  1. I made a partially successful claim almost 2 years ago. Never followed it through due to family issues. Now shabbeys new charge regime (which effectively doubles the charges) has got my back up so I'm going back for the balance and more besides. Just a few questions:- has anything changed in the recommended claim procedure since late 2006 ? Can I reclaim their new "instant overdraft monthly fee" which they kindly charge me for authorising an overdraft on my behalf, and without consultation with myself ? What is the likelihood of them cancelling my overdraft ? I have since moved my current account elsewhere. Its almost £1K and would get me into all sorts of trouble if I had to find that amount instantly. Cheers for any advice in advance. ..... amd one more question while I'm on it.... How do I incorporate the refunds I received into the spreadsheets ? If I insert it as a -ve on the sheet then it appears to credit the total with interest from the date that I received it. However, if I simply remove it off the total then I will have been charging interest that I am not entitled to.
  2. Due to inconsistancies in the dates when my salary goes in, along with my mortgage DD being presented, over the course of a year the payment can be returned unpaid 2 or 3 times a year. Up to now there has not been a problem as the C&G re-present the DD a couple of days later, its paid and that's the end of the matter. However for the last 2 months they have decided to charge me the standard "non-Payment fee" of £31. Is this a new tactic in anticipation of the judgement from the forthcoming OFT case or have I just been unlucky not to have been changed before.
  3. Last summer I initiated the process of reclaiming 6 years of bank charges across 3 different accounts. The sum total came to roughly £1200. I followed everything down to the last detail. Both letters, completed the spreadsheets and registered it all on moneyclaim, though didn't carry it through. We had a bit of a family crisis and it was left on the back burner while more important matters were sorted out. In the interim they actually refunded several hundred pound of charges. My question is this..... can I now resurrect this claim, and if so, will I need to re-submit my LBA or simply revise the spreadsheets and complete the moneyclaim submition ? Also has anything major happened in the ensuing months that I should be aware of ? I've had a brief scan through the board and nothing seems to have changed too much, but have I missed anything important ? The stupid thing is that I would really have let this thing lie, but they have just dumped me with over £50 in charges due to a direct debit going through one day earlier than expected. The value of the DD ?........ £1.54 ! Anyhow.... I'm back and I'm p*ss*d off

  6. Just by way of a bump to get the above questions answered, and a further update. My accounts this morning reveal refunds of approx £250 in relation to "misc charge refunds"...... a sweetner ?...... and they gave me no indication that they were going to do this. Still it only represents about 25% of my claim so I'll add the credits onto my spreadsheets and carry on. ...... the questions above.... I've read a few threads that suggest the "daily rate" should be a fixed figure in pence rather than a %age interest rate. How should I calculate this ?
  7. OK an update.......Gone through the letters process and received nothing other than the standard "4 week stalling" letters. I am now completing my case on moneyclaim. I have included the standard text found on here along with the additional text for claiming interest. Couple of questions.... Do I simply divide 8 by 365 to get the daily rate of interest ? Should I be including the account numbers within this text ? Cheers in advance..

Why won't it let me save/submit even though I am below the number of permitted characters and have not used the forbidden symbols? Is it the number of rows (max quoted 24) and if so, how on earth do I sort that? Cheers in advance..
  9. and as a final indication of just how much they pay attention to what we ask of them..... The £10 cheque that I enclosed as payment for the data relating to manual interventions........ Well they asked me to ring if I didn't want them to use it against the cost of providing the statements. When I rung to tell them "NO".... I discovered that they had already cashed it.....THE DAY BEFORE THEY SENT ME THE LETTER. LBA will now be sent this weekend.

  11. Well I don't need the statements..... I have over 10 years of them.. COMPLETE ! So as I undrestand it, the SAR letter was just an opportunity for them to demonstrate that the £30 "cost" could actually be justified. They declined to do that, but any court judge should now be happy that I gave them the chance. Now I just go for it with the LBA this weekend as the 14 day Prelim Letter deadline will have passed. Unless anybody advises me different.
  12. OK an update.... Sent out my Data Protection Act letter 14/7. I amended the template as I had no need of the statements, just evidence of any manual interventions. Enclosed my £10 cheque. Also sent my Preliminary letter similtaneously. I sent out a single letter in each case to cover both accounts. Received acknowledgement of both this week. In the case of Data Protection Act, they completely ignored the content of the letter and just blabbed on in the replies (1 for each account) about the.... "statements...microfiche... blah...blah...blah" With regard to the manual interventons they state that they are unable to help because.... So can I assume, that as they are unable to produce them upon my request... then it will similarly not be available were they asked to provide evidence in court ? The reply to the Prelim Letter simply expresses their apologies that I feel I have the need to complain. No reference to the circumstances. They enclosed a "How to Complain" leaflet and said that I would be contacted within 40 days in relation to my complaint once they have undertaken a "thorough investigation". So......... I gather I press on and send my second letter this weekend ?
  13. This is the oldest car hire/lease [problem] in the book. In the first instance have you copies of the usual documentation that details any marks on the car at the time that you collected. If they didn't provide you with this opportunity then they will be unable to prove that your caused the damage. In this case.... its gonna be small claims to retrieve your money.
  14. Thats fine .... but there is no way they are allowed to transfer an account and offer detremental or even different terms from the original contract which you signed. If they fail to offer the same terms then I'm pretty sure that you would be entitled to cancel the arrangement.

  17. In our case we had had an external bell on the system. However this had failed months before the socket failed. Engineer is going to blame that..... I know he will.
  18. I've had a very similar experience. I was looking back over previous bills and discovered a £55 charge. Queried this as I had no recollection of a visit from an Engineer. However it was before Xmas. After chatting with the other half she reminded me that a bloke had called after I had reported a fault. He was in the house 5 minutes.... removed something from the master box .... made a test call a..... and left. I rang BT in Bangalore or wherever it is this week to contest this. They are going to raise the issue but were unable to give me any reference that would enable me to prove that I had logged this issue. I aint paying this...... its cr@p..... and I can have cable.
  19. Just started against Abbey and now considering Capital One Credit card. I have one fear..... If I do this will they call in the loan/debt as i can no way afford tro pay up in one lump sum ?
  20. Thanks to the help over the last couple of days on here I've now taken the plunge. Total claim over three accounts for the last 6 years is just short of £1K. Intend to post my preliminary letter this morning RD. One question. I've kept all my statements so no need to apply for the full Data Protection Act thingy. However following advice on the General board I am amending the standard letter to read as simply a request for a list of manual interventions. I'd appreciate it if somebody would just cast an eye over the proposed letter and would welcome any comments..... ........ well I would if I could copy n paste the text from my doc into this box...... why won't it let me do it ?
  21. OK.... I get it now. So if you've no need of the statements, you could actually send a letter requesting details of manual interventions and you preliminary request letters similtaneously ? Just want to get things moving really
  22. So are you saying that, despite what it infers on the "step by step guide" on here, The DPA App is an important part of the process ?

  25. OK, I've completed the relevant spreadsheet from the statements of my 3 accounts over the last six years and understand that initially I send the middle of the 3 sheets for these. I'm now looking at the initial letter letter templates and there appear to be 2 with very subtle differences. 1/ Letter Before Action (LBA) 2/ Preliminary Approach. What factors dictate which of these is most appropriate for my circumstances ? My bank is the Abbey and I have only had a casual conversation on this subject, in which they referred me to a branch.
