  1. I've told RW in writing on a couple of occcasions and have written again today! I will write to the bank charges section if no luck with this. However, does an unfair charges claim amount to a dispute for these purposes? Also, would you suggest that I make a CCA agreement application? Thanks again

I'm in dispute with my former bank over unfair overdraft charges but despite my complaint being on hold under the FSA waiver I am being chased vigorously by a DCA called Robinson Way who are very persistant. I've told RW that the account is in dispute and supplied details of my complaint reference and referred them back to the bank but they are relentless. Can someone suggest an effective response or at least let me know what my position is. Thanks.

Well, I sent this letter with my complaint reference but am still being pursued vigorously by RW who say that my former bank state that they should still deal with their claim even though it is on hold because of the FSA waiver. RW are asking me to provide detailed information why the account is in dispute. I've recently read a solicitors' site saying that banks are now commonly using DCAs to pursue repayment even in cases which are on hold. I've again sent RW details of my overdraft charges complaint reference and referred them back to the bank. Can anyone advise me what my position is and suggest a form of wording which will finally get them off my back. Thanks
  4. Some months ago I made a claim against Lloyds TSB for unfair overdraft charges applied to my (now closed) account. I received the usual letter telling me that the matter was subject to legal action and was awaiting a decision in the High Court. The letter also aknowledged that I 'may be in financial hardship' and said their collections deartment would look at the matter. However, since then I have hard nothing about this but have received a number of rather intimidating letters from Robinson Way Debt Collectors threatening legal action to recover the disputed amount. Would someone suggest a course of action. Naturally I am quite anxious about the prospect of court proceedings.
  5. How I wish I had found this forum sooner. I found myself suddenly unemployed some years ago and have had so many moments of gut wrenching anxiety and sleepless nights by being pursued with the usual tactics by dca's. I now feel a lot less isolated and also that I have much more knowledge and ammunition to fight my corner and I have just started the process to reclaim charges applied to my account after my unemployment because my bank would not let me close my account whilst overdrawn. I will definitely donate to this site once my circumstances improve. Thanks
