  1. Hi Has anyone else had a notice of intended litigation from Moorcroft's pre-court division? Also, could anyone advise as to whether the attached file represents an enforceable agreement or an application? This is a practically illegible photocopy which has been sent by iQor. It's confusing that iQor and Moorcroft have both written regarding this alledged debt on behalf of RBS. Would Moorcroft have to produce a true deed of assignment to say that RBS had legally passed on the debt and would they therefore also need to produce the original agreement copy, not a photocopy? I'm not sure where things stand legally. Many thanks for any help and advice received, Moneyprobs
  2. Hi Can anyone advise on dealing with a Notice of Debt Collection from Wescot on behalf of RBS? A letter will be sent to Wescot with a request for an original CCA. After the statutory period, if an original CCA is not produced, what further action can be taken against Wescot? Also, does anyone have a simple and accurate definition for 'true copy' of a CCA? Finally, has anyone heard of Capital Bank and specifically, debts originating with RBS being transferred to 'Capital Bank'? If a DCA letter referred to Capital Bank as a client, rather than the original source (RBS) how does that sit legally with all parties (original creditor - intermediary creditor - the multiple chain of subsequent DCAs and the person with alleged liability for the debt?). Hello everyone Just wanted to ask if anyone knew the legalities concerning threats (by Blair, Oliver & Scott - essentially RBS) to apply in court for a charging order on someone's home with regard to an unsecured personal loan? Would a charging order be legally enforceable? Also, iQor were unable to provide an original credit agreement and have stated that 'this has been closed on our files and returned to our Client for their control and management'. A subsequent threatening letter has arrived from Wescot Credit Services (on behalf of RBS) and a letter has just been sent to them also asking for the original credit agreement. Anyone dealt with Wescot? Thanks M

  5. Hi again Just wanted to add something about that that last letter from iQor (demand for payment in full within less than 4 days from receiving the letter!). I can't find an account number anywhere on the letter, just a reference number and also, the proposed pay in full deadline is 10am on a Sunday when their phone lines are closed anyway. Have decided to send the request for original CCA of to them today. Hope this is the right thing to do. Fred - you mentioned about iQor being pretty far down the food chain - could you give me any more info on this - thanks. Thank you all M
  6. Hello folks - it's reassuring that you've been able to deal these iQor bullies. Having sent the letter to them regarding the legalities of their proposed 3rd Feb doorstep call (which has gone unacknowledged), a letter from them came today 'Notice of Legal Proceedings' demanding payment of the debt in full by 10am on Feb 1st (2 days before the original intended doorstep call??!!). In their letter they have threatened court action (incl. examination of my means), proposed deductions from my salary (they don't know whether I'm salaried or not!) and seizure and sale of my property. Does anyone know where iQor stand legally on any of the above threats? The letter is not signed in any way, there is no iQor named person on the letter for reference, but as ever, there is a number in bold (!) to call and I clearly stated in my letter to iQor that all correspondence was to occur in writing. Should I write to iQor now asking for my original CCA (as I did with BO&S) as iQor have purchased the debt and presumably need to provide proof of the original agreement too - does anyone know if this is the case?   8. Hi everyone I've been sent a letter demanding payment in full from iqor (who had the debt passed on from classic card who I've never heard of either!). Prior to that, the debt was held with Blair Oliver & Scott, who I was in written correspondence with (following advice from this forum) and originally the debt was held by the Royal Bank Of Scotland. Are these debts just being sold on to new DCAs every few weeks??! Iqor are going through the pre litigation threats and instructing phone contact to be made. My understanding is that all correspondence should be undertaken in writing. Iqor are also threatening the doorstep call. Now I've just sent a letter to AA Personal Finance as they sent an impersonal card (with no reference to an account or debt) stating that one of their representatives will call at my home on 3.2.09. The letter I have sent to them makes reference to Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R. regarding unlawful entry to private property. Has anyone else on the forum experienced anything similar and could anyone advise whether I'm on the right track? As ever, many thanks moneyprobs x

Hi Forum Friends I've now received letters from both Fredrickson International Ltd (Capital One) and the Bank of Scotland regarding my recent request to obtain copies of the original credit agreements. Both letters are neutral in tone and have stated that the matter is currently being looked into. Today I received a letter from Blair Oliver & Scott which failed to acknowledge my request for the original credit agreement and which was threatening in tone, as previous ones have been. B, O & S have already had 2 registered post letters from me regarding the account (which they haven't responded to) and I just wondered what the next step would be to take with them?   10. I haven't, but I kept the receipts and relevant evidence from the post office transactions at my end. I think I'll now go ahead with a follow up letter which I've just read here on the forum. I feel I need to act promptly at this stage, plus at 35 weeks pregnant I've just been diagnosed with obstetric choleostasis and may be induced any time from next week or so and I hate having these threats from the DCAs hanging over me at such a worrying time. Hi everyone I've heard nothing from Blair, Oliver & Scott or Fredrickson International Ltd regarding requests for copies of original credit agreements and we've now gone beyond the statutory time limit for responding. I just wondered what the next step would be to take with both DCAs? All advice gratefully appreciated Many thanks

Hi there Am awaiting a response from Blair Oliver & Scott (deadline next Tues) regarding request for original credit agreement and have now received a similar letter from Fredrickson International regarding a Capital One credit card balance. Have sent a letter to them too today asking for the original credit agreement, so will wait to see how they respond. There seems to be a real surge of activity and increase in threatening demands at the moment judging by the letters received by friends and family recently. I'm directing anyone I know in similar circumstances to this website and many thanks to those out there who are able to offer support and advice. Kind regards Moneyprobs

  14. Hi everyone, having read some of the threads concerning dealings with DCAs I've decided to get my head out of the sand and follow the example and advice of some inspiring members on this site. I've recently had threatening letters from Blair Oliver & Scott in addition to Debitas and am now going to request a copy of my original credit agreement, correspond only in writing (the call centre harrassment is dreadful) and do all I can to sort my finances and credit file out. In all honesty, at 7 months pregnant (with a 2yr old already) taking on these bullies is the last thing I want to be doing and I am feeling very apprehensive. It's only reading some of the success stories posted on here that's finally given me the courage to take action. Any advice offered would be gratefully received. With thanks and best wishes xx
