  1. Thank you for the info I phoned the court today and the Judegment went through because Abbey have not acknowleged the claim. thank you for the correct info Micheal. I will now have to issue a warrant of execution will let you know what happens. Regards Ross
  2. please escuse my ignorance but surely if the bank does not acknowledged the claim then have have broken the rules of the FSA waiver. Which states that all claims must be akcnowledged by the defendent...in this case they have not done so should the claim go through the normal channels.
  3. I started a money claim against abbey national and they have not ackowledged or responded to the claim. Yesterday i issued a judement by default does this mean that abbey have not follwed the rules in the bank waiver where they must ackowledge all claims. I suppose my question is now i have issued a judgement by default what happens next.

  5. Hello all at CAG hope this is the right place for this. I am new to this so please bear with me. Since the beginning of 2007 i have been trying to reclaiming my bank charges. however due to recent event i understand that the test case has put on hold all the claims. Well guess what Friday 15th August i receved a letter from Wescott recovery services who are acting on behalf of Abbey national to claim back the overdraft i had when i was banking with Abbey. now i really dont know what to do they want back £150 overdraft and i am claiming more the £2000 back from them for charges. Can anyone give me advice on what steps i should take The letter says that i iwll be taken to court and item removed from my home to cover the cost. Any advice is welcome Thanks Ross
