  1. That sounds similar to this debt. Hopefully this will be on permanent hold. In fact I'm almost sure that this debt has lost it's id along the way as it's now in one name & I think it was originally a joint account.
  2. Have they actually said your account is on permanent hold? The one but last letter of mine says that as a gesture of goodwill they will put the acc on hold until they receive further commincation from the OC. The last one says that they still cannot provide me with my requested info.It does say that they are working hard to obtain it. In 2 letters they say that the OC have not been able to locate it from their archives. Cabot state that they will continue to ask the OC for the info & that they hope to receive it shortly.
  3. I meant that if I receive as many letters for the next 6 years until it becomes SB then I'll have enough to paper the shed with. My last & final payment to them was last Nov sent alongside the CCA request.
  4. I have just had another look through my Cabot letters. I did send them a account in dispute letter. I now remember thinking I had not needed to have bothered because the day after I posted it I had the reply to it. Yes they were ahead of me with it but I did actually send them one & have proof it was delivered. Have had the usual bumph from them since saying they are still awaiting a response from the OC.
  5. Will keep them all & when the account is statute barred I'll paper the shed with them. They love me so much they don't want me to forget them, that's what it is!!
  6. I have not sent them the follow up letter but they have sent a response to what would have been it. They love sending them so much they are ahead of me. It's just filed away with the other letters from them. They have put a hold on the account due to not having the cca so I'm not overly bothered about it now. I find it amusing to see how many different ways they inform me of the same thing. They do not have the CCA. This acc is years old & has been passed from dca to dca a number of times. I almost look forward to the next Cabot letter.
  7. I get letters from them every few weeks but none of them are my CCA. They all state similar things. The last one said that I could apply to the Original creditor for the CCA if I liked. Don't think so! It's more than obvious that there is no CCA.

  9. Thanks for that Slick I have today received another letter, this one dated 30 12 08. They have enclosed a copy of my terms & conditions. It's just their standard T & C's. The covering letter has my name & address but this time they have failed to include my acc ref no.The space is blank where it should be. I have given BC 10days from the receipt of my last letter (delivered yesterday) to address my queries & then I am going to seek legal advice, I have had enough of them brushing over everything. Each time I ask for answers they either send me a bundle of statements, their current T&C'c or current contract.
  10. Hi Slick I really cannot remember when I took on the BC account. I do know that I did not have it before Jan 97 & it went over to reduced repayment in June 2000. The closest I would say is mid/late 97. I remember being surprised them letting me have it as I was not working. I was a stay at home Mum & OH was working full time. Each time I neared the limit on it they would raise it. Having spoken to the fella at BC yesterday he said that even though the statement said nil in 2007 there was still a balance of almost a £1000 outstanding.:-? I have also just noticed that the letter states that they have omitted the interest charges as they are no longer applicable to my account. The bottom left hand corner of my alleged agreement clearly states interest charges. I'm not sure that I will ever get to the bottom of this. Thanks for taking the time to help. ITO
  11. Latest news I phoned BC yesterday to ask what was happening about the refund of the overpayment. After BC stating that they have sent me all the data they have (a bundle of statements) on me in response to my Subject Access Request on the 13th nov they have found more Data. It would seem that they have a a harder dig to look for what info they may still have. Is it normal to receive data after they have said they have nothing else on you? They now say they have copies of letters dating back to the original they sent me when the account went to repayment. I did say that if they can find letters dating back to 2000 then they should be able to find statements that far back too. The reply was that the letters were stored in a different place by different means so they would not be able to find the statements from then. There are also other letters that I have never seen or have no knowledge of. I have asked for copies of these letters to be forwarded to me. They today sent me a response to my cca request. Please see attached. It is dated 31 12 2008. Sent after they stated they had no further data. they have sent me a copy of thier current BC agreement. They state they can do this because the account was opened before 19 05 1985. I did have a seperate Bank account with them prior to this date which was closed around the same time that this BC account went to repayment. This BC account is no where near as old as that. I cannot say when the BC account was opened but would hazard a guess at about 1997 but definitely no earlier. I would like to think that they have no original CCA & that is why they have sent me this instead. I don't think they actually know what they are doing.
  12. I bet they look they are sucking lemons when they get these CCA requests firing at them right left & center!! I still cannot believe it was that easy. A total of 8 days from CCA to sucking lemons! Thank you.
  13. Just another question if you don't mind please. How does it work that these Dca's say they refer the debt back to the original lender when they have owned the debt for years,in this case over 10? It seems they have no legal right to it as they have no CCA. I would have thought that the original lenders right to collect on it would have been lost when it was sold to the DCA. Canthey suddenly start asking for payment on something they no longer own? Thanks ITO

  15. Hi Until I discovered this site I had no idea I could do anything about these debts other than continue to pay. This could have gone on for another 15 yrs! I so hope this is the end of it. I expect I have paid for whatever it was a long time ago. It really is worth CCA ing these 'old' debts!
  16. Thank you. Shall I file the letter under 'leave alone for 6 yrs' & hope that no one else contacts me? I don't even remember what this debt is for it's so old. If anything my guess is, it was maybe a chest freezer or such like back in my previous marriage.

