  1. Hi! I have just sent a sar off to ge money for a loan taken out with them in 1998, there reply was that the origional documents have been destroyed as the loan was paid back in full in 2003, they did however send me a full statement of account, on the statement there are verious charges and on day one there was an insurance premium of £224 which i guess may have been a ppi. What i need to ask you guys is what angle should i proceed with this next if any? Many thanks
  2. oh yes and no problem though am not trying to blackmail my mortgage firm, the fact is they charge £25.00 per letter and if i send back the letters that were ment for other people without having my issue resolved, what proof would i have in court if it goes to court that i had been wrongly charged? You seem to know what you are talking about, can you advise on a letter, or could anyone else?

Hi! thats what i'll do i think, i'll tell them i wont except, and yes i received all details by sar though am a little unsure of what charges i can claim as its a mortgage account, any feedback on this would be a great help. Due to the fact that they didn't no how these charges were made up and in addition to this, there keeness to get the other peoples information back, i was thinking of writing one more letter before getting serious but stating that it is a final letter, though saying that what do you write to these people, and do you think its woth a shot?

I wrote to my mortgage firm requesting they pay back fees on my account if they could not demonstrate how they were made up, in return my mortgage firm basicly refused, now here is the interesting part over a period of time my mortgage firm have been sending me letters from other peoples accounts i.e mortgage statements with account details i.d ect ect so in responce to my decline i wrote back giving them 14 days to demonstrate how the fees are made up and if the could not demostrate it to return fees or court action! in addition to this i gave them a taster of the original documents i have received by way of account numbers of other peoples written at the end of the letter, within 1 day my old mortgage firm phoned me to discuss the matter, though you could see that there real intrest lied in the documents sent to me as they wanted them back, i said sorry not untill my issue is addressed as i may need to rely on this information with respect to letter charges, they said we cant give you a breakdown as how do we calculate an elctric bill and they went on to say the charges are just written we dont no how they are made up, after this she tried to get me to send the paperwork back again and i said no and that i had to go as i got work to do. Today 2 days later and 3 days from writing my letter the have offered me £140 and asked how i want it paid and also asked for the documents, my fees are around £1500 they include letters fees arreas management fees, i d/d fees etc, i my original letter was a 14 day request or court. I just need to know if i should persure or take the £140, they have stated they cant demonstrate the fees by phone call what do you think? and if you think i shoud pursue can you give me an idea of a letter to write? I will try and keep this simple as so far it has been very long winded, basicly i took out some holiday insurance with axa, needed to make a clain in march 07 i contacted them twice reg application pack, this was not received, by this time it was about nov last year, anyway no luck so went into the travel agents who kindly phoned axa on my behalf, finally early this year got claim application pack though it was the wrong one and although my address was stated it was sent to the wrong address also, went back into travel agents and got another pack sorted out the right one this time though still wrong address, filled in pack sent it off recorded post, never heard from axa so phoned them up, they stated they never received it, i said it was sent recorded, then in the next breath said they had but i need to sent one more receipt for a camera,there were other items also which they state the could not pay for as the type of insurance i had, i did this then claim was settled though they would not pay out for the camera, i wrote back in complaint reg shoddy service etc etc and that i should be paid and copmensated for all the trouble, they said we have real good customer service etc etc, yeah right! i wrote back a very detailed letter explaining all the probs etc etc they then said i was charged a to higher percentage and a cheque would follow i got a cheque today and over a year and a hallf later for £20 and in addition to this, this was the only time they got my address correct. I have tried to be brief and i hope you can understand it ok, i would like to take this matter further but i have no idea of the legal jargon etc, i.e as the service was very poor have they breached the goods and services act? what do you recommend to write back to them with? also i feel that i should be paid in full also for the items that supposedly was not included in my insurance, plus compensation for my worry and the problems encountered, do you think i am asking to much? I really want to take this further as not only do i feel i should get my items full value back, but maybe they will look into there practices and the next person will not have to go through what i have been through Hope you can help and many thanks!

  7. Hi all! I text my tenant reg sofa and washing machine, i told him unless returned id phone police, i heard nothing so phoned the police, they said its straight theft and he would be arrested, the next thing the tenant phoned and wanted to sort things out, i said he could buy them if he wanted he said yes and is meeting me tomorrow, i think i'll leave the rent thing and put it down to a learning curve, like you say never mix business with friendship, and to be honest from what you have said it seems like it will be hard for me to prove, Oh how lucky was i to have the mobile no for him

There were no terms laid down as i knew the person, he had been with me around two years plus, the agreement was verbal all i expected was that he paid on time and if he left then the decoration would be put back as he moved in, I phoned him to say his rent was due and he said he was moving out tomorrow, i inspected the property today to see that the toilet is broke two rooms are a different colour, and my washing machine and leather sofa had been taken!

Just spoke to my tenant today who is moving out tomorow without giving notice, the rent is on a monthly basis and is due tomorow, the tenant is refusing to pay as he said he is moving out tomorow and he is keeping the rent as its his deposit, The property has been painted by him and needs to be put in the condition as of when he moved in, also i will now lose rent on the property untill i get a new tenant, is there anything i can do?

