dont have a copy of the CCA? I pressume you wont be paying the 'bubble' payment? - and of course keeping the car?

Yes, and also because i dont have a copy of the original agreement and dont remember the T&C - want to check if they were/are fair? Can you advise on the outcome(s) as per my previous post? Thanks

Hi All, i have car finance that i am thinking of challenging the agreement on, if i do can the finance company take the car back off me or will i keep the the car until the dispute is resolved? If the agreement is found to be unenforceable, will i keep the car? Likewise if found enforceable, will they take the car or do i then just revert to making the agreed payments? Many Thanks

Thanks! i believe the error equates to about £12.00? the original loan amount was about £7/£8000 i think? Is that too small an amount to render it unenforecable? Thanks again for the replies!

Hi, i understand it can feel daunting. I was in the same boat the first time i tried it - so i used a company, which to be fair were great and took all the hassle out of doing it myself (and the time element, which was important to me). There was an upfront fee of £149 and a 20% 'backend' fee, but i was more than happy with that (at the time) as it was only payable on results! - which i got (£14,000 - wiped off!!). However i might look at the next ones myself (still undecided) but if you want the details of who i used you can email me ([email protected]) and i can send you the details? Hi all, i have an urgent question. After sending a CCA request to B.O.I (post office loan) and scrutanising the documents, it would seem their interest calculations are wrong (only by a small margin) - does this render the whole agreement unenforceable? The urgency is that they are requesting urgent payment of last months amount and i dont know wether to pay or not while the issue is being resolved (it is a joint loan and i wouldn't like my wifes credit file to be affected) Please advise if possible? Also if the agreement is unenforceable, what would be the next step/letter to send? Thanks All (fingers crossed!!) fingers crossed

thanks for the reply foolishgirl. what do you mean about 'statutory prescribed terms?' should i stop making payments on the account as it was longer than the 12 days and the copy they have sent me wasn't what i asked for - i asked specifically for a true, signed copy of my CCA, so until they provide it, its in dispute, isn't it? And also how do you post the agreement on? Thanks again for the reply

Hi, Wondered if you could help - this is my 1st post so not 100% how it works but heres my question: I have recently sent off (To Halifax) for a copy of my credit agreement, after the 12 days i sent the reminder letter, and about 1 week later i received a copy of the agreement - however this is not signed and merely just a blank, standard agreement (goverened under the consumer credit act 1974) Is the lender obliged to send a copy of 'my' 'signed' agreement or just a copy of an agreement. Can you advise what my next step should be? Also can business agreements be challenged? Many Thanks
