  1. Hi, in brief another business is using my business name, its the same industry in around the same area. I have been trading using the name for 12 years and as far as I can see them only 3. I have owned the website, emails and url with the name and reported my tax returns under the business name in question. I am a sole trader, not too sure their status but would like to know if it makes a difference if its ltd company on their part. I do not believe the business name can be trade marked but will be looking into this. Any advice would be greatly appreciated. I would like to try and keep the name out at the moment. Thanks in advnce
  2. Hi, I'm recently looking at shared ownership leasehold properties. If anyone has been looking you would notice most of these have a premium attached to the sale as a cash upfront payment, on asking I get told its for fixtures and fittings and improvements made to the house, these can range in price from 10000 to 50000. My question is are these even legal, and why are they a thing, surely the value of the improvements have made to the house is reflected in the price of the house.I'm confused as to why anyone would pay this. The First thing you would do is re do it all to your taste. Any advice on the matter would be appreciated, these premiums make affordable housing unaffordable. I read somewhere there was a petition or something to get this banned
  3. Hi, thanks in advance, I have taken out an isa on the basis of using it to buy my 1st property. I understand it has to be open for 12 months before you can access it, all good as was opened a year ago and took advantage of the 25% top up from the government. My question is how long does the deposit need to be made before I can withdrawal the second year's amount, you are allowed 4000 per year and is topped up to 5000, I understand the 1st year to wait, but is this still the case for the second year's deposit, I.e if I deposit another 4000 and get the 1000 extra, do I have to wait another 12 months to access these funds or are they available sooner, as I will be looking to purchase in the coming months. I hope this makes sense but cannot find any information, obviously it's a lot of extra money but no good in a year's time.
  4. Good news. They received a letter cancelling the ticket. So all good. Thanks for all the help.
  5. Having not heard anything, they looked onto the parking Eye appeal portal and now says amount owed 0.00. Not too sure if they will write or of that's it done with.
  6. Exactly, so trainline would of known. So they shouldn't be selling tickets. Is that not illegal or fraud?
  7. I didn't know unfortunately, my local line was closed and no tickets for sale. I found the nearest one open, they had tickets available so purchased one, as a consumer I was made to believe as I could purchase one the train was on. Turns out they should not of been selling them either.
  8. Hi. A pretty serious scam looks like being done by trainline, they seem to be selling tickets for trains that either do not exist or they know are not running and I have proof. They knew full well about the strikes happening in October as the union told them on the 13th September some x2 weeks before the action to close some line. They sold me a ticket on the 26th September ( I no doubt expect thousands of others too) for the 1st of October which they knew was a strike day. I had no issue getting a refund, but they kept a 99p booking fee. Now I put it to you that they have done this on purpose to gain revenue from the booking fee knowing the trains were never running. I have complained and got mine back, but it took some effort. I feel something should be done about this. Is there anything that is recommended, I have logged a complaint with the ORR Office of Rail and Road. But is there a trading standards body or other way to get this actioned. They are clearly making thousands conning people and need to be stopped and held accountable.
  9. They are still awaiting the response, I will update as soon as possible. They have made it clear they will fight it in court if needs be
  10. Ok thanks for the reply, what sort of action should they expect? Is there a way to counter sue them to stop it ?
  11. Appeal was sent on the 27.9.22 here is the appeal, I entered the car park at 13:34:32 as per your camera evidence. I called the automated payment line twice at 13:39 - 4 minutes and 28 seconds after entering the car park. This was After finding a space, walking to the payment machine, reading the payment procedure, making a note of the payment location and payment contact number, walking back to the van and getting my payment card. I spent 7 minutes 7 seconds registering and 1 minute 23 seconds paying, as per x2 attachments of screenshots from my phone call logs and call recorder app as evidence of number called, date called and call duration. I also have the calls recorded. I paid for parking for x2 hours at 13:47 this was £3.20 with card number ending 0750 - upto 15:47 as per recorded phone call and attached call logs. I have attached a copy of the payment as it appears on my statement. I left the car park at 15:52:05 as per your evidence. As per my 10 minute grace period I should be entitled to leave the car park by 15:57, which I did. I feel I have done everything I possibly could in a reasonable amount of time to pay for my parking and leave on time. I do not feel i should be penalised and will defend the ticket. I will not enter into anymore correspondence unless it is in a court of law in front of a judge.
  12. Not too sure if they have a copy, they have wrote to then explaining it took that long to buy a ticket and that they should be entitled to 10 minutes grace at the end of the parking time.

  14. Hi, thanks in advance. A friend parked in a car park managed by parking Eye. They arrived and was recorded by camera entering at a certain time and leaving after 2 hours and 17 minutes. They have evidence They paid for 2 hours over the phone payment line by means of a bank statement and recorded phone call. This is a parking charge notice and only states the entry time and exit time along with the duration on site. There is no acknowledgement of any payment made or overstay mentioned. The date of the notice is 53 days after the event if this makes a difference and there is no mention of any laws. My queries are there is likely to be 2 issues here but both seem to be in their favour. The 1st being the time it took between entering the site and the time the ticket was purchased was 13 minutes. This was recorded on their phone call recorder. Broken down this took 4.5 minutes to park, walk to the machine gather all the information walk back and call the payment line. The next 8.5 minutes was the time it took on the phone to set up a new account and make the payment to parking Eye. They record all their calls and do have this saved. All in all it took 13 minutes to pay for the ticket, and was out of their hands the length of time the procedure parking Eye has set up. The second issue I see is the fact they left 5 minutes after the ticket had expired. Realistically with grace periods I don't see this holding up. Clearly the automated system has not taking any human factors into account. They unfortunately have already lodged the appeal to that effect. On the basis as a consumer they have done everything they could but have been forced into this situation due to unfair practices. They paid for 2 hours but was recorded onsite for 2hrs 17mins, of which 13 of these were parking and paying. I see 5 minutes of that as being grace on arrival followed by another 5 minutes on exit. Any advice would be appreciated.

  18. Ok many thanks. Can i just run just one last thing past you. A basic case, sells for 185,000, minus 15,000 purchase, minus 11,500 allowance, minus 10,000 selling fees stamp etc, minus 5,000 repairs double glazing etc, minus x2 years of her living there which she just confirmed - 170,000cg ÷ 15years = 11,333per year so minus 22,666 for relief of x2 years??, and do you get a standard 18 month relief on the last 18 of ownership? @ 16,999? Total equal amount of cg? Many thanks in advance.