My reason for getting behind in payments were due to a lul in work, and the amount i can afford to pay on top of my payments is £100 this will be going on my new increased payments which start on the 1-10-08 (end of 2 year fixed) With regard to the original request from me, i do not have it as i sent it to gmac, i do have the other persons letter received in return though

  15. Hi! Was wondering if anyone could help with carphone warehouse? I took out a contract with them a while ago on the 3 network, i cant remember properly but within the first month of contract i had phone problems and my phone was sent away 2 or 3 times to be fixed i cant remember, The end result was a broken phone and a running contract and carphone refusing to give me a new phone, as a result i was left with no option other than to take out a second contract which carphone were happy to do so i had to contracts going, the first one i let go by the way side as i believe they breached there contract. Now i am getting solicitors letters asking for money (the cheek of it) the last was a court hearing with a judgment order attached if i don't pay, i have just been ignoring them as of there shoddy workmanship and my lack of experience on these type of issues, if i could have my way then i think this issue with them should be squashed and any money paid to them returned and also judgment removed. What is your advice on what to do?

Yes i could get this paperwork printed off no problem, i have currently filled out the basic parts of the form and only part of section three which i have just stated i'd like to stop a repo the rest of section thrree and section ten i have left for your good advice. Thought i'd let you know that i have now instructed a solicitor as every time i tried to write to the other party there solicitor wrote back and added there charges to my bill so it was a bit of a catch 22, just to let you know my solicitor said that there costs were ridiculous and he also said he is able to change the contract so all sounds good at the mo, ill keep you posted;-)

I have just received my paperwork through the post and will start working on the form tomorrow, so i will stay in touch if possible? in addition to this i was wondering if i could put a small claim in at the hearing as i think the whole thing is a shambles and should not be happening, what i mean by this is as you know i received another persons paperwork(which i will take with me) now how do i know that this case is not based on his income expenditure etc which in his letter which i have was not excepted by gmac? if this is the case then i should not have to pay for solicitors fees etc etc or even be at court! Just to let you know that i phoned gmac the other day again to try and resolve some of my problems with them but all they were interested in was the other persons details i had and also the court appearance i turned upto before which was thrown out of court as it was of someone elses details, there was no talk of reimbursting me for there mistakes which i have had to pay for, i took the persons name and they said that they would get a manager to call me, i said definately and she said yes, nobody called! i have not spoken to a manager yet though on several occasions i have been told they will call me, they will sometimes pass you over to a supervisor but if its a manager its always a call back which in my case never seems to happen how bad is that! Anyway Ellen are these cases soley for stopping repossesions or could i try and get a few fees back here?

Just received a mortgage redemption quote from my mortgage firm as i asked for my exit fees back and they stated that they dont have exit fees, The quote is as follows word for word, Capital balance(excluding arreas of capital) £******* interest arreas, capital arreas, interest due and over payments £1,795.83 additional interest£4.45 early repayment charge £5,165,40 fees £760 redemption fees £0.00 Please could you advise on what i can try and claim back also the interest if any i could add if there is a claim?

Thanks! i don't have a printer, so i'll get the form over the phone from the court as i have had to before and i'll mail you if i can as this is not my first time in court so i think i may need to do a real good job and i know you are experienced in this sort of thing, And yes this is real bad about what gmac have done, i have received charges which are not due to my account and other people have got in deeper trouble as i have had there letters and they are proberly un aware! yes i would like to report them, how do you think i should try and get my charges back? at the court hearing? or in the traditional manner you use?
  22. Hi yes sorry! I have an eviction notice which was sent from eversheds? the solicitors name is mark smith acting on behalf of gmac, they are looking to repo my property though i am going to fill out application to the court in order try and keep things going, the thing is though, i really want to get my teeth into them and hopefully make a claim as they have had me in court before which was thrown out as the details were of someone else, not sure if i was charged, also they have sent letters which have other peoples details on, not sure if i was charged etc etc At the end of the day i would like to keep my house and get these charges back, some are due to me, some are due to other peoples accounts and the sad thing is gmac have broken the data protection act and in addition to this, the letter i got recent was one for a guy who gmac would not except his offer of payment , the poor guy has proberly lost his house now as he would have been un aware gmac didn't except his offer as i have got his letter!!!

Just got repo letter today off eversheds, my account is in £4500 of arreas, was thinking of paying the court fee and having it stopped, the thing is i am real unhappy with my mortgage firm as my arreas started in 2006 when my daughter passed away, i told my mortgage firm of this but they were no help i just had to go to court luckily the judge was ok and payments were arranged, one year later my payments started to slip again and once again had to go to court this was thrown out of court as the details eversheds had were for someone else not sure if i received fees and costs for this? now recently my situation has changed again so i wrote and phoned my mortgage firm to discuss payments, they sent me a letter back saying they will not except and guess what all the details on the account are yet again for someone else, don't no what charge i would have received for this paperwork, i shouldn't laugh at the mo but if i wanted to get a credit card in someone elses name then i think i could do it as i have all there details hehe! i have 28 days to apply to the court to stop this action being taken on my property, the thing is i really want to sort out this shoddy firm now, i am fed up with being on the phone for over half hour at a time only for the phone to go dead, i am fed up with receiving other peoples account details and proberly being charged for them god if only they knew! and most of all i am fed up of these damm charges! What is your advice? oh and to name and shame the firm it is gmac!!!!!!
