  1. hi and thanx for quick response. Neither form has a signature on them. He did ask 3 times for a CCA over the phone when he informed freemans that she had ordered the goods in his name. But no response til we sent CCA request.
  2. Can anyone please offer some advice. My partner has recently sent CCA requsts to Littlewoods and Freemans. When he lived with his ex partner turns out she opened accounts in her moms catalogue in his name and ran up about 5grands debt. They are now chasing him for the monies for the goods. Freemans have sent a photocopy of a CCA but it is not signed by my partner. Littlewoods have stated in their letter that they cannot locate an agreement for my partner but also provided a copy. However they have also stated the date that the account was opened...which was 8 months after my partner left his ex. CCCS have said that we must include these debts in our creditor list but I am loathe to pay for anyone elses debts.....and so now I am not sure wether to go with a DMP or take on all the other debts myself. This includes 3 creditors with unenforceable CCA's
  3. Hi Just got off the phone from CCCS. They have advised me that the 3 creditors that I dont want to pay as they have not provided me with cca will still have to be included in the DMP. They said that as a charity they do not condone me not paying the debt as I have had the money and merely because the debt is unenforcable then that doesnt mean i dont owe them the money. She also said that as I have been paying the debt so far then I have acknowledged the debt. I asked her about what mozzat said that we can access the DMP online and put it to 0 etc and they said that if that happens it generates a report which will make the CCCS contact the debtor and asky why this was done. The upshot is - if I want a DMP with the CCCS then I have to include the creditors that have not sent me a copy of the CCA. Im flumoxed now as to what to do. Shall I do it myself (pro rata payments etc) or just bite the bullet and pay the CCCS. Any guidance would be appreciated folks.

Thanks Gold lady I went through the thread the other night about enforcable vs unenforceable agreements and despite being a novice I felt that it deffo was unenforceable but then as I looked further I began questioniong myself. Of course they seem to me not to have given me the relevant info that I requested and as a result I am sure that due to time they will not be able to produce a signed agreement in court if it got that far. So I am prepared to fight it all the way with the relevant guidance from caggers. Also what letter would I send now as they ahve failed to give me what i asked for????? any help would be great.

  7. Hi Have finally sorted out scanner and just uploaded my Nat West CCA request info onto photobucket. Please take a look and let me know what your advice is. I will follow this with my Tesco CCA request documents (unless I am advised to start another thread) Please note that the letter on the top is from Mint but is the exact same copy that I received from Nat West. Also they sent me a replacement card recently and Called me Miss Lane (which is not my name) on the accompanying letter which came with the agreement details quoting the 1974 Act etc Please look at the 7 documents below that I received.   9. Hi there all My chin is still up thanx moxtly to all on this thread. Update as follows No CCA back from Barclays therefore I have sent THE letter...I acknowledge no debt to you etc etc. (it aint stopped em calling me though- this resumed about 2 days after my telephone interview with CCCs) I am going to take this path for a DMP as it seems obvious choice and tbh when i told them that I was challenging 3 credit cards they said that I was doing the right thing. I have to admit I have copied all my CCA requests and have been religiously through the CCA agreement link about enforcability and unenforcability etc and Be Jesus it is gettong complicated cos of the disparity of the STUff sent to me. I will upload asap for the knowledgable Caggers to look at and advise me but scanner is being a pain. Can I ask in the meantime.....hopefully my thread hasnt been lost in the massive world that is CAGDOM. I have received default notices on 2 cards who have not sent me the right info. What do I do? Also how do I stop CCCS paying my debitors that I have listed who havent provided the CCA on time? Do we ignore them. I am pretty sure Bcard and Tesco and now even Nat west(who sent an app form) have not got the right info.....it amounts to £13500. Mint sent me the right details and I am haooy to enter into a proper DMP with them but anyone who has made boobies well I wanna contect it to the hilt.

  11. the mint card was taken out on line 18months ago so looks like that is a valid one then. Had a default letter from them this morning. need to look at the ppi stuff more closely. will update as soon as. Thanx again folks
  12. Does anyone have any views on just having boxes ticked on CCA's too? No signature. Must have been done online. The form says I am bound to agreement by ticking box. But surely anyone could have applied in my name???
  13. Well I will do my best to upload letters asap to get your opinions. Yes I checked the letters from Tesco nat west & mint ana all are same letters from same named worker. However each one has different results. I cant believe the diversity of them all. They all seem like mickey mouse outfits to me. They deserve to get stung for being such imbeciles when they cant even sort out sending the correct OA's and they all came from the same person too. The caseworker who was pp'd btw must think its crazy too! Ill update the outcome from Barclaycard when I hear. Seems like the battle is just beginning lol

