  1. Thanks for the advice, I have discovered I am classed under 'hierarchy liability' which means if no one else in the property has an income and I own the house I am responsible and my 'student' exemption does not count.
  2. Is that the case as I am a full time student? Does my income still count i assumed I would be exempt.
  3. Hi, I have been trying since September to sort out council tax benefit. I am a mature full time student and receive a superannuation pension, child tax credit and child benefit. My partner became self employed in September, receives working tax credit but has no income as yet nor any projected for at least six months.Am I liable for his council tax? I have had to send in all my bank account details etc (three times) even evidence of child support I should receive even though my ex husband refuses to pay. Would just like clarification as to my liability. I own my property. Thank you

    Hi,just a quick question, I have arrangemnets in place to pay a percentage of my surplus income to each of my creditors which are due for review in August. Does my student loan count as income?
  5. I am living in a property left to me by my parents whilst my ex-husband remains in our jointly owned home. I am now divorced but as my ex refused to deal with my solicitor the financial settelement was never sorted.My ex has not made any mortgage payments since November and as he was already on an agreement has now been refered to litigation.As a full time student I was advised by my solicitor not to make any payments although with two children am not able to anyway.The mortgage stands at £123,000 although the house when I left (accepting the fall in prices) was approx £180,000. I do not mind losing my share of the house as i just want to remove myself from any association with my ex.I am however concerned about a shortfall following repossession which as a home owner i might be force to take on alone as my ex is likely to become even more elusive.There is an endownment policy for £15000 which my ex wants to cash in to clear his debts but I am fearful he will just be putting off the inevitable and it will not be available if a shortfall does occur. The mortgatge is with Abbey. Should I contact my solicitor,the Abbey (who do know the situation) or the litigation company to put my case or see what happens? sorry this rambled on .
  6. Hi this is the first time I have written so I apologise if it's a bit complicated to read. Having separated from my husband in June 2007 I wrote and visited Natwest explaining my situation. I received a form for us both to complete,removed all my direct debits into my new Natwest student account and sent the form to my ex-husband to sign and return.When I left the account was overdrawn by less than £500. I was dismayed to discover in September 2007 via a notice under section (76)1 that the account was £4305 overdrawn and any money available in any other accounts would be transfered. I therefore had to change student accounts and tried to make some arrangement to pay a monthly amount of £60 per month which they collected from my debit card. They did not request it in April and said I was required to increase the amount to £75 which I duly did. In august 2008 I was unable to pay any of my creditors and defaulted making individual arrangements with each one. I wrote to Natwest explaining my situation and continued to pay a small amount each week.I was also informed that the debt was split individually. My ex husband is being dealt with by a solicitor in Birmingham and I have been informed a court date for February requesting a charge on our property which he remained in, is being requested. I received a letter from Moorcroft debt recovery (12/2009) and have arranged to pay £10 per week on a balance of £4624.49 which i assume will continue to increase.Do I have any means of stopping interest or claiming back the charges?Sorry this was so rambling.Thank you.
