  1. i have had the same letters and what amuses me is they are treating our request as a complaint, i have complained to the complaints dept that they are treating my request as such. 7 day lba sent 01/08/06. steve b
  2. This is what is going in the post tomorrow, is there any improvement i could or should make? I am in receipt of the documents that you have supplied in response to my Data Protection Act information request dated 24/5/2006. The disclosure of personal data is incomplete in that at least the following documents are missing. 1) You have failed to provide a complete list of transactions and charges. from **/*/2000/ up to **/**/2005. 2) You have provided no notes, or documents relating to any legal action between you and myself. 3) You have provided no notes, or documents relating to instances of manual intervention. This is not an exhaustive list by any means, it is just an example of some of the information I am missing. Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998. The time for compliance with my request has now expired. If you do not comply fully with my Subject Access Request within 7 days, I shall apply to the County Court for an order to enforce compliance, together with damages at the discretion of the court.   3. yes that is sound advice thanks its appreciated. i have read that abbey usually closes the rebel accounts, i was hoping that the fact my account is very healthy atm might avoid that inconvenience, any feedback pls.... steve b
  4. the last letter i sent by registered post was this one http://www.consumeractiongroup.co.uk/forum/abbey-bank/4031-abbey-microfiche-argument.html have i missed something somewhere? i did call abbey and spoke to a girl who asked for more time to deliver the microfiche so i let the 40 days overun by 20 days, now i realise i was being fobbed off and lied to, rather annoying isnt it....... steve b
  5. hi, this is my first post here as i have been lurking, digesting and silently getting on with my claim with no probs until now. i have sent my £10 back in may with the standard template sar letter which was recieved on the 25th may, i have had the normal stalling replies and letters and again responded with the dpa template warning that non compliance would result in court action under section7 blah blah..... anyhow today 20 odd days after the 40 day original request expiry i have recieved a letter here is the content...... thank you for your letter of 13 june 2006 i am sorry you have had cause to complain in connection with a request for all transactions and charges on your abbey current account, ***** ******** you sent a request for these documents however you recieved a letter informing you we could only provide you with your most recent statements. i would like to advise you, under the data protection act request you will only recieve the transactions that are currently held on our systems, any earlier transactions have been archived on microfiche, which is not covered by the dpa, these archived transactions will therefore not be supplied to you under a dpa request. we can however provide you with details of the transactions held on microfiche for an additional fee of £10.00, if you wish to go ahead with this request, you will need to contact our telephone banking centre on 08459 724724, where an advisor there will be happy to assist you. (heres the good bit) this is my final resolution letter, i hope this has clarified the matter for you. however if you would like to dicsuss the content of this letter or have any new points you believe should be taken into account, and which may make a difference to the outcome of the investigation, please contact me within 14 days of this letter on the above number, if i do not hear from you by then, and you have not asked us to extend that deadline for any reason i will file my papers accordingly. should you be dissatisfied with the outcome of our investigation, i would like to remind you that you can refer your complaint to the financial ombudsman service, i enclose a booklet blah blah.... personally signed ----------------------------------------------------------------------------- what is the investigation they are talking about?? there is nothing to investigate, and more to the point where do i go from here i will not let them wriggle off the hook but to continue i would like to humbly ask for help from here. help! steve b
  6. hi, my name is steve i have been lurking in the background and digesting all the relevant posts regarding the abbey while carrying out my own action against them, to date i have sent the sar and had the standard letters in return. like others my sar has been a shambles with the abbey stalling and going over the 40day limit by @ 20 days now, anyhow i will start my own thread and keep you all (and myself) up to speed with my progress. all the best.....