  15. Hi Update as to CCA requests. I CC'd 4 creditors. Response so far from 3. They are as follows. Nat West have sent a signed credit agreement dated 2002. Mint have sent CCA agrrement with tick boxes no signatures. They have also said that I ticked insurance.(must have done this on-line) How do I stand with that one? Finally Tesco have just sent me a load of photocopied information and a last statement. No agreement signed by me so looks like they aint got one for that one which I thought would be the case. I havent heard from Barclaycard other than phone calls and texts. So I will semd them the default letter. What I did find strange was that all the CCA letters were obviously hand written by the same person. But I posted them to different locations. Anyway any advice would be great.
  16. subscribing to thread as in similar position. 14 days are up and phone calls are coming in - up to 9pm last night. We now have to send them a letter i think stating they are in default and no further action should be taken on the account. Someone will point us in the right direction i'm sure.
  17. Hi Yes I have and have just started having my wage paid into it so can ensure my priority debts are being taken care of. Had more calls from Barclaycard. mobile and landline. They say call from bcard press any key to continue ??? whats the point of that?? Also had a text from Mint today. Seems like it is all kicking off now! NO CCA's so I suppose I write to them now saying that the CCA is in dispute.....and alss send harrassment letters at the same time. Any suggestions? greatly appreciated
  18. Hi there not been on for a while as i have been waiting for the outcome of my CCA requests. Well! the 14 days are up today and so far no OA from anyone....thats Barclaycard, Tesco, Mint & Nat West. Had a phone call from Barclaycard today telling me that I must pay £260 from my debit card as they hadnt received a payment in Jan. (I have cancelled all of my CC DD's and have lettesr ready to send with a nominal pament. However stopped myself from sending them as I didnt want to send anything with a signature whilst I am in the 14 day period of the CCA request. I didnt pay that much as my minimum payment anyway. I flatly refused to play ball with her. I did explain that I had not yet received the CCA and the 14 day perod was upand she said 'I understand what you are saying'. I could hear her typing all the time. I also said I was talking to CCCS re DMP but hadnt had interview on phone yet when she asked me for a reference number. I said I dont have one yet and I certainly didnt have the money so under no circumstances would they get the money. SO! to all you old hats at this (not literally either) did I do everything right or does anyone have any tips (apart from changing my number lol)for future calls as I anticipate I will be getting a few of those. So what do I do next? any ideas? Oh and I have had a 2 month break from Halifax regarding my mortgage. I will go into arrears but whats the viewpoint on this one too? They ahve also offered that I pay interest only for a while to help me with my monthly outgoings. Any advice would be welcome. Thanks again in advance.

  20. Thanks for the info about joint account. I will write to all the banks etc about the overdrafts and loans as soon as my basic account is set up/ I have sent CCA requests today and now im just waiting. Girlaloud ! yeah thats me 38K unsecured. £100K mortgage and £11K secured. I had a loan with Northern Rock a few years ago. I suppose i should request the CCa for that too....(is it a CCA for a loan? or something else) Mind you getting a bit concerned about potential phone calls from creditors......so looks like i better get the harrassment letter ready too. I must admit now that I have finally stopped thinking that my credit rating is important i feel that some of the pressure has gone.
  21. Well he is aware of the joint liability and frankly i intend to transfer the smaller debt from my sole account to the joint account just before I change bank accounts. Therefore when they freeze it they will chase us both for it. the od limit is £5000 and it is at £3400 at the moment whereas my sole account has an o/d of about £1500 so I could basically move it all across so that I am only lable for half of it. Any opinions would be appreciated on this one....

  23. Hi I have applied to Halifax for a basic account. I do have my mortgage with them but thats ok so far. I have had 1 default from nat west with regard to credit card....but paid minimum payment after that. I will transfer everything as soon as I get the go ahead on the account. I need it soon though so that i can arrange wage transfer. my ex doesnt have a card or cheque book but i will get on to taking him off asap although I did feel that it would be pertinent to keep him on it so that we share the liability. He will get away without being liable for anything apart from that which i find hard to swallow at the min
  24. Oh and charges on the overdraft.....there are only interest charges...every month. I have never not been in the red. I have had a few cheques been bounced....for about £38 each....I think there was about 5 of those. Basically I have 2 accounts with Natwest. One is a current plus (joint with my ex) It used to be advatage gold but i changed it recently. The other is a graduate account. I pften have to take money from one to pay to teh other to cover outgoings and there have been charges put on for not having trabsfered money in time for the cheques to go out. I am really new to all this so dunno where to start. If there is a thread I shpuld follow plz let me know. Thanks
