  1. if they dont have the agreement then maybe they cant enforce collection of the outstanding amount
  2. Hi, hope someone can help me out, I sent the template letter to barclaycard along with my £1 postal order. I had a reply today on the 14th day. The letter says: : Thankyou for contacting us, enclosed with this letter is a copy of your barclaycard terms and conditions. if you need extra information or if you've any questions then visit our website http://www.barclaycard.c.uk or give us a call. Like it said all they sent was a A4 sheet with there terms which they send out with a credit card, The thing is, the original account was with Goldfish and barclays took over the account as they sent me a new card and the account is now called barclaycard Goldfish account, I never ever signed a new contract with barclays. I dont think they have my original goldfish CCA. My question is what should i do now, im not in any arrears and make the min payment each month.
  3. thank you so much for the replys, I dont think the PPI would be any good as i am self employed and i have had friends who didnt get paid out because they insurance said that by being self employed then they had affectively made themselves unemployed , if you can believe that. As for ticking the box, does this mean they can produce the documentation so i would be stumped. I have posted another thread about my old accounts with MBNA which now barclaycard have taken over, all i new was when i received new cards in the post, i never signed anything requesting new cards in barclays name so if i transfered my balance from egg to these old accounts which were applied for in writing years ago then i could stand a chance. maybe. just hoping.
  4. Can anyone answer this please, I opened credit card accounts with MBNA and Goldfish a number of years ago and paid them off and left them dormant, one has 89p credit. I then received a load of barcleycards and when i looked into this i found that barcleys had taken over my MBNA and Goldfish accounts. My questions are: If i transfered my egg balance to these cards and waited a couple of months would the cards be enforceable as i have never signed to any new terms or CCA and if the accounts are still under the original cca would they be able to find it after taking over these accounts. The egg card was taken up on an internet application and i understand its dosnt come into the same area as hand written applications

Please can someone help me, I have just read in the National debt line book that if you take out a credit card on the internet then the rules on asking to see the CCA and the chances of claiming for enforceable agreement is not good. I was about to send my request to egg but i filled in the application on the internet and everything is internet based on the account. I am paying nearly 300 a month and interest is around 170 but as i am selfemployed my income is now dropping and i am struggling to pay my debts. I really dont know what to do and finding myself not sleeping and worrying all the time. At the moment i have not missed any payments to creditors but things are getting hard now. hope someone can help.

Hi, I am about to walk into the big pond and i cant swim so i hope i dont drown, lol I am going to start to see if my egg credit card is unenforceable after reading posts on here, I dont have a clue what i am doing so will someone walk me through the process's. I was going to send the national debt line standard letter asking for a copy of the CCA form relating to my account but i am worried because i only got the card around last august 07 and i did hear that it had to be an account which was opened before April 07. thanks for a great site which i will be donating something to help.   8. thank you poppy for the reply, yes we did appeal and what we got was them saying we had not proved we had sent the form back therefore the appeal was rejected and the decision was final, they then started getting really heavy with phone calls and calling at the house , we didnt want to end in court and couldnt find anyone to help, so we agreed to paying £100 a month back but i have since found the photo copy of the form.

  10. hi, i have a quick question. I have a card that i took out about oct 07 and transfered a large balance to it. am i still able to try and make a claim under the CCA or does this card come under a newer CCA which means i have no case. thank you
  11. Thanks for that chris, would you be able to guide me through the proses as i dont have a clue about how or what to do, i am also worried that the card company will get nasty if i start a claim. I am with egg at the moment with a 0% deal on balance.
  12. I think this is very interesting, i have been looking at sites about claiming but they charge so much and some want 30% of the claim. i would end up in more debt than i had before. has anyone made a successful claim or will they fight you in court. paul
  13. hi, this is my first post and hope someone can help, We have had an on going fight with the revenue over our tax credit award back in 2004 ( i think, will have to check) it was one of the first years when they started, we gave in last year after they started scarring us with court action, We were awarded £3,000 which we were entitled to , I set the declaration back and have a photocopy of it, and that was it so we thought but about 2 years ago they said they wanted all the money back because they never received the end of year declaration back, i am self employed so i am used to sending forms back on time and i wouldnt have a photo copy if not. I wrote to my MP but nobody wanted to know, all they said is i had to prove i sent it. we have been paying £100 per month back as we dont qualify according to them anymore but now it is becoming hard to find the spare money to pay them. can anyone tell me what i should do.