  18. Hi 8 days ago I sent a CCA request to Robinson Way & Co. They sent the £1 fee back return of post with a compliment slip stating they have sent me a seperate letter. The seperate letter arrived this am. please see below: Does this mean it's all over? This is a 15 yr old debt that I have been paying £6 @ month on ever since. The last letter I had from them was in 2003 & had an alledged balance of almost 2k on it. I'm not sure that was all debt or debt + charges. I was just happy that they never hassled me & carried on paying them. They state that I should now deal with Lombard but don't say how. Should I just let sleeping dogs lie? If I do nothing will I get Lombard after me? But then the amount owing on this letter states zero??? Any advice is appreciated. ITO

  20. Thanks Slick I was rather hoping you would be about as I know you are aware of my situation. They are not very consistent are they. They tell me they have no more data on me but a few weeks prior they sent me data they say does not exist. I thought that sending the account in dispute letter would be a pointless exercise. Shall I send the request for the overpayment to the head office address that the Sar & cca requests went to, or use the one that is on my recent correspondence from them? Shall I bother sending copies of my bank statements to them to prove I have made these excess payments? ITO
  21. Just been having another look at the response to my cca request letter. It states my original lender as citifinancail & that it was a loan. I have never had a loan from citifiancail. I believe them to be one of the previous owners of this debt, not the original lender. Prior to them it was someone else. I have also been reading a correspondence from Cabot dated November 2006. It's a shame I did not know about the CCA back then. One of the paragraphs state; 'If for any reason, payments are not received by the agreed dates, the arrangement will be cancelled & we will enforce our right to payment under the original terms & conditions.' It states T & C's not contract. So is that in itself evidence that they do not have the original contract?
  22. Update Today is 22 days since the Subject Access Request & CCA request. I have today received the following letter from BC enclosing less statements (Nov/02-May/07) than they sent just before BC themselves suggested I Subject Access Request them. It states it's all the info they hold. Funny that as a few weeks ago they sent me statements starting June 02. To date they have not responded to the CCA request. They have not returned the £1 postal order either. The ones BC sent prior to the Subject Access Request are for period June/02-May/07 The Statement below is the final one of these in question & it shows a balance of Zero. I have paid & have evidence of 19 Monthly payments via Standing Order since the zero statement. As this is not the usual reclaim issue, it's now a case of getting back the money I have overpaid. Could I phone them & discuss it or is it still a good idea to do everything in writing. Will it now just be a simple case of I have overpaid & would like it back or will they put hurdles in my way?   23. Thanks to you both. I think they acknowledged my request because I put my monthly cheque in the same envelope. They could hardly say they have not received the CCA when they have already cashed the cheque. But having read some of these threads I guess any thing is possible. I've never known them cash a cheque so fast! I sent a CCA to Robinson Way for a debt just as old on the same day so I am waiting for their response. I'll start a new thread on that when I hear from them. Does everyone have the £1 fee returned? Had I known I would not have had it payable to them.
  24. Hi everyone I would like some advice on what to do next if anyone has time please. This is a very old debt. even I'm not sure who it was originally with, what it was for & how old it is. I think it's about 1996 or even earlier. I know I transferred it to a debt agency (I paid them & they paid my debts after taking out a fee) around 1998 ish. I then paid it direct some time after, once I realised that paying that agency £30 a month of my money was not a good idea. I think the debt has been sold on 3 times since then. I have paid them (whoever was asking for it) a regular £10 @ month since. The debt stands at over £2000 according to Cabot. But as I say I have no idea how much of this money I do indeed still owe. I discovered this site a while ago & decided maybe it was time to do some financial spring cleaning. I've just received the response to my CCA request from Cabot Financial. They've returned my £1 postal order and stated that .. ..They are not obliged to provide such info ..They have returned my £1 fee (what do I do with it? It's crossed payable to them) .. They anticipate being able to provide this info in 12 days If any one has any knowledge of where I go next with it I would be very grateful. Below is the letter recieved today. They were very fast in dealing with it. I only posted the request last Friday. Thank you ITO
