  1. Hello Jennifer - you're in exactly the same boat as me. Capital One acknowledged my claim today, with intent to defend. I believe that they now have 28 days - so for you, that is 14 April. Best of luck x
  2. ...at my local Country Court, but am still scared. Am doing it this way to attempt to have my default removed. Does anyone know whether they take cheque/ cards/ cash for the court fee? Will they be nice to me when I go in? Will keep you posted x

  5. Hello I've been reclaiming against Capital One, for £308. I had an account which defaulted on £200 owing (about 100 of which was purely charges). They never sent me a default, I moved, I contacted them 2 years later off my own back and started clearing what was now £604. Following a year of being passed pillar-to-post between Capquest and C1, Capquest sent me a Full and FInal Settlement letter for £300 which I paid - meaning, in total, I paid £450 of the £604. I sent my LBA to C1 asking for £308. They offered me £152, but to come off my total OWING TO THEM - which they have as £164. I sent them a copy of my full and final settlement letter from capquest, and yesterday RObert Uddy responded with: "to explain, the £300 payment was a full settlement because we weren't asking you to pay the rest of the balance. Howeever, as the Capquest letter mentions, the balance at the time was £464.71. This is why £164.71 is still showing as outstanding on your credit file" I'm now really confused, as I feel they owe me £308 for all my charges, and they actually want the defecit £12 off me to close the account. Does my Full and Final Settlement letter actually mean nothing? I'm more desperate to sort my credit file than to get money off C1, and I wanted this default removed - am actually shocked to realise it's been down as 'part settled' and not settled, as I figured that's what a Full and Final Settlement meant to me!? Can anyone advise me what to do now? Do i deny the £152 refund and go ahead and claim? Or accept it, pay the £12 too and wait for this to all disappear? xxx
  6. Many thanks Elsinore! The £200 was part charges, but mostly my overspending on gig tickets and Jack Daniels, alas. I know it's unlikely that i'll be able to get the default removed, as I did owe them the money - I just resent the long time it took me to get it sorted with them and the laziness on their part with regards to chasing me! I am sending off my SAR today, fingers crossed. A reimbursement would make the default a little easier to bare Have a lovely day! Bx

Hi guys I've been reading with interest how many of you claim back unfair bank charges from your suppliers, and wondered if you'd be able to advise me I had a Capital One credit card before University, which was full to the limit of £200. My stepdad died and I ran off to London instead of uni locally, forgetting all about the card (which had been paid fine up to that point). Two years later I found an old statement at my mums, got in touch and explained that I owed them money. This figure was set at £605 and the interest froze at that point (on debt of £200). It took a year (literally) of writing and ringing Capital One and Capquest (who were passed, then unpassed, then repassed my debt) before settling it at £450 (I'd been paying off £20 a time everytime I managed to get through to Capital One on the phone - before being fobbed off to Capquest again). My credit file has this Capital One debt on, and says Part Settlement (a bit harsh, beings I paid £450 on the £200, and they fobbed me off from Jan 2005 until March 2006). Am i within my rights to ask Capital One to remove this from my credit file, on accounts of the interest/non payment charges of £30 a time being unlawful? I do not have the statements, as I did not live at home at the time, and the account is now closed so not certain where I stand. I do not want the money back, but I would love it to be removed from my Credit File. I have put a Notice Of Correction on my file with Equifax but not yet witH Experian and Callcredit. Any advise is, as always, most greatfully received x
